Amash-Conyers Fails 205-217

In one of the closest votes in a long time for civil liberties, the Amash-Conyers amendment just failed, but only barely, by a vote of 205-217.

The debate was lively, with Mike Rogers, Michele Bachmann, and Iraq verteran Tom Cotton spoke against the amendment; Amash closely managed time to include a broad mix of Democrats and Republicans.

The only nasty point of the debate came when Mike Rogers (R-MI) suggested Justin Amash (R-MI) was leading this charge for Facebook likes.

In These Times We Can’t Blindly Trust Government to Respect Freedom of Association

One of my friends, who works in a strategic role at American Federation of Teachers, is Iranian-American. I asked him a few weeks ago whom he called in Iran; if I remember correctly (I’ve been asking a lot of Iranian-Americans whom they call in Iran) he said it was mostly his grandmother, who’s not a member of the Republican Guard or even close. Still, according to the statement that Dianne Feinstein had confirmed by NSA Director Keith Alexander, calls “related to Iran” are fair game for queries of the dragnet database of all Americans’ phone metadata.

Chances are slim that my friend’s calls to his grandmother are among the 300 identifiers the NSA queried last year, unless (as is possible) they monitored all calls to Iran. But nothing in the program seems to prohibit it, particularly given the government’s absurdly broad definitions of “related to” for issues of surveillance and its bizarre adoption of a terrorist program to surveil another nation-state. And if someone chose to query on my friend’s calls to his grandmother, using the two-degrees-of-separation query they have used in the past would give the government — not always the best friend of teachers unions — a pretty interesting picture of whom the AFT was partnering with and what it had planned.

In other words, nothing in the law or the known minimization rules of the Business Records provision would seem to protect some of the AFT’s organizational secrets just because they happen to employ someone whose grandmother is in Iran. That’s not the only obvious way labor discussions might come under scrutiny; Colombian human rights organizers with tangential ties to FARC is just one other one.

When I read labor organizer Louis Nayman’s “defense of PRISM,” it became clear he’s not aware of many details of the programs he defended. Just as an example, Nayman misstated this claim:

According to NSA officials, the surveillance in question has prevented at least 50 planned terror attacks against Americans, including bombings of the New York City subway system and the New York Stock Exchange. While such assertions from government officials are difficult to verify independently, the lack of attacks during the long stretch between 9/11 and the Boston Marathon bombings speaks for itself.

Keith Alexander didn’t say NSA’s use of Section 702 and Section 215 have thwarted 50 planned attacks against Americans; those 50 were in the US and overseas. He said only around 10 of those plots were in the United States. That works out to be less than 20% of the attacks thwarted in the US just between January 2009 and October 2012 (though these programs have existed for a much longer period of time, so the percentage must be even lower). And there are problems with three of the four cases publicly claimed by the government — from false positives and more important tips in the Najibullah Zazi case, missing details of the belated arrest of David Headley, to bogus claims that Khalid Ouazzan ever planned to attack NYSE. The sole story that has stood up to scrutiny is some guys who tried to send less than $10,000 to al-Shabaab.

While that doesn’t mean the NSA surveillance programs played no role, it does mean that the government’s assertions of efficacy (at least as it pertains to terrorism) have proven to be overblown.

Yet from that, Nayman concludes these programs have “been effective in keeping us safe” (given Nayman’s conflation of US and overseas, I wonder how families of the 166 Indians Headley had a hand in killing feel about that) and defends giving the government legal access (whether they’ve used it or not) to — among other things — metadata identifying the strategic partners of labor unions with little question.

And details about the success of the program are not the only statements made by top National Security officials that have proven inaccurate or overblown. That’s why Nayman would be far better off relying on Mark Udall and Ron Wyden as sources for whether or not the government can read US person emails without probable cause than misstating what HBO Director David Simon has said (Simon said that entirely domestic communications require probable cause, which is generally but not always true). And not just because the Senators are actually read into these programs. After the Senators noted that Keith Alexander had “portray[ed] protections for Americans’ privacy as being significantly stronger than they actually are” — specifically as it relates to what the government can do with US person communications collected “incidentally” to a target — Alexander withdrew his claims.

Nayman says, “As people who believe in government, we cannot simply assume that officials are abusing their lawfully granted responsibility and authority to defend our people from violence and harm.” I would respond that neither should we simply assume they’re not abusing their authority, particularly given evidence those officials have repeatedly misled us in the past.

Nayman then admits, “We should do all we can to assure proper oversight any time a surveillance program of any size and scope is launched.” But a big part of the problem with these programs is that the government has either not implemented or refused such oversight. Putin’s Congressional Puppets

I have to give this to Michele Bachmann. Unlike most of the members of Congress she traveled to Russia with last week, she has not (at least not apparently) been suckered by Vladimir Putin to play his patsy.

Jim already described Dana Rohrabacher’s posturing with Steven Seagal while he attempted to replay his glory days palling around with the mujahadeen. Subsequent to that, Rohrabacher defended Putin’s abuse of power in fighting his former soulmates.

“If you are in the middle of an insurrection with Chechnya, and hundreds of people are being killed and there are terrorist actions taking place and kids are being blown up in schools, yeah, guess what, there are people who overstep the bounds of legality,” he said.

While the rule of law is important, Rohrabacher added, “We shouldn’t be describing people who are under this type of threat, we shouldn’t be describing them as if they are Adolf Hitler or they’re back to the old Communism days.”

Meanwhile, both Rohrabacher and Steve King bravely defended Putin’s prosecution of Pussy Riot.

“It’s hard to find sympathy for people who would do that to people’s faith,” King said.

But I’m most amused by the script William Keating (who represents parts of Boston and its southwest suburbs) is speaking from, parroting FSB’s assurances that the Marathon attack could have been prevented if only FBI had been more responsive to the tip they had provided the FBI and CIA.

Keating said the letter contained a lot of details about Tamerlan Tsarnaev, including his birthday, telephone number, cellphone number, where he lived in Cambridge and information about his wife and child. He said it also referenced the possibility that Tsarnaev might be considering changing names.
The Russians also had information about his mother, including her Skype address, Keating said.
Keating told the AP that the Russians believed Tsarnaev wanted to go to Palestine and engage in terrorist activities, but was unable to master the language.
‘‘That was the level of detail they were providing in this letter,’’ Keating said.
Keating said the intelligence officials believed that if Russia and the U.S. had worked together more closely, the bombings might have been averted. He said a top Russian counterintelligence official told the delegation that ‘‘had we had the same level of communication as we do now, the Boston bombing may never have happened.’’

Note Keating doesn’t make clear whether the details from the texts on Palestine were included in what the Russians sent us (the Russians translated the letter for the CODEL), or whether they only now shared it with the CODEL.

Steven Seagal Helps Rohrabacher in Failed Quest to Visit “Chechnyans”

Proving once again that he has the reasoning skills of a termite-infested and rotting fence post, Dana Rohrabacher had the bright idea that he and fellow geniuses Michele Bachmann and Steve King should go to Russia to get to the bottom of why Russian and US intelligence agencies did not jointly predict and prevent the Boston Marathon bombing. From the announcement of the trip on Rohrabacher’s website (oh, wait, it looks like Rohrabacher just crossposted the ABC News story transcribed from what Rohrabacher’s office fed them):

A delegation of American lawmakers will travel to Russia next week in part to investigate last month’s Boston Marathon bombings, ABC News has learned.

The group, led by Rep. Dana Rohrabacher, R-Calif., wants to find out why a 2011 Russian request that the United States investigate Tamerlan Tsarnaev, one of the suspected Boston bombers, did not raise more red flags.

The Russians  offered a vague warning that Tsarnaev planned to link up with extremist groups abroad, but an FBI investigation yielded no evidence to support those claims at the time. The lawmakers also want to know why  subsequent U.S. requests for additional information about Tsarnaev went unanswered by the Russians.

“If there was a distrust, or lack of cooperation because of that distrust, between the Russian intelligence and the FBI, then that needs to be fixed and we will be talking about that,”  Rohrabacher, the chairman of the House Committee on Foreign Affairs’ Subcommittee on Europe, Eurasia and Emerging Threats, told ABC News by telephone.

“Our goal is to use Boston as an example, if indeed there was something more, that should’ve been done that wasn’t because of a bad attitude,” Rohrabacher added.

Remarkably, the ABC News transcription goes on to cite Rohrabacher wanting to overcome any “lingering mistrust between the former Cold War rivals”. And yet, neither ABC News nor Rohrabacher seem to give any thought to the fact that back in the heady days when the US was backing Osama bin Laden and other mujahideen fighters against the Soviets in Afghanistan, Rohrabacher himself decided to play dress-up, grab a gun and go to Afghanistan to join the fun in hunting Russkies. Oh well, forgive and forget, I guess.

Unlike when he tried to visit Afghanistan and was denied entry because of his rabble-rousing past and continued meddling, Rohrabacher was allowed entry to Russia. Rohrabacher’s goal wasn’t only to talk to Russians, however. Since the Boston bombers were ethnic Chechens, it appears that the great Congressman decided he had to visit himself some “Chechnyans”. That’s right, in a reprise of Rohrabacher’s infamous Congressional hearing on Balochistan where he mangled the pronunciation of the region, Rohrabacher now has shown his cultural sensitivity once again by mangling another name: Read more

Obama’s Re-Election Campaign: Destroying the Country to Save It

Much of the discussion about this Jeff Zeleny piece has focused on Obama’s apparent consideration of cutting regulations that “affect the economy.”

The president intends to offer at least some progressive proposals to help regain a fighting posture that he has not had since the health care debate, but a provision is also being discussed to place a new moratorium on some regulations that affect the economy, excluding health care and financial rules. The proposals are likely to infuriate an already unhappy Democratic base. [my emphasis]

Greg Sargent suggests we ought to wait to see precisely what Obama means by this; I agree, not because I have any faith in Obama, but because the syntax of this line is so strange. Does Zeleny mean “moratorium on new regulations”? A “moratorium–does that mean temporary or permanent–on existing regulations”? Who is doing the discussing here, Mr. Passive Voice Journalist?

In short, I think Zeleny has failed his job as stenographer.

Which is why I’m even more intrigued by this passage.

The Republican candidates, collectively and in distinctive ways, continue to cast him as the foil against whom they ran so successfully in 2010: a big-government liberal who has expanded regulations, created uncertainty for business and failed to revive the economy, with millions more Americans out of work than when he took office. They portray him as an unsteady leader who is unequipped to turn around a country in economic crisis. [my emphasis]

Again, the meaning here is unclear: Who is the “they” here? Does Zeleny mean to invoke the themes all Republicans used to run against Obama in 2010? Or just the ones running for President. I’m not sure Ron Paul “ran against” Obama in 2010, though Michele Bachmann and Rick Perry did. Both complained about health insurance reform, but largely in terms of “freedom” and (particularly in the case of Perry the separatist, state’s rights), not regulations. Perry complained about emissions restrictions, which is certainly a regulation, but Obama’s already caved on that front.

Both Bachmann and Perry got caught hypocritically replying on government pork while attacking Obama’s stimulus bill, and it’s fair to say that Perry used stimulus funds to balance TX’s budget, and given the number of government jobs TX has relied on, it’s therefore safe to say Obama’s stimulus created jobs Perry is taking credit for.

And both Bachmann and Perry called Obama a socialist.

But the theme ignores one of the big things Republicans, as a whole, ran against Obama on in 2010: “cutting Medicare” (in the health insurance reform).

Which makes me wonder whether this interpretation of the 2010 election is Zeleny’s … or the Obama team’s?

It seems a critical issue because some seems to have simplified the reasons for the Democrats’ shellacking in 2010, particularly given that voters still largely blamed Bush for the economy in 2010 (though they’re doing so less now).

In any case, if Obama thinks he can embrace policies that will stop two fools who called a President who has coddled banksters “a socialist” from repeating that claim–if Obama believes that spoiling our air and water will make Bachmann and Perry be nice to him–it’s simply not going to work.

But I do worry that’s what he has in store.
