NSA Spying: The Oversight of the Passive Voice

In a white paper claiming “the American people deserve to know what we are doing to protect both” privacy and liberty, and security, the government (Ellen Nakashima, at least, doesn’t specify which agency generated this) also includes this assertion:

The [dragnet metadata] program is subject to strict controls and oversight: the metadata is segregated and queries against the metadata are documented and audited.

The detail is one that NSA Director Keith Alexander had already claimed in his testimony before the Senate Appropriations Committee last week. He claimed,

Every time we query that database, it’s auditible by the committees, by DOJ, by the court, by the Administration.

In a telling comment to the press the other day, though, Dianne Feinstein, whose staffers on the Intelligence Committee would be the ones auditing the queries, said this:

Asked to confirm that intelligence officials do not need a court order for the query of the number itself, Feinstein said, “that’s my understanding.”

I found it really strange that a person who should be solidly in the thick of the audits Alexander was boasting about didn’t even seem sure about how someone accessed the database.

But then, Alexander said they were “auditable,” not that they were audited by all these people.

One of just a few explanations about oversight in a document trying to prove the government protects our privacy and liberty might be more persuasive if they weren’t presented in the passive voice. It doesn’t sound like DiFi knows Congress could audit the document; I wonder if the FISA Court, which Alexander claims also can audit the data, knows it can (I’d also like to see someone audit the claim it is segregated; is it ever copied?).

The white paper’s statements about the 702/PRISM program are equally unsatisfying.

Congress requires the Government to develop and obtain judicial approval for “minimization” procedures to ensure appropriate protection of any information about U.S. persons that may be incidentally acquired. The Government did that, and its procedures were approved by the Foreign Intelligence Surveillance Court.

As I’ve noted repeatedly, the FISC doesn’t get to review compliance with these procedures, only the adequacy of them if applied as promised. And since this white paper makes no claims that the government can’t access this US person data — which, after all, includes content and metadata — it suggests the most sensitive collection for Americans has only internal (DOJ and ODNI review) safeguards for Americans’ Internet communications.

Effectively, in addition to providing further evidence for Mark Udall’s assertions that the government could accomplish what it says it is doing via other, far less sensitive means, this document only serves to show how inadequate the oversight of these programs is.

Human Rights Groups to Obama: Don’t Let John Brennan Cover Up the Torture He Condoned

Eight human rights organizations just sent a letter to President Obama urging him to appoint a high level White House official to coordinate the Senate Intelligence Committee torture report out of the White House. Like the letter Mark Udall already sent, this one implies releasing the report is crucial to delivering on Obama’s 2009 promise to end torture.

As one of your very first acts as President, you signed an Executive Order that closed the CIA’s “black sites” and restricted the agency to the techniques in the Army Field Manual.

We believe the public release of the Senate Select Committee on Intelligence study is critical to upholding your 2009 Executive Order. Safeguarding your Executive Order from being overturned by a future administration or Congress will help ensure that the United States does not return to policies of torture and cruelty again.

But here’s the key paragraph.

Most importantly, your administration has a responsibility to ensure that the Executive Branch response to the study is not driven by individuals who might be implicated in the CIA’s use of torture. While it is appropriate for individuals who have direct knowledge of the program to provide input, others with knowledge of the program should also be consulted. We urge you to ensure that a consolidated response representing the considered view of all parts of the Executive Branch is submitted to the Committee for review. [my emphasis]

Let’s name names, shall we?

The person currently driving the Torture Report declassification process is a guy by the name of John Brennan (indeed, as Goldman and Apuzzo note in their coverage of the Clandestine Service decision, few other high ranking torturers are left).

At the time the torture program was instituted, he was CIA’s Deputy Executive Director, in charge of things like logistics and personnel. He was, at a minimum, read into the torture techniques as they were being approved. Few people around at the time remember him expressing any opposition to them — aside from wanting the politicians who approved torture to be held responsible for it. Brennan also admits to knowing the torture was taped, and his forgetfulness about whether he sought information on CIA lawyer John McPherson’s review of the torture tape leads me to suspect he learned, at the time, that the torturers were destroying the record of them exceeding torture guidelines. Brennan also — after he had moved on to the Terrorist Threat Integration Center — relied on information derived from torture in sworn declarations submitted to the FISA court.

I’d say all that qualifies Brennan as an “individual who might be implicated in the CIA’s use of torture.” (It should also have disqualified him for the job, but you fight torture with the Senate you have, not the one that might be a functioning oversight body.)

That is, these human rights groups, though far more polite than I am, are basically saying that John Brennan shouldn’t be entrusted with this declassification decision because he’d be covering up his own role in it (he is mentioned, though not badly implicated, in the report).

But that same line is also where the logic of this letter fails.

After all, as I have pointed out, torture was not CIA’s baby. It was the White House’s. And while Obama personally had no role in authorizing torture (except insofar as the government relies on Appendix M to use techniques that amount to torture, and outsources it to countries like Somalia), the President — President Bush — did. So while, unlike Brennan, Obama isn’t personally implicated in what the report shows, his office — one whose authority he has jealously guarded — is. Every appeal to the White House to declassify this report should be clear about that fact.

Particularly given the one objection Brennan is reported to have expressed back in the early days of torture:

He expressed concern, according to these officials, that if details of the program became public, it would be CIA officers who would face criticism, rather than the politicians and lawyers who approved them.

The one objection Brennan had to torture, it seems, is that the CIA — not the White House — would be blamed for it.

I would imagine the White House knows that well.

Mark Udall to Obama: You Can Force John Brennan to “Excise the Demons”

I have to admit, this letter from Mark Udall urging Obama to support the release of the Senate Intelligence Committee’s torture report is close to shrill when describing CIA Director John Brennan’s disinterest in declassifying the report.

Meanwhile, there have been media reports that the CIA is planning an “aggressive response” and is objecting to a “majority” of the Committee’s Study. While I find these reports hard to believe, I am concerned that despite my request — and requests from Chairman Feinstein and other colleagues on the Committee — Director Brennan and his staff have shown little to no interest in engaging collaboratively and constructively with the Committee on a path forward on the Committee’s Study. In fact, despite repeated requests by Members, the CIA has declined to meet or discuss the Study with Committee staff. [my emphasis]

But a more important detail elaborates on something hinted at in this report of Joe Biden’s support for releasing the report.

Speaking about the classified Senate Intelligence report on the use of torture or enhanced interrogation by the United States, Biden suggested that his personal view is that he agrees with McCain that more information should be made public, while he noted it has been the subject of intense debate at both ends of Pennsylvania Avenue.

“Now this voluminous study has been done,” Biden said. “And the internal debate that goes on in the Congress and in the White House is, do we go back and do we expose it? Do we lay out who was responsible and how we got to where we are?”

“It offends the fundamentals of what kind of country we are, and the practical side of it is, don’t think it didn’t damage the United States’ image in the world in ways that we’ll be paying for for years to come,” McCain said, noting his support for disclosing more details of what happened.

“It is not resolved yet, John, but I’m where you are. I think the only way you excise the demons is you acknowledge, you acknowledge exactly what happened straightforward,” Biden said. [my emphasis]

That is, the CIA is not the only part of the Executive Branch debating the release of the report. So is the White House. And while Udall is much less shrill with this suggestion than his description of Brennan’s disinterest in discussing the report, he does imply that Obama ultimately gets to make this decision.

It is my understanding that the comments from your administration will reflect not only the views of the CIA, but also other Executive Branch agencies impacted by the CIA’s detention and interrogation program. I believe the views of other government agencies and the White House are absolutely essential in order to engage in a constructive, lessons-learned dialogue.

In 2009, you made it clear that the CIA’s detention and interrogation program and its “enhanced interrogation techniques” had no place in an Obama administration. I deeply appreciate your stand on these important issues. I also applaud the recent comments of Vice President Biden about the need to “excise the demons” and acknowledge what was done under the CIA’s detention and interrogation program. Only by acknowledging and correcting the false public record can the CIA — with your support — credibly institute the necessary reforms that are essential for the CIA to be its best. I strongly believe — and trust that you agree — that publicly acknowledging the truth of this program, regardless of how uncomfortable, is necessary, consistent with our country’s history and ideals, and in the long-term interests of the CIA and the American people. [my emphasis]

Obama’s Administration has tried to hide the fact in the courts, but the torture program was the President’s program, not CIA’s. According to then-CIA Director Leon Panetta, the NSC — not the CIA Director — was the entity that made the torture program a Special Access Program.

Officials at the National Security Council, (NSC) determined that in light of the extraordinary circumstances affecting the vital interests of the United States and the sensitivity of the activities contemplated in the CIA terrorist detention and interrogation program, it was essential to limit access to the information in the program. Mark Udall: Leakers on Senate Intelligence Torture Report Got Facts Wrong

Last week, I noted that leaks to the WSJ about CIA’s response to the Senate Intelligence Torture report seemed designed to box John Brennan in, making it very difficult for him to authorize declassification of the report.

Sure enough, the very day after Brennan won confirmation, WSJ reports that CIA is not done with their review yet, but they disagree with the report’s findings.

The report examines the details of conditions under which each detainee was held and interrogated, the quality of the information provided and the accuracy of how the CIA described the program to other officials and lawmakers. It included 20 recommendations, officials said.

The report assesses the utility of information from interrogations in 20 cases and concludes that it wasn’t useful; the CIA disputes that conclusion in all but one or two of those assessments, officials said.

The CIA is objecting to the majority of the report, a senior intelligence official said.

“The overall objection was the report basically says we never in any instances got good information from this program,” another U.S. official said. “To anyone who has worked at the CIA on this issue, that’s not true.”

Even CIA officers who opposed the interrogation program acknowledge that the agency obtained useful information, the U.S. official said.

Even if Brennan wanted to declassify this report — and given his stated desire to protect CIA from criticism, he probably doesn’t want to — he’d have a hard time doing so, because it would instantly turn the torture dead-enders against him, which is not the safest way to start a job managing a bunch of talented spooks. [my emphasis]

In today’s Global Threat Assessment hearing, Mark Udall addressed the WSJ report. He revealed that the leakers behind that report had gotten basic facts about the report wrong — such as that there were 20 recommendations.

He then asked John Brennan three questions:

  • CIA officials are leaking what may or may not be official response to the report. Do you believe this is leak of CIA views?
  • Do you anticipate looking into leak?
  • There’s no new deadline for CIA comments in response to report. When can we get it?

Brennan did say the CIA was assessing the story to determine whether “there had been a disclosure.” I’m not sure whether he answered whether the leaks represented the views of the CIA.

Brennan also hedged a bit about a new deadline to respond to Congress. He would like to say comments will come back within a months time, he said (the original deadline was February 15, basically a month past already). He then promised his “firm resolve” to look at what CIA has put together and get back to the Senate Intelligence Committee.

That Makes Over 21 Requests by 31 Members of Congress, Mr. President

Adding the letter that Barbara Lee, as well as a list of all Members of Congress who have, at one time or another, requested the targeted killing memos.

February 2011: Ron Wyden asks the Director of National Intelligence for the legal analysis behind the targeted killing program; the letter references “similar requests to other officials.” (1)

Did Susan Collins Switch Parties? Cause She Wanted OLC Memos, Too

I hate to waste an entire post on this.

But the NYT’s report last night that President Obama was going to capitulate to the Benghazi truthers rather than turn over memos revealing who and where he has been killing people — as well as all the secondary reporting on it — has made this claim.

Rather than agreeing to some Democratic senators’ demands for full access to the classified legal memos on the targeted killing program, Obama administration officials are negotiating with Republicans to provide more information on the lethal attack last year on the American diplomatic compound in Benghazi, Libya, according to three Congressional staff members.

The strategy is intended to produce a bipartisan majority vote for Mr. Brennan in the Senate Intelligence Committee without giving its members seven additional legal opinions on targeted killing sought by senators and while protecting what the White House views as the confidentiality of the Justice Department’s legal advice to the president. It would allow Mr. Brennan’s nomination to go to the Senate floor even if one or two Democrats vote no to protest the refusal to share more legal memos. [my emphasis]

On February 4, Susan Collins was among the 11 Senators who signed a letter asking for “any and all legal opinions that lay out the executive branch’s official understanding of the President’s authority to deliberately kill American citizens.”

Perhaps Collins has been satisfied with the brief glimpse at the two memos it shared with the Committee back on February 7. Perhaps she — the Senator on the Intelligence Committee who asked the best questions about targeted killing efficacy — is not all that interested in the other memos the Administration is hiding, presumably along with uses of targeted killing she isn’t being briefed on. Perhaps she no longer supports the hinted hold-up for national security nominees.

But even on the Senate Intelligence Committee, the call for the targeted killing memos was a bipartisan affair (among those not on the committee, Mike Lee and Chuck Grassley also signed the letter, and Rand Paul sent his own demand for the memos). Heck, once upon a time, John Cornyn wanted to legislatively demand the memos.

Demanding that the President reveal what kind of targeted killing programs it supports is no hippie fetish. It is something that members of both parties have supported.

White House Capitulates to Benghazi Truthers Rather Than Coming Clean on Targeted Killing

The other day, I explained that the Administration would be forced either to cede to Republican demands for Benghazi talking points and other truther demands or release a full accounting why and in which countries it has conducted targeted killing.

It decided to capitulate to the Benghazi truthers rather than tell the Intelligence Committee what kind of targeted killing it has been doing.

The administration is currently in discussions with Republican members of the Intelligence Committee about providing the trail of e-mails that were the basis of “talking points” from the intelligence agencies regarding the Sept. 11 attack in Benghazi, which killed the American ambassador to Libya, J. Christopher Stevens, and three other Americans. Such a concession would probably win at least some Republican votes for Mr. Brennan.

I get that the Benghazi truther demands are, at this point, pointless. I get that the President would rather cede to a bunch of  nutcases  from the Republican party than Senators from his own party.

But what does it say that this information on targeted killing–which the Administration should provide to the intelligence Committees under the National Security Act, by law, in any case–is more precious than a bunch of partisan hackery the Republicans have been pursuing since September.

John Brennan Refuses to Deny the Government Collects US Person Data with No Predicate

John Brennan pointedly refused to answer Mark Udall’s question about whether the government collects information on Americans without a predicate.

In 2008, you stated, “I would argue the government needs to have access to only those nuggets of information that have some kind of predicate. That way the government can touch it and pull back only that which is related.” You also stated that the issue needed to be discussed, “not to the point of revealing sources and methods and giving the potential terrorists out there insights into our capability – but to make sure there is a general understanding and consensus that these initiatives, collections, capabilities, and techniques comport with American values and are appropriately adjusted to deal with the threat we face.” Do you believe the U.S. government currently has access to only nuggets of information that have some kind of predicate? Do you believe that the public has adequate information on this topic?

I believe your first question is referencing statements I made about the need to balance security, privacy, and civil liberty interests in connection with the then ongoing public debate over changes to the Foreign Intelligence Surveillance Act. With respect to FISA, this Administration has worked hard to ensure that any electronic surveillance that targets the American people is subject to judicial review through the Foreign Intelligence Surveillance Court to ensure, among other things, that such surveillance complies with the Constitution, and I strongly supported these efforts. I believe it is important that the Judicial Branch act as a check on the Executive Branch to ensure there is an adequate factual predicate to conduct lawful electronic surveillance that targets the American people. I have also supported – and will continue to support – the Administration’s efforts to ensure that Congress is kept informed of our surveillance practices and processes.

Moreover, the Act provides the process and procedures the Government must follow to undertake surveillance, as well as the role the Judicial Branch and the Congress play in that process. As I have stated publicly, I support as much transparency as possible on our counterterrorism efforts, consistent with our obligation to protect sources and methods. Thus, to the extent we could discuss with the public some of the factual predicates that have been deemed by courts as sufficient to justify surveillance, I would support doing so. Indeed I do believe, as I said in my September 2011 speech at Harvard Law School that an “open and transparent government” is one of the values our democratic society expects and demands. [my emphasis]

As a threshold matter, Brennan is addressing underlying predicates only with regards to the FISA Amendments Act, not to Section 215, which uses the relevance standard to collect information — from acetone and hydrogen peroxide purposes, probably to geolocation — of totally innocent Americans.

But even so, this answer not only doesn’t answer Udall’s question — didn’t you once believe that we should only collect intelligence for which there is a predicate so we don’t conduct fishing expeditions — but it points to the inadequate role of the FISA Court in limiting who the US can spy on.

I guess John Brennan has become a fan of fishing expeditions into US person data.

In any case, unlike Lisa Monaco, Brennan isn’t going to promise to release the secret law.

In 2008, you stated that it was important that there be a public airing, including public congressional hearings, related to the predicate for the surveillance of U.S. persons. Do you believe there is more on this topic that could be declassified?

And while I am not aware of any particular information on this topic that could be declassified, I do believe any such information should be disclosed to the extent that such a disclosure could be done consistent with our national security.

The Benghazi Truthers and the OLC Hold-Outs

Screen shot 2013-02-14 at 8.41.25 AMDianne Feinstein announced yesterday that the Senate Intelligence Committee would not, as originally planned, vote on John Brennan’s nomination today. No Valentine’s Day love for Brennan I guess.

DiFi cited outstanding questions on Benghazi and the 7 OLC memos the White House has withheld.

That’s important background to this Joshua Hersh story, which makes fun of Richard Burr (who had just made a joke about his relative Aaron Burr killing Alexander Hamilton) grilling Jack Lew about who briefed Obama on Benghazi the night of the attack. As Hersh points out, the White House has released a picture showing Denis McDonough briefing the President that day, which ought to answer Burr’s question.

What Hersh doesn’t say is that Burr specifically asked Lew whether Brennan was in this loop. In the closed session on Tuesday, apparently, Brennan said he wasn’t. This comes on top of the White House withholding — at least as of last Thursday — Presidential Daily Briefs and some emails about the response to Benghazi as it unfolded.

Now, Lew’s role in Benghazi briefings really won’t affect his job as Treasury Secretary. But Brennan’s role might, particularly if the Murdoch boosted eBook alleging he was running ops in Libya out of the White House is true (I’m not saying it is).

In any case, the persistence of the Benghazi truthers has introduced an interesting dynamic I didn’t expect. Of the Republicans on the Senate Intelligence Committee, only Susan Collins and possibly Tom Coburn are not full-on Benghazi truthers (and James Inhofe, who gets a vote if he wants one as Armed Services Committee Ranking member, could add another truther vote).

But Collins is part of the other group — along with at least Ron Wyden and Mark Udall — holding up Brennan’s nomination, those demanding the 7 OLC memos on targeted killing the White House has thus far refused to turn over to the Committee purportedly overseeing these killings. That puts the vote somewhere in the vicinity of 9 votes holding out for something from the White House, 6 votes ready to vote Brennan’s nomination forward.

So who will the White House cede to? The Benghazi truthers, or the OLC holdouts? And is what is in the material the White House has thus far withheld enough for these groups to vote against Brennan?

Note, there’s always the possibility these groups will converge. The public record supports the conclusion that Libyan militants in Derna claimed to have been struck or at least surveilled by a drone. Those militants have ties, at least, to the militants who carried out the attack on the Benghazi post, and the public record also supports the claim the militants were avenging that drone surveillance or strike.  If that drone was approved by an unknown memo authorizing continued strikes in Libya, it would be something that both the Benghazi truthers and the OLC holdouts would be interested in.

Setting Up a Department of Pre-Crime, Part One: Why Are We Doing This?

I’m going to have a series of posts on the proposed FISA Drone (and/or Targeted Killing) Court, starting with a description of why I think there’s movement to do this now.

There are, as I see it, three different motivations among those now backing a FISA Drone (and/or Targeted Killing) Court.

First, there’s Dianne Feinstein. Now that the white paper has been released — and the actual OLC memos to the other members of her committee — it has been made clear that the program she has been assuring Americans, based on her Gang of Four review, is lawful is not the slam dunk she made it out to be. And while Mike Rogers’ constituents may not object to his continued reassurances that it is okay for the President to kill an American based on his sole authority (though they may; we shall see), DiFi’s are likely to. (Saxby Chambliss, of course, is not running for re-election; Dutch Ruppersberger has been rather quiet in the last few days). So to the degree that DiFi takes a lead on this issue, it is an effort to put a palatable spin on something she has been spinning as legal for years.

If a FISA Drone (and/or Targeted Killing) Court is necessary and justified, it should have been in 2009, when she took over the Chair at Senate Intelligence Committee (or at the very least, by January 2010, when it became clear the Obama Administration was targeted Anwar al-Awlaki). But somehow, DiFi is only backing the idea now that her poor judgment in letting the killings continue without oversight is being exposed. To some degree, I’d put Patrick Leahy (who doesn’t want to be tough with Obama) and Chuck Grassley in this position, as well.

Then there’s John Brennan, who in response to Angus King’s suggestion of a FISA Drone (and/or Targeted Killing) Court said,

And that’s why I do think it’s worthy of discussion. And the point particularly about due process really needs to be taken into account because there’s not a different standard as far as if a U.S. citizen joins Al Qaida, you know, in terms of the intelligence base or whatever. But American citizens by definition are due much greater due process than anybody else by dint of their citizenship.

I think this is a very worthwhile discussion. I look forward to talking to the committee and others about it. What’s that appropriate balance between executive, legislative and judicial branch responsibilities in this area?

I think Brennan’s motivation is far better summed up in the response he gave Jello Jay Rockefeller, who basically used his second round question to deliver a very sloppy blow job to Brennan. In response, Brennan got firey.

I want every member of this committee to be an ardent advocate, proponent, and defender of the men and women of the Central Intelligence Agency.

And I see it as my obligation to represent them to you on their behalf, so that when times get tough and when people are going to be criticizing and complaining about the CIA, I have all of you to say you knew about what the CIA was doing, you supported it, and you will defend it.

My impression is that, contrary to the moral rectitude myth, Brennan is a pretty amoral guy. It’s not right and wrong that motivates him; it’s allegiance, and as CIA Director (and, probably, even now) his allegiance is going to be to the institution.

And as he said in no uncertain terms to Jello Jay, he believes it is the role of the Intelligence Committee to support and defend the illegal actions the CIA does.

Brennan likely also knows that the easiest way to give the Committee cover for ardently defending what is, at its core, indefensible, and the only way to do so without affecting the flexibility accorded to the Executive Branch, is to let them pawn off the moral questions to a court operating in secret.
