The Evidence Needed for a Trump Prosecution

It would be easier to prosecute Trump for January 6 than Peter Navarro. I say that (in advance of today’s debate about referring Navarro and Dan Scavino for contempt) because it is far easier to tie Trump’s actions directly to the successful obstruction of the vote certification on January 6 than it would Navarro’s, and Navarro’s actions are fairly tangential to the proof that Trump’s actions met the elements of obstruction of the vote certification.

Months ago, I laid out how to prosecute Trump using the framework that DOJ has already used with hundreds of January 6 defendants. But in this post, I will show how much evidence DOJ has already collected proving the case against Trump by using the framework for Trump’s criminal exposure laid out by Judges Amit Mehta and David Carter, incorporating a key point made by Judge Reggie Walton.

In his opinion upholding the lawsuits against Trump, Amit Mehta found that it was plausible Trump conspired with the militias and also that he bore aid-and-abet liability for assaults at the Capitol (see this post and this post). He found that:

  • Trump and the militias jointly pursued an effort to disrupt the vote certification
  • Trump planned the unpermitted march to the Capitol
  • Trump encouraged the use of force and threats to thwart the certification from proceeding
  • Trump knew supporters would respond to his calls to come to DC and march on the Capitol
  • Trump called for collective action
  • Trump intended his “fight like hell” comment to be taken literally and rioters did take it literally
  • Trump ratified the riot

In his opinion finding that one email from John Eastman must be turned over to the January 6 Committee on a crime-fraud exception (see this post), Carter laid out the following proof that Trump obstructed the vote certification:

  • Trump tried to persuade Pence to disrupt the vote certification
  • He publicly appealed to Pence to do so
  • He called on his followers to walk to Congress to pressure Pence and Congress

Carter laid out this evidence that Trump had corrupt intent:

  • Proof that he had been told the vote fraud claims were false and his own request of Brad Raffensperger showed he knew he had lost
  • Trump had been told the Eastman’s plan was not legal

Carter laid out this evidence he had entered into a conspiracy:

  • Trump held lots of meetings to talk about plans to obstruct the vote count
  • Trump ratified Eastman’s plan in his Ellipse speech

To those two frameworks finding that Trump probably conspired to obstruct the vote certification, Judge Walton held that you cannot point to back-room plotting to get to the intentions of the actual rioters; you can only look at what the rioters themselves accessed, Trump’s public speech and Tweets (see this post).

This table (which is still very much a work in progress) lays out what evidence would be needed to prosecute Trump. The horizontal Elements of 1512(c)(2)/Relevant to Motive and Co-Conspirators sections show what is necessary given the elements of the offense as laid out by the judges and in DOJ filings, versus what might provide evidence of a broader conspiracy. The Must Have/Nice to Have columns show that for each kind of proof, there’s what is necessary and what would be really useful before indicting a former President.

In other words, the things in the yellow boxes are the things that would be necessary to show that Trump obstructed the vote certification. They basically amount to proof that things that Trump did brought the rioters to DC and to the Capitol and that he had the corrupt mens rea to charge with obstruction. I include there proof that Trump conspired with the militias, which I consider necessary because the Proud Boys, especially, took the bodies that Trump sent them and made those bodies tactically effective.

While prosecutors are still working on tying Roger Stone to both militias and tying Alex Jones and Ali Alexander into the crimes at the Capitol, much of the rest of this evidence has already been collected and rolled out in charging papers. For example, I showed some of the proof that rioters responded to Trump’s attacks on Pence by targeting their own attacks on Pence. There are a number of Trump comments that directly led hundreds of rioters to start making plans to come to DC, including arming themselves; NYT recently laid out the most central communication, a Tweet on December 19, 2020, though not only is that focus not new, it’s the tweet and response to which Arieh Kovler predicted the attack on the Capitol in real time.

A number of the other things you’d want to have before you charged Trump are available to DOJ:

  • Details of how the march to the Capitol happened and why it — and Ali Alexander’s permitted rallies at the Capitol — made a riot more likely
  • Explanations why Ellipse rally organizers balked at including people like Ali Alexander and Roger Stone
  • Testimony from Pence’s aides about how Trump pressured his Vice President in private

It is true that the testimony of several people — those involved in selling the Big Lie and Scavino’s coordination of the riot (including a particular focus on The Donald) — would be really useful. But that testimony is as important to proving that they were part of the conspiracy along with Trump.

Pat Cipollone’s tesitmony would be incredibly useful to that case, too. Normally, he could invoke privilege, but Trump already waived some of that privilege by sharing details about his conversations with Cipollone with Sean Hannity. If Cipollone did cooperate with DOJ, I don’t think he would leak that.

Similarly, the Relevant to Motive and Co-Conspirators rows — showing Trump’s coordination with Congress or his prior planning of it — would be really useful to have in prosecuting Trump. But ultimately, as Judge Walton held, what Trump did in private could not have influenced most of the rioters, because they never knew those details. As such, some of that information — precisely the kinds of stuff that TV lawyers say would be the first overt signs that Trump was a subject of the investigation — is more useful for including others in the conspiracy.

The most important of this evidence — communications from the December 18 meeting and comms during the day of the riot — are already in DOJ’s possession from Rudy’s seized phones, whether or not they obtained a warrant for that content yet.

Update: I’ve tweaked the horizontal headings on the table to clarify that the top half of the table stems from the elements of offense for 1512(c)(2), whereas the bottom half is clearly related and may help prove mens rea or incorporate other co-conspirators, but is not necessary (in my opinion) to meeting the elements of obstruction.

Judge Reggie Walton Ruled Trump’s Back-Room Maneuverings Inadmissible for Dustin Thompson’s Alleged Obstruction

Last week, I showed that most commentators are looking in the wrong place — in the backroom plots to overturn the election — for evidence of Trump’s role in January 6. All the scheming at the Willard only matters, I argued, because it brought bodies to occupy the Capitol and threaten Pence. You find the evidence of Trump’s influence on the rioters in the words and deeds of the rioters.

That argument is backed by an order Judge Reggie Walton issued a few weeks ago in the case of Dustin Thompson, who is set to go on trial for misdemeanor theft and trespass and felony obstruction charges on April 11.  His trial will be among the first for a January 6 defendant accused of obstruction who did not, also, engage in or threaten cops. His prosecution is symbolically important because he filmed himself helping to ransack the Parliamentarian’s office, from which he stole a coat rack.

Because of his symbolic attack on the operation of the vote count, Thompson’s trial will be an important test of DOJ’s theory of obstruction.

For months, Thompson has been trying to get permission to call Trump and Rudy Giuliani to claim that he believed he was acting on orders from the President to occupy the Capitol and therefore did not have the corrupt intent to be guilty of felony obstruction.

Walton will permit Thompson to show the speeches of Rudy and Trump, but he rejected the defendant’s bid to call them as witnesses. He did so partly because of the circus doing so would cause (the legal term is “a trial within a trial” or “mini-trial”). But he also did so because Thompson would have had no knowledge of anything that happened behind the scenes. If he was genuinely influenced by what Trump said that day, it would have been exclusively through his speech and later Tweets. The best available evidence about what Trump said that — Thompson claims — led him to storm the Capitol would thus be the recorded speeches, not whatever Trump would say on the stand.

ORDERED that the testimony of the putative witnesses referred to in the Defendant’s Motion to Appoint U.S. Marshals Service as Process Server (“the defendant’s process server motion”), ECF No. 44, is inadmissible in support of either of the first two versions of the public authority defense as described by the defendant in his Brief in Support of Testimony of Donald J. Trump, et al., ECF No. 53. It is further

ORDERED that the actual statements of the putative witnesses referred to in the defendant’s process server motion are admissible (1) to the extent that the defendant can establish that he heard them prior to the acts that he is alleged to have committed and (2) for the sole purpose of attempting to show that he did not have the requisite intent to commit the crimes he has been charged with committing. It is further

ORDERED that the in-person testimony of the putative witnesses is inadmissible under Federal Rule of Evidence 403 because the probative value of such testimony is substantially outweighed by the danger of confusing the issues and misleading the jury. The only relevant testimony by the speakers would be the actual statements heard by the defendant prior to the acts that he is alleged to have committed. Testimony about an orchestrated or behind-the-scenes effort to cause former President Trump’s supporters to commit the acts that occurred at the United States Capitol on January 6, 2021, as alleged by defense counsel, is irrelevant as it has no relevance to the public statements that the defendant actually heard. Moreover, the probative value of the proposed in-court testimony about such public statements is lacking, given the duration of time since these statements were made and the improbability that the witnesses will be able to precisely mimic the text, tone, demeanor, and mannerisms originally used when the statements were made, all of which are necessarily relevant to the statements’ impact on the defendant’s intent. Accordingly, in light of the irrelevance of the alleged desire on the part of the speakers to incite the defendant to commit the crimes charged in this case and the substantial potential that their testimony will mislead and confuse the jury, it is therefore inadmissible under Rule 403. Furthermore, the recordings of what the defendant heard at the time the statements were made is the best evidence of the impact that the statements allegedly had on the defendant’s intent. For this reason also, the in-court testimony of the speakers is inadmissible. 2

2 It is inconceivable that any of the speakers will testify that they intended for the people they were addressing to commit the acts that the defendant is accused of committing, in no small part because doing so could result in criminal charges being lodged against them. Thus, it is highly likely that they would either assert their Fifth Amendment privilege not to incriminate themselves or deny that they intended to incite the crowd to commit the acts that occurred at the Capitol on January 6, 2021. However, even if the speakers were to so testify, such testimony would open the door for the government to cross-examine the speakers about their intent in making the alleged statements. This would inevitably lead to a mini-trial on the issue of the intent of the speakers in making their statements, which, as the Court concludes above, is utterly irrelevant to the impact of the statements on the defendant’s intent. This reality is further reason not to permit the speakers to testify at the defendant’s trial.

Thompson is going to have a hard time blaming Trump’s speech in any case. As Thompson’s co-defendant Robert Lyon admitted in his statement of offense when he pled guilty last month, he and Thompson weren’t paying close attention to Trump’s speech.

During the January 6, 2021 speech given by former President Trump, Thompson and Lyon twice went to get food from nearby food trucks. Thompson was also on his phone on various occasions during the speech.

Thompson also sent texts before he arrived in DC, including multiple ones pertaining to the Stop the Steal rally and others talking about arming himself, evincing his plans before the rally.

Those are the texts Judge Walton permitted the government to admit at trial.

Thompson will presumably still try to make his trial about Trump. But Judge Walton laid down an important principle — one that stems from the real influences on most (but by no means all) rioters — that Trump’s role in their obstruction stems from what is public.

Four Rudy Giuliani-Related Privilege Reviews: DOJ Likely Already Has a Version of Document 4708

As I noted here and here, on Monday, Judge David Carter ordered John Eastman to turn over most documents he had been trying to withhold from the January 6 Committee. That order found that it was likely that Trump and Eastman had conspired to defraud the US. But there was just one document turned over on the basis of crime-fraud exception: a document otherwise privileged under a work product claim that, Judge Carter ruled, could not be withheld because it was sent in the commission of the attempt to obstruct the vote count.

Here’s how Carter described the document:

In this email, a colleague forwards to Dr. Eastman a memo they wrote for one of President Trump’s attorneys.153 The memo sketches a series of events for the days leading up to and following January 6, if Vice President Pence were to delay counting or reject electoral votes. The memo clearly contemplates and plans for litigation: it maps out potential Supreme Court suits and the impact of different judicial outcomes. While this memo was created for both political and litigation purposes, it substantively engages with potential litigation and its consequences for President Trump. The memo likely would have been written substantially differently had the author not expected litigation. The Court therefore finds that this document was created in anticipation of litigation.

The eleventh document is a chain forwarding to Dr. Eastman a draft memo written for President Trump’s attorney Rudy Giuliani.274 The memo recommended that Vice President Pence reject electors from contested states on January 6. This may have been the first time members of President Trump’s team transformed a legal interpretation of the Electoral Count Act into a day-by-day plan of action. The draft memo pushed a strategy that knowingly violated the Electoral Count Act, and Dr. Eastman’s later memos closely track its analysis and proposal. The memo is both intimately related to and clearly advanced the plan to obstruct the Joint Session of Congress on January 6, 2021. Because the memo likely furthered the crimes of obstruction of an official proceeding and conspiracy to defraud the United States, it is subject to the crime-fraud exception and the Court ORDERS it to be disclosed.

Carter’s decision and the release of documents has set off the usual wails about how much more proactive the January 6 Committee is than DOJ, replete with statements of fact — almost always people who haven’t done any work to understand what DOJ is really doing — that DOJ hasn’t taken steps to obtain such documents itself.

I’d like to look at four privilege reviews that implicate Rudy Giuliani and show that it is likely DOJ already has this document or at least ones that are related. Those reviews are:

  • Judge David Carter’s review of 111 documents subpoenaed from John Eastman by the January 6 committee
  • The 11-month long privilege review of materials on 16 devices seized from Rudy Giuliani on April 28, 2021
  • Details released about Robert Costello’s advice to Steve Bannon provided in response to a subpoena from the January 6 Committee
  • The known details about subpoenas served on Sidney Powell’s non-profit, Defending the Republic

John Eastman

As explained here, the David Carter opinion describes the judge’s privilege review of just four days of materials (January 4 to January 7, 2021) responsive to the January 6 Committee subpoena to Eastman. Carter went meticulously through seven categories of materials in Eastman’s possession and determined that just ten documents could be withheld under a work product claim and one — document 4708 — had to be turned over under a crime-fraud exception.

Carter ruled the document — an email chain that forwarded a memo written for Rudy to Eastman — was excepted under a crime-fraud exception because, the judge described, it sought to transform Eastman’s Electoral Count Act scheme “into a day-by-day plan of action.” Eastman didn’t write it. Rather, because the document was created for Rudy, Carter treated it along with four others, “created by or for agents of President Trump or his campaign, including attorneys of record in state cases and President Trump’s personal attorney.” [my emphasis]

References to the document explain that Eastman claimed attorney-client privilege over the document (fn 81, 125) and someone wrote “PRIVILEGED AND CONFIDENTIAL” in email text (fn 101).

Carter’s review of the document is particularly valuable for how he dismisses Eastman’s attorney-client privilege claim: In hundreds of pages of briefing, Eastman provided no evidence that its sender was affiliated with the Trump campaign or was covered by Eastman’s own claim to be representing Trump.

Dr. Eastman claims attorney-client privilege over only nine documents: five emails125 and four attachments.126 None of these documents includes Dr. Eastman’s client, President Trump, as a sender or recipient of the email. Instead, all emails are sent from a third party to Dr. Eastman, and two of the emails blind copy (bcc) a close advisor to President Trump.127

Despite having filed nearly a hundred pages of briefing, Dr. Eastman does not mention this third-party email sender anywhere in his briefs; the person is named only in his privilege log entries. Dr. Eastman’s description in the privilege log is conclusory, describing the sender merely as his “co-counsel.”128 Dr. Eastman failed to provide retainer agreements or a sworn declaration that would prove this third party was an attorney or agent for President Trump. The Court also cannot infer the third party’s affiliation with President Trump from his email, which is a generic, [email protected] email address. Dr. Eastman has not met his burden to show that these communications were with an agent of President Trump or the Trump campaign, and as such, these documents do not warrant the protection of the attorney-client privilege.

In other words, there was someone involved in relaying a memo originally written for Rudy to Eastman that Eastman didn’t want to or couldn’t argue was a Trump lawyer. And that’s why this attorney-client privilege claim failed. That’s an important detail because — as we’ll see — Bannon tried something similar.

Rudy Giuliani

Now let’s turn to Rudy’s phones. As I keep explaining, while the known warrants used to seize Rudy’s phones cover his Ukrainian influence peddling and cover a time period from May 1, 2018 through December 31, 2019, SDNY got Judge Paul Oetken to approve a Special Master review that covered the period from January 1, 2018 through the date of seizure, April 28, 2021. Special Master Barbara Jones’ review is only for privilege claims (including Executive privilege and attorney-client at least), not for responsiveness to any subpoena, so the end result of her review will result in turning over all non-privileged content on Rudy’s devices from that 28-month period.

That means if the person who created the memo forwarded as part of document 4708 sent it to Rudy on one of the devices that were seized, then the underlying memo would be included in the Special Master review.

We don’t know how DOJ has prioritized this review. We know only what is in this and earlier reports, which I’ve captured in this table.

Jones did an initial review, covering the entire timeframe (that is, post-dating January 1, 2018) of 7 devices, from which she found 3 documents about which she had some question, but ultimately deemed them privileged and turned over 2,000 other items.

Then, seemingly in parallel, she did a review of Device 1B05 (a cell phone) and 8 other devices. For the 8 devices, her review covered only the period of Rudy’s Ukrainian influence peddling. But for Device 1B05, Jones’ review covered the full 28-month period, meaning it would include any texts or messages sent on or pertaining to January 6.

I next assigned for review the chats and messages that post-dated January 1, 2018 on Device 1B05, which is a cell phone. There were originally 25,481 such items, which later increased to 25,629 after a technical issue involving document attachments was identified. An initial release of non-designated items was made to the Government’s investigative team on November 11, 2021.1

Of the total documents assigned for review, Mr. Giuliani designated 96 items as privileged and/or highly personal. Of those 96 designated items, I agreed that 40 were privileged, Mr. Giuliani’s counsel withdrew the privilege designation over 19, and I found that 37 were not privileged. I shared these determinations with Mr. Giuliani’s counsel, and they indicated that they would not challenge my determination that the 37 items are not privileged. The 40 privileged documents have been withheld from the Government’s investigative team and the remaining 56 were released on January 19, 2022.

Device 1B05 was the only one for which Jones disputed the original privilege claims made by Rudy and his attorney Robert Costello. Of 40 items, Jones agreed with their privilege claim. Of 19, Costello withdrew the claim. And of 37, Jones told Costello she disagreed, after which Costello decided not to fight her ruling.

While these discussions were going on, Judge Oetken issued a ruling that, if Rudy wanted to challenge Jones’ rulings, they’d have to make their legal arguments (but not the content of the contested communications) public. During the Michael Cohen privilege review, such a decision led Cohen and Trump to drop privilege claims, probably over the crime-fraud excepted hush payment communications, and that may be what happened here.

Whatever happened, we know that, with the exception of 43 items, any January 6-related communications that were on half of the 16 phones seized from Rudy would have been turned over to the FBI for a scope review. To be clear, investigators wouldn’t be able to access those comms unless they got a separate warrant for them, but we would never know (short of an indictment relying on them) if they had.

None of that guarantees that the memo forwarded with Eastman’s document 4708 is in DOJ possession. If the person who wrote it emailed it, it would not necessarily be on the seized devices. (Though if DOJ had a January 6 warrant for Rudy’s phones, they presumably would have obtained one for his email and iCloud as well, as they did with his Ukraine investigation.) If the person delivered it by hand, it would not be on the devices. And it’s possible that Costello made a more compelling argument than Eastman did that the sender was covered by a privilege claim tied to Trump.

Steve Bannon

We don’t know what kind of wild privilege claims Robert Costello was making as part of the privilege review of Rudy’s devices (which started in earnest in September 2021). But we do know what kind of wild privilege claims Robert Costello was making for another of his clients, Steve Bannon, in discussions of how to respond to a subpoena from the January 6 between October 5 and 19, 2021. He provided those details (including two 302s from interviews at which FBI agents were present) in a bid to claim he — Costello — was unfairly targeted as part of DOJ’s investigation of Bannon’s contempt (see this post for details).

In Costello’s interviews, he was all over the map about whether Bannon could invoke Executive Privilege. He said that according to some OLC opinions, Bannon did not have to be a government employee to receive “protections” under EP, and that “TRUMP had the right to claim it for BANNON.” He said that 10 of the 17 items on the Jan 6 subpoena were covered by EP. He admitted EP did not cover a request for comms involving Scott Perry and “it would take a ‘creative argument’ to apply Executive Privilege to that particular item.” He admitted, too, that comms with the Proud Boys wouldn’t be covered by EP if such communications existed.  He said that EP claims should be worked out between Trump and the Committee. He said he had told Bannon that Bannon could not invoke EP because “that authority belongs to the President.”

Ultimately, though, Costello admitted that Trump’s attorney Justin Clark never reviewed anything Bannon might have claimed privilege over and refused several requests to contact the Committee himself about EP.

COSTELLO did not provide any documents to attorneys representing former President Trump for review to determine if Executive Privilege covered the documents. At the time, COSTELLO did not know what attorneys were representing others who had received Select Committee subpoenas.

COSTELLO asked CLARK to reach out to the Select Committee and to directly express to the Select Committee what COSTELLO and BANNON were confused about in regards to Executive Privilege. COSTELLO estimated he requested this of CLARK approximately two or three times; however, CLARK did not reach out to the Select Committee. COSTELLO did not have prior knowledge of the lawsuit of former President TRUMP.

CLARK would not identify for COSTELLO what would be covered under Executive Privilege and that CLARK left that determination up to those who had received the Select Committee subpoena. CLARK also refused to reach out to the Select Committee on behalf of COSTELLO or BANNON.

COSTELLO did not provide or offer any documents to attorneys representing former President TRUMP to review for Executive Privilege.

In a follow-up, Costello effectively admitted there was no concrete record that Trump had invoked EP.

Costello stated that Justin Clark (Clark) was trying to be intentionally vague; however, Costello was clear former President Donald Trump (President Trump) asserted executive privilege with regard to Bannon.

When DOJ asked Costello for a letter indicating that Clark had invoked EP for Bannon, he had nothing specific.

Then there was the matter of Bannon’s podcasts. Costello ceded they weren’t covered by privilege, but only because they were public (!!!!), and appears to have just assumed the Committee would go get them on their own.

With regards to responding to the Select Committee’s request for documents, COSTELLO planned to send a link to the website hosting all of BANNON’s publicly accessibly podcasts.

The podcasts requested could be obtained by the Select Committee off the internet, and since they were in the public domain, the podcasts also were not covered by Executive Privilege.

COSTELLO admitted he did not have a good answer as to why he didn’t disclose to the Select Committee that the podcasts were in the public domain and BANNON was not required to respond to that particular item. COSTELLO believed the particular requests regarding the podcasts was just a “bad request” by the Select Committee.

The most telling piece of advice given by the lawyer Bannon shares with Rudy — one that goes to the heart of what Costello might have done in discussions taking place at the same time about privilege with SDNY — was that Bannon, who is not a lawyer, could claim attorney-client privilege over items requested in item 17 of the subpoena, which asked for,

Any communications with Rudolph Giuliani, John Eastman, Michael Flynn, Jenna Ellis, or Sydney Powell about any of the foregoing topics.

Costello claimed these such communications, including those with Mike Flynn or Sidney Powell, would be covered by attorney-client or work product privilege.

COSTELLO believed that the request listed as number 17 involved information over which BANNON could assert attorney-client privilege given it included a request for communications between BANNON and RUDOLPH GIULIANI, JENNA ELLIS, and other attorneys who were working for former President Trump.

COSTELLO believed item 17 was covered by attorney-client privilege or by attorney work product protections. Even though MICHAEL FLYNN was not an attorney, he was present during attorney-client-protected discussions. Those particular attorneys represented former President TRUMP and CLARK informed COSTELLO not to respond to item 17.

There’s so much crazy-train about this last bit. After stating over and over that Clark refused to invoke EP, Costello then admitted that Clark wanted Bannon to withhold communications involving Rudy, Eastman, Powell, and Mike Flynn. Costello admitted Flynn (like Bannon) was not a lawyer, but was still prepared to claim attorney work product over comms with him anyway. But the thing I can’t get enough of is that Rudy’s lawyer Robert Costello was claiming that Sidney Powell — who, in a written statement issued on November 22, 2020, Trump’s lawyer Rudy Giuliani made very clear did not represent Donald Trump — represented Donald Trump.

Still, all this crazy train amounts to non-lawyer Bannon, advised by the lawyer he shares with Rudy, making the same claim that lawyer John Eastman had made regarding “war” planning leading up to January 6; that such documents were covered by work product privilege. That’s the same claim that Judge Carter just applied a crime-fraud exception for.

I’m guessing Costello attempted to make similar claims with Barbara Jones in SDNY and I’m guessing that Jones pointed out that Bannon and Flynn aren’t lawyers and Rudy was quite clear that Powell was not Trump’s lawyer. In other words, I think it likely that some of the claims Costello withdrew are similar to those that Eastman failed with. If that’s right, it increases the chance Document 4708 would be turned over to DOJ.

Sidney Powell

And then there’s the Kraken lady.

We don’t know the full scope of the grand jury investigation into Powell, aside from the fact that Molly Gaston, who is supervising the Bannon prosecution, is also involved in it (which means she’d have visibility on the overlap between the two, and would know that Trump’s lawyer tried to withhold comms involving Powell without invoking privilege). The subpoena requests, at least, cover the finances of her Defending the Republic “non-profit.”

The federal probe, which has not been previously reported, is examining the finances of Defending the Republic, an organization founded by Powell to fund her “Kraken” lawsuits to overturn the 2020 election, the sources said.According to two of the people familiar with the matter, a grand jury was empaneled, and subpoenas and documents requests have gone out to multiple individuals as recently as September.

The investigation, then, would cover activities that are tangential to the January 6 subpoenas to Bannon and Eastman.

But the fact that there’s a grand jury investigation into Powell makes it exceedingly likely DOJ got a warrant for her emails.

She has a valid privilege claim covering communications with Mike Flynn for some of this period. But thanks to Rudy’s public statement, she has no privilege covering her actions for Trump.

Chances are pretty good she received a copy of the memo for Rudy too (if the memo wasn’t written by someone with closer ties to Powell than Rudy).

I think it’s likely that DOJ has multiple copies of document 4708, probably via Rudy, Bannon, and Powell, if not Eastman himself (getting it from Chapman U would always have been easy to do with a gag, and would be still easier now).

What’s clear, though, is that the lawyer that Rudy and Bannon share is making privilege claims every bit as absurd as the ones Carter just rejected, and with Bannon, there’s no question about privilege claims.

Jeffrey Rosen Targeted Project Veritas’ Office Manager Long before Merrick Garland Targeted James O’Keefe

According to a recent NYT story, Project Veritas paid $50,000 to a former Mike Pence lawyer and House staffer, Mark Paoletta, to get members of Congress to push back against the criminal investigation into the rat-fucking organization.

After the criminal investigation into Project Veritas became public last fall, a prominent Republican lawyer who was lobbying on behalf of the organization and Mr. O’Keefe briefed a group of congressional Republicans on the case, to urge them to try to persuade the Justice Department to back off the investigation because the group did nothing wrong, according to a person briefed on the matter.

Lobbying filings show that Mr. Paoletta was paid $50,000 during the last two months of last year to inform members of Congress about the F.B.I. raid on Mr. O’Keefe.

That’s really telling. After Project Veritas won a fight to get a Special Master appointed to review records seized in a raid on James O’Keefe and others last year, they balked at DOJ’s effort to make them foot the entire bill, telling a tale about their gritty “upstart journalism.”

The government argues that an upstart journalism organization with a current annual budget that recently hovers around $22 million is better suited to fund Special Master proceedings than a goliath arm of the U.S. government featuring a long-standing bloated budget, currently at $31.1 billion.2 The government’s demand that a press entity bear considerable financial burdens to defend against the government’s unconstitutional attack on a free press is corrosive to the First Amendment. The exercise of First Amendment rights is a guaranteed right, not a luxury subject to taxation at the government’s whim. Imposing daunting costs during the pendency of an investigation meant to resolve important First Amendment questions inflicts its own kind of abridgement. When exorbitant costs may be levied against the media simply for acting in accord with settled First Amendment precedent, the process becomes the punishment.

For Project Veritas, an upstart journalism organization, each dollar spent on Special Master fees and expenses is a dollar not spent publishing news stories or investigating leads.

They won that fight and thus far, Special Master Barbara Jones has billed almost $40,000, which will be split 50-50.

It turns out, though, that PV’s claim that they would spend every cent saved on Special Master fees on what they euphemistically call “news stories,” was false. Instead, they were spending it to get Chuck Grassley (whose former top staffer Barbara Ledeen used to have close ties to PV), Jim Jordan, and other of the most corrupt Republicans to write letters to Merrick Garland complaining about “brazen and inconsistent standards” and “partisan or other improper motive.” (As we’ll see, it turns out they should have been complaining to Jeffrey Rosen.)

What’s interesting is those letters that Barbara Ledeen’s former boss and Jim Jordan and Ron Johnson signed all suggest they took their understanding of PV’s actions entirely from the public record. They cite news articles.

Congress was told that Don Jr was involved before the stupidest Republicans wrote to complain

Not so, as reported by the NYT. Paoletta apparently knew — and shared — details that had not yet been reported by the press. Paoletta knew of a September 6, 2020 fundraiser held by Elizabeth Fago and attended by Don Jr where Ashley Biden’s diary — allegedly stolen — was passed around.

In August, Ms. Harris reached out to Robert Kurlander, a friend who had been sentenced to 40 months in prison in the 1990s on a federal fraud charge and had expressed anti-Biden sentiments online, to say she had found the diary. The two believed they could sell it, allowing Ms. Harris to help pay for the lawyers representing her in the custody dispute.

New details from interviews and documents have further fleshed out what happened next. Mr. Kurlander contacted Elizabeth Fago, the Trump donor who would host the fund-raiser attended by Donald Trump Jr. When first told of the diary, Ms. Fago said she thought it would help Mr. Trump’s chances of winning the election, according to two people familiar with the matter.

Richard G. Lubin, a lawyer for Ms. Fago, declined to comment.

On Sept. 3, Ms. Fago’s daughter alerted Project Veritas about the diary through its tip line.

Three days later, Ms. Harris and Mr. Kurlander — with the diary in hand — attended the fund-raiser attended by Donald Trump Jr. at Ms. Fago’s house in Jupiter, Fla., to see whether the president’s re-election campaign might be interested in it. While there, Mr. Kurlander showed others the diary. It is unclear who saw it.

It appears that Paoletta had originally been told — and told members of Congress — that Don Jr advocated calling the FBI, only to follow up to express uncertainty about that point.

The lawyer, Mark Paoletta, said that upon learning about the diary at the fund-raiser, Donald Trump Jr. showed no interest in it and said that whoever was in possession of it should report it to the F.B.I. But shortly thereafter Mr. Paoletta, who had served as Vice President Mike Pence’s top lawyer in the White House, called back the congressional Republicans to say he was unsure whether the account about Donald Trump Jr.’s reaction was accurate.

We know from past history, Don Jr doesn’t call the FBI when offered dirt on an opponent. Instead, he says “If it’s what you say, I love it, especially closer to the election.”

Project Veritas was willing to pay $50,000 to tell members of Congress that this crime might impact powerful fundraisers (Fago was named on the PV warrants) and the former President’s son, but didn’t want to foot the full bill for a Special Master.

SDNY always gets emails before they do an overt search

The fact that PV told members of Congress that this involved the former President’s son explains why PV is so pissed upon discovering what has been obvious to me from the start: That before obtaining warrants to seize James O’Keefe’s phones, DOJ had first obtained emails that provided the evidence to get the warrants for his phones.

The Government disclosed many of its covert investigative steps in the ex parte context of the Affidavit, including each email search warrant it had obtained pursuant to the SCA in this investigation.

This is precisely what SDNY did with Michael Cohen and Rudy Giuliani, and it’s what Magistrate Judge Sarah Cave was talking about when she referred to the “considerable detail” in the affidavit.

Third, the Court has reviewed the Materials in camera and observes that they contain considerable detail about individuals who may have already provided information to the Government—voluntarily or involuntarily—such that unsealing of the Materials “could subject [them] to witness tampering, harassment, or retaliation.”

PV revealed that in a motion asking Judge Analisa Torres to claw back this information.

The government apparently disdains the free press, and candor to the Court and opposing counsel. In light of the government’s violations of Project Veritas’s First Amendment, journalistic, and attorney-client privileges, as well as the government’s attendant failure to disclose these matters before or during the litigation of our motion for appointment of a Special Master, Project Veritas requests that this Court, pursuant to its supervisory powers, inherent authority, and Fed. R. Crim. P. 41(g), enter an Order requiring the government to:

(1) immediately halt access, review, and investigative use of Project Veritas materials that the government obtained from Microsoft (cf. November 12, 2021 Order acknowledging pause in government extraction and review of James O’Keefe’s mobile devices);

(2) inform this Court and counsel whether the government used a filter team to conduct a review of the data it seized from Microsoft on the basis of both attorney-client and journalistic privileges;

(3) inform this Court and counsel of the identities of any prosecutors, agents, or other members of the investigative team who have reviewed any data seized from Microsoft, what data they reviewed, and when they reviewed it; and

(4) disclose to the Court and counsel the identity of any other third party to which the government issued demands for Project Veritas data under the Electronic Communications Privacy Act (“ECPA”) with or without a non-disclosure order.

This interim relief is necessary to avoid compounding the harm to Project Veritas caused by the government’s violations of law and principles of candor and to enable Project Veritas to seek appropriate further relief.

I’ve put the dates of these warrants below; those dates and targets totally undermine everything PV has been complaining about.

PV has been complaining about “journalists” when DOJ first found evidence of a crime from their office manager

That’s because the first person targeted at PV was their “human resources” manager; that may be a reference to Jennifer Kiyak, who is named in the warrant targeting O’Keefe but listed on Project Veritas Exposed as PV’s Office Manager.

An office manager would have been the one to arrange payment of $40,000, and by getting her emails and — given that the FBI first targeted her in a subscriber record, may have been traced backwards from contacts with Ms. Biden — DOJ probably obtained plenty of evidence that the “journalists” had done far more than journalism.

Moreover, the first warrant to get “journalists'” emails was obtained while Jeffrey Rosen was Acting Attorney General, and all but one of these warrants for email (the one against O’Keefe) were obtained before Merrick Garland was confirmed. All of these email warrants were obtained before Garland imposed his new media guidelines, guidelines that Billy Barr’s DOJ never adhered to.

In other words, PV has been complaining for months that Merrick Garland targeted “journalists” when in fact they should be complaining that Jeffrey Rosen targeted someone who would, in no way, under any administration, be covered by media guidelines.

DOJ tells PV to hold their complaints until they are indicted

DOJ’s response to PV’s wails (which I wrote up in more detail here) is genuinely hysterical. They say, over and over, that PV can wait until they’re indicted to challenge these warrants.

Movants can raise these issues if there is an indictment filed charging them in connection with the investigation,

The materials referenced by the Movants were obtained pursuant to duly authorized legal process that are not subject to challenge by the Movants in this pre-indictment stage.

Second, the Movants seek pre-indictment discovery regarding the process used to review the materials referenced by the Movants, the identities of those who participated in that process, and the identities of third parties on which other legal process may have been served in the course of the investigation.

To the extent the Movants may potentially be entitled at some point to the disclosures that they seek, any such entitlement would only be triggered, if at all, by the filing of an indictment charging them in connection with the investigation, and not before.2 In the event of a criminal proceeding, as Judge Oetken noted, they would have the opportunity to litigate any privilege or suppression issues, but they cannot do so during the pre-indictment phase of an ongoing grand jury investigation.

They acknowledge that PV would love to know who or what else has been investigated.

Of course, the Movants, like any subjects of a federal grand jury investigation, would like to know about every investigative step the Government is taking during the course of a criminal investigation, but that is not the law, for good reason.

No doubt so would Don Jr.

It also suggested there are other aspects of this investigation that DOJ is keeping secret.

The Government refrained from publicly disclosing details of the investigation, and continues to do so, for the same reasons that this Court denied production to the Movants of the affidavit (the “Affidavit”) submitted in support of the issuance of the search warrant dated November 5, 2021 that is the focus of this Part I matter and that Judge Cave ruled should remain sealed: to protect the ongoing grand jury investigation.

Keep in mind, there are necessarily other warrants out there that list other crimes, such as ones involving Harris and Kurlander that would name theft itself. In fact, the first order targeting PV mentions 18 USC 873 — blackmail.

Which means we can’t rule out that the nomination of Fago to the National Cancer Advisory Board a month after the election might be under investigation too.

Paul Manafort Prevented from Flying to Dubai

As Knewz first reported and AP has now matched, Paul Manafort was pulled from a flight to Dubai on Sunday because his passport was revoked.

Former Trump adviser Paul Manafort was removed from a plane at Miami International Airport before it took off for Dubai because he carried a revoked passport, officials said Wednesday.

Miami-Dade Police Detective Alvaro Zabaleta confirmed that Manafort was removed from the Emirates Airline flight without incident Sunday night but directed further questions to U.S. Border and Customs Protection. That agency did not immediately respond to an email Wednesday seeking comment.

A lawyer who has represented Manafort did not immediately return a call and email seeking comment Wednesday.

As a reminder, Manafort’s pardon did not include his actions in an August 2, 2016 meeting with alleged Russian spy Konstanin Kilimnik, at which he seemingly traded his strategy to win the election for $19 million in financial benefit and a commitment to help carve up Ukraine.

Nor was Manafort pardoned for his efforts, which continued at least until he was arrested, to help Kilimnik carve up Ukraine to Russia’s liking.

Nor was Manafort pardoned for his role in all the influence-peddling that Rudy Giuliani was involved with in Ukraine through 2020.

This was three days ago. The fact that Sean Hannity has not been wailing about the poor treatment of Manafort since suggests either that there’s not a good way to spin it, or that Manafort has some reason to want to keep this quiet.

Update: NBC’s Tom Winter says that, contrary to other reports, he was simply not permitted to board and that he can apply for a new passport. It’s not clear why he speaks of a “new investigation.”

Imagine if DOJ Used the Hunter Biden Inquiry to Get Testimony against Rudy Giuliani…

I’m going to return to my argument that The Laptop is functionally equivalent to the Steele dossier. But until I do, I want to return to the parallels between the Ukrainian influence peddling investigation of Hunter Biden and that of Rudy Giuliani.

First, take a look at this passage from the Ken Vogel-bylined NYT story that inflated new life in The Laptop story.

People familiar with the investigation said prosecutors had examined emails between Mr. Biden, Mr. Archer and others about Burisma and other foreign business activity. Those emails were obtained by The New York Times from a cache of files that appears to have come from a laptop abandoned by Mr. Biden in a Delaware repair shop. The email and others in the cache were authenticated by people familiar with them and with the investigation.

Elsewhere, the NYT story reports that the investigation into Hunter Biden turned to his influence peddling in 2018, well before the laptops in question were purportedly dropped off at a blind computer repairman’s shop.

The investigation, which began as a tax inquiry under the Obama administration, widened in 2018 to include possible criminal violations of tax laws, as well as foreign lobbying and money laundering rules, according to the people familiar with the inquiry.

The contents on The Laptop were iCloud content, which the FBI could have and would have preferred to obtain with a warrant. We know the emails in question weren’t deleted by all parties because sources for stories describe still having them.

In other words, it’s unlikely that The Laptop played a critical role in the FBI investigation into the President’s son, because the FBI had other, better ways to obtain the same content and because the FBI had already turned to these matters well before the laptop got shared with the FBI on December 9, 2019.

So let’s go back to the way that Vogel-bylined NYT article reflated The Laptop story. The passage I quoted says three things:

  1. Prosecutors have looked at emails in question.
  2. NYT had obtained emails from what it credulously calls The Laptop.
  3. The “Laptop” emails were authenticated by “people familiar with them and with the investigation.”

The source for the first claim is likely someone who was a witness in the DE investigation (and we know that witnesses who have offered up their testimony have been part of the recent Murdoch-driven campaign to reflate it). The second claim is simply NYT’s ham-handed effort to make it clear the emails they received were part of the same campaign as the original NY Post story.

The third claim, however, is interesting. Written as it is, it suggests there are people who are familiar with both the investigation and the email cache. That would seem to suggest that some of the very limited universe of people involved with The Laptop — Rudy Giuliani, Steve Bannon, Robert Costello, and Mac Isaac — believe they know something about the Hunter Biden investigation.

Let’s focus on Robert Costello for the moment: He loves to be a cut-out. And when Billy Barr set up a special back channel to ingest Ukrainian-provided Russian dirt on Hunter Biden, Costello was that back channel. In other words, the lawyer that Rudy and Steve Bannon share is one possible source for that third claim, but if he were, it would suggest investigators in Delaware had spoken with him as a witness because he knew of the process by which he came to be in possession of a sketchy laptop.

Whatever testimony the source of that third claim offered could be shared with SDNY, which is investigating Rudy’s own influence-peddling scandal with Ukraine.

With all that mind, take a look at this passage of Philip Bump’s excellent summary of all the ways that laptop story is sketchy.

Giuliani was central to that effort. In late 2018, he began exploring the idea that Biden, as vice president several years before, had improperly tried to influence Ukraine to block an investigation of Burisma, a company for which Hunter Biden served as a board member. This story, promoted by an investigator targeted for termination by the U.S. government, was later debunked, but it seemed a promising line of attack. On April 1, 2019, a writer linked to Giuliani named John Solomon wrote the first of several stories about the allegations.

On April 12, the laptops were dropped off at Mac Isaac’s repair shop. Mac Isaac is legally blind and was not able to identify Hunter Biden by sight. One of the laptops, though, bore a sticker for the Beau Biden Foundation, an organization dedicated to Hunter’s late brother.

At some point in the middle of this month, Hunter Biden left Burisma’s board. Presumably he was by that point aware that questions were being asked about his role. If not, it became very clear on May 1, when the Times elevated the Burisma question in its coverage.

In the meantime, Volodymyr Zelensky had been elected president of Ukraine, and efforts to pressure him to announce an investigation into Biden began. In early May 2019, Giuliani planned a trip to Ukraine to dig up information that might damage Biden — a plan that was covered in the press. After broad outcry, he scrapped the trip. But the signal was sent: Giuliani was seeking information deleterious to Biden.

Later that month, someone in Kyiv was approached about buying Hunter Biden’s emails. This was not reported until Oct. 21, 2020, a week after the Post’s story about the laptop.

This time period — December 2018 until May 2019 — is precisely the time period that prosecutors asked Special Master Barbara Jones to prioritize for her privilege review of the last set of Rudy’s phones (as well as the one phone from Victoria Toensing).

In the initial incarnation of this investigation — the one charged in 2019, before Lev Parnas started running his mouth — the focus of this investigation was exclusively on how Rudy got Marie Yovanovitch fired.  But in September 2020, that part of the investigation was put on hold to await Rudy.

Yovanovitch’s name doesn’t appear in Bump’s summary at all. Yet it happened in the same month — May 2019, the culmination of this effort — when Rudy was going to go to Kyiv to dig up dirt on Hunter Biden, and when someone was wandering around Kyiv offering to sell what looks like what ended up packaged as The Laptop.

Whether or not Rudy’s effort to solicit what ended up being dirt that looked just like The Laptop was originally the focus of the investigation, DOJ has now obtained a privilege review of Rudy’s comms from that time period when he was soliciting it.

“The Laptop” Is the Functional Equivalent of The Steele Dossier, 1: Rudy Is the Real Scandal

I’m going to explain how The Laptop that Rudy Giuliani floated just before the election is the functional equivalent of the Steele dossier.

Before I do, let me make a fairly obvious (if counterintuitive) point: Of the three people that powerful Ukrainians attempted to cultivate for their ties to the Vice President or President — Paul Manafort, Hunter Biden, and Rudy Giuliani — just one provably affected US policy through the Vice President or President: Rudy.

Contrary to what you may have read, for example, Manafort actually wasn’t the one who prevented the GOP platform from being strengthened to support Ukraine, JD Gordon was (though Trump’s do-not-recall answer about his own involvement can’t rule that out). Mueller’s decision not to prosecute Gordon as an agent of Russia was only recently made public (thanks to the relentless work of Jason Leopold and his lawyer).

And while there’s a lot of circumstantial evidence that Manafort entered into a quid pro quo on August 2, 2016, trading campaign strategy for a commitment to help carve up Ukraine to Russia’s liking along with $19 million a financial benefit for Manafort personally, because the investigation into Manafort became public in 2016, his ongoing efforts to push that Russian plan to dismember Ukraine never (as far as has been made public) had the involvement of Trump. It’s possible Trump was involved or Manafort got certain commitments in 2016, but Manafort’s own cover-up prevented DOJ from determining whether or not that was true.

According to the NYT story that has renewed the frenzy around the laptop Rudy Giuliani released just before the election, Federal prosecutors still haven’t determined whether Hunter Biden’s treatment of Chinese, Kazakh, and Ukrainian influence efforts amounted to a crime. But they do have evidence that Hunter Biden tried to be explicit that he could not influence his father to help Burisma.

In one email to Mr. Archer in April 2014, Mr. Biden outlined his vision for working with Burisma. In the email, Hunter Biden indicated that the forthcoming announcement of a trip to Ukraine by Vice President Biden — who is referred to in the email as “my guy,” but not by name — should “be characterized as part of our advice and thinking — but what he will say and do is out of our hands.”

The announcement “could be a really good thing or it could end up creating too great an expectation. We need to temper expectations regarding that visit,” Hunter Biden wrote.

Vice President Biden traveled to Kyiv, the Ukrainian capital, about a week after the email.

In the same April 2014 email, Hunter Biden indicated that Burisma’s officials “need to know in no uncertain terms that we will not and cannot intervene directly with domestic policymakers, and that we need to abide by FARA and any other U.S. laws in the strictest sense across the board.”

He suggested enlisting the law firm where he worked at the time, Boies Schiller Flexner, to help Burisma through “direct discussions at state, energy and NSC,” referring to two cabinet departments and the National Security Council at the White House.

The firm “can devise a media plan and arrange for legal protections and mitigate U.S. domestic negative press regarding the current leadership if need be,” Mr. Biden wrote in the email.

And sworn testimony from experts in both parties say Hunter did not dissuade his father from taking steps to crack down on corruption.

Of these three well-connected Americans being cultivated by powerful and corrupt Ukrainians — some but not all of them known Russian agents — only Rudy Giuliani is known to have had a direct effect on policy. Among other things, Rudy got Marie Yovanovitch fired. In only Rudy’s case, then, do we have clearcut proof that a Ukrainian influence operation had the desired effect of  changing American policy. Though even there, it’s not yet clear whether Rudy’s unregistered influence peddling was criminal.

(Obviously, Manafort pled guilty to being an unregistered Ukrainian agent during the earlier period, and he got paid orders of magnitude more than Hunter Biden did, too.)

So as we fight about The Laptop again, based on a reference to verified emails in a NYT article bylined by serial Rudy mouthpiece Ken Vogel, the first thing we should keep in mind is that there’s far more evidence that Rudy Giuliani successfully influenced the President or Vice President as a secret agent of Ukraine than Hunter Biden.

DOJ Unseals 18-Month Old Indictment against Lev Parnas’ Financial Backer

Yesterday, SDNY unsealed an indictment against Andrey Muraviev, the Russian national who gave Lev Parnas and Igor Fruman $1 million to spend on pro-cannabis Republican politicians.

SDNY presented the indictment as part of an effort to protect US politics, and it was.

Damian Williams, the United States Attorney for the Southern District of New York, and Michael J. Driscoll, the Assistant Director-in-Charge of the New York Field Office of the Federal Bureau of Investigation (“FBI”), announced the unsealing of an indictment against ANDREY MURAVIEV, a/k/a “Andrey Muravyov,” a Russian citizen, charging him with making illegal political contributions as a foreign national, and conspiring to make illegal political contributions as a foreign national in the names of straw donors. Muraviev is charged with conspiring with Lev Parnas, Andrey Kukushkin, and Igor Fruman, and others, who were convicted at trial or have pleaded guilty to these crimes.

U.S. Attorney Damian Williams said: “As alleged, Andrey Muraviev, a Russian national, attempted to influence the 2018 elections by conspiring to push a million dollars of his foreign funds to candidates and campaigns. He attempted to corrupt our political system to advance his business interests. The Southern District of New York is committed to rooting out efforts by foreigners to interfere with our elections.”

FBI Assistant Director-in-Charge Michael J. Driscoll said: “As alleged, Muraviev, a Russian foreign national, made illegal political contributions and conspired with Parnas, Kukushkin and Fruman to obscure their true source. The money Muraviev injected into our political system, as alleged, was directed to politicians with views favorable to his business interests and those of his co-conspirators. As today’s action demonstrates, we will continue to aggressively pursue all those who seek to illegally effect [sic] our nation’s elections.”

But I’m still not sure what explains the unsealing of the indictment yesterday. It’s actually exactly the same as S1 — obtained the same day on September 17, 2020 — only with Muraviev charged rather than described as Foreign National-1.

It may be just part of the effort to roll out charges against as many people — along with Jack Hanick and Elena Branson — for Russian influence peddling as possible right now. It may relate to Lev Parnas’ plans to plead guilty to the remaining charged charge against him (the Marie Yovanovitch related charge from the original indictment was removed in S1 to await Rudy’s inclusion).

Or perhaps DOJ unsealed it to make it easier to share with some other entity, such as Federal prosecutors in Florida who are investigating some of the pro-cannabis politicians who received Muraviev’s laundered campaign money.

Now that DOJ Has Rudy Giuliani’s Phone Contents, Lev Parnas Prepares to Plead

Back on January 21, Special Master Barbara Jones reported on the status of her privilege review of Rudy Giuliani’s devices. For eight of Rudy’s devices, she had turned over over 27,000 items that post-dated January 1, 2018. For eight others, she had turned over the 3,000 items dated between December 1, 2018 and May 31, 2019.

While she had started to turn over materials as early as November, Jones turned over the balance on January 19. From there, a filter team at the FBI would have to scope the contents to make sure the investigative team only got items covered by whatever warrants the government has gotten.

The one known warrant that SDNY has covers Rudy’s efforts — assisted by Lev Parnas — to get Maria Yovanovitch fired in 2019. Those charges were included on the original October 2019 indictment against Parnas, but removed when the charges against him were superseded in September 2020.

If DOJ is going to charge Rudy for ousting Yovanovitch at the behest of Yuri Lutsenko and others, they are probably preparing to do so now.

Which makes it interesting that yesterday, Parnas asked for a change of plea hearing on the remaining already-charged count for which he still has to stand trial.

Remember: Back in March 2020, Parnas tried, unsuccessfully, to flip.

Lev Parnas spent much of January 2020 claiming to want to cooperate with the impeachment inquiry — though those claims were often suspect. At the same time, SDNY seemed to want to stall those efforts. The Senate acquitted Trump in February.

Only after that, on March 5, 2020 (and apparently just March 5), did Parnas proffer testimony in what he had been publicly claiming for some time was an interest in cooperating. But apparently after making statements that support the government case against him at trial next month, nothing came of the proffer.

On March 5, 2020, Parnas and his counsel met with members of this Office and the FBI, to proffer Parnas’s potential testimony about the charges at issue here and other matters. In advance of the proffer, the Government provided a written proffer agreement to Parnas’s counsel, setting forth the terms under which statements Parnas made during the proffer could and could not be used against him.

During a lengthy proffer, Parnas made several statements that tend to prove the charges at issue here, or facts underlying those charges. An FBI agent took detailed notes of the proffer, and later produced a formal report memorializing it (the “302”). Those notes, and the 302, have been provided to Kukushkin and Parnas.

In a pretrial hearing last October, Parnas’ lawyer Joseph Bondy revealed that at that early point, SDNY had insisted Parnas plead to all the charges against him (which at that point still included the Yovanovitch charge).

But now that DOJ has — after 30 months of work — obtained all Rudy’s communications about the Yovanovitch plot (and already facing prison based off his October 2021 guilty verdict), Parnas appears to have a deal that’s worth pleading guilty to.

Remember: When Parnas was previously trying to flip, it wasn’t just the Yovanovitch plot he wanted to cooperate on. He also wanted to help SDNY prosecute obstruction of the investigation into that effort, including efforts to delete iCloud content as impeachment started. Parnas has receipts — not just against Rudy (and Mike Pompeo), but also videos implicating Trump.

Meanwhile, as Parnas prepares to plead guilty, Yovaovitch is using her book tour to highlight the damage done by autocrats like Putin and Trump.

Steve Bannon’s Phantom Executive Privilege

In a reply motion demanding to know why DOJ subpoenaed the toll records for him, the lawyer Steve Bannon shares with Rudy Giuliani, Robert Costello, claims DOJ obtained the email information, including hundreds of pages from Google, for different Robert Costellos, not him.

The hundreds of pages of email information they obtained from Google, including email addresses (and IP addresses) of the sender and recipient, date and time of the emails, metadata, social media and meeting (Google Hangouts) data, information as to whether each email was read, remained unread, was deleted, or what filing box the recipient put it in, and more [See e.g., 0011510001249; 001339-1732] were all for another completely uninvolved citizen apparently named Robert Costello or Robert M. Costello. In fact, not one of the email accounts the Government sought access to in this case, intending to get defense counsel’s emails, actually was defense counsel’s email account.

He even issued a declaration stating, among other things, that,

I have no association whatsoever with email accounts with the addresses “[email protected],” or “[email protected],” or “[email protected],” or “[email protected].”

We shall see how the government explains this claimed mix-up, assuming Judge Carl Nichols permits them to file a surreply (Costello claims he only just discovered these weren’t his emails after reviewing them for months).

That said, Costello did not deny association with email accounts with the addresses of, [email protected], [email protected], or [email protected], which appear to be included in the friends and family accounts of the main Gmail account in question. And though Costello claims to provide the exhibits to back his claims, he doesn’t provide the Comcast return and doesn’t provide back-up for the bulk of the returns he is complaining about (US 001339-001732 below).

What Costello has also shown is that, in a memo to DOJ, he claimed to quote from a letter from Justin Clark, who would have been acting as Trump’s lawyer, invoking privilege on Trump’s behalf.

“President Trump vigorously objects to the overbreadth and scope of these requests and believes they are a threat to the institution of the Presidency and the independence of the Executive Branch.” Mr. Clark added that:

“Through the Subpoenas, the Select Committee seeks records and testimony purportedly related to the events of January 6th, 2021, including but not limited to information which is potentially protected from disclosure by the executive and other privileges, including among others, the presidential communications, deliberative process, and attorney-client privileges. President Trump is prepared to defend these fundamental privileges in court.

As I’ve previously noted, at a meeting on November 3 at which Costello was supposed to be presenting that memo, Costello alternately claimed:

  • He had had no communications with Trump lawyers prior to October 18
  • Clark refused to reach out to the January 6 Committee on behalf of Costello or Bannon
  • Costello could not recall who brought up Executive Privilege first, him or Clark
  • Costello did not ask Clark to attend the hearing because he wouldn’t contact the committee on his behalf (even though his later complaint was that the Committee refused to have a Trump lawyer present)

In that November 3 meeting, Costello said he’d provide all the backup to support his claims.

But when JP Cooney asked for all the documents Costello claimed to be relying on in the memo and an interview with DOJ and the FBI on November 3, 2021, Costello said, “as soon as I locate the letter I received from Justin Clark, acting as counsel for President Trump, I will forward that under separate cover.” Cooney responded, making sure, “please review and let us know if this constitutes your entire production.”

There’s no evidence in this filing that Costello ever provided it.

Which may be why, in a follow-up interview on November 8 — after searching and (at least as this record shows) not finding any letter from Clark — Costello told DOJ:

There are additional discrepancies disclosed by the materials Costello has included.

In his declaration, Costello (who, remember, was investigated as part of the Mueller investigation for helping to dangle pardons) complained that this meeting to stave off an indictment didn’t work like all the previous times he had had such meetings.

[I]t is clear to me that the representatives of the United States Attorney’s Office for the District of Columbia never had any intention of engaging in a lawyer like discussion of the legal merits of a prosecution of Mr. Bannon for criminal contempt of Congress. This position was and is shocking to me because of the many prior instances when this same Office declined to prosecute others, including sitting United States Attorney Generals based upon a referral from Congress.

There’s more: For example, Costello misrepresents when he joined Bannon’s defense team for this.

But the key detail is that Costello claimed to have a letter from Trump invoking Executive Privilege. And when DC USAO asked to see it, Costello changed his story.

Update, April 19: I’ve updated the timeline below with two documents DOJ submitted on April 15. They raise further inconsistencies in Costello’s statements to the FBI and DOJ in his interviews.
