Did an Intelligence Asset Persuade Abdulrahman al-Awlaki to Search for His Father?

There’s an inconclusive — but nevertheless intriguing — detail in Jeremy Scahill’s Dirty Wars that might explain why Abdulrahman al-Awlaki decided, in September 2011, to go search for his father. After the boy ran away from home, the family tried to figure out why, having expressed no plans to go search for his father, he would up and leave like he did.

The family called around to Abdulrahman’s friends. Someone told [Awlaki’s father] Nasser that a teacher at the school had recently gotten close to Abdulrahman, and Nasser believed the teacher had been encouraging Abdulrahman to find his father and to reconnect with him, that it would be good for the boy. “He had influence on him, an they used to go to a pizza parlour to eat pizza.” Nasser said. When Nasser tried to find the teacher to ask him if he had any information about Abdulrahman’s whereabouts, the teacher had “vanished.”

Granted, this amounts to no more than an observation that someone who had become influential on the boy disappeared right as the family started looking for answers; there’s no affirmative evidence there was a connection.

That said, the CIA had already twice tried to use family ties to get to Awlaki by this point. As the Danish agent Morten Storm has described, he arranged a marriage between a Croatian convert to Islam and Awlaki in a failed attempt to track the cleric.

In addition, as Scahill laid out in his book and excerpted in the Nation, a CIA officer unsuccessfully approached Awlaki’s brother, Ammar, in February 2011 to help them find Awlaki.

Chris made it clear that he worked for the CIA. He told Ammar that the United States had a task force dedicated to “killing or capturing your brother”—and that while everyone preferred to bring Anwar in alive, time was running out. “He’s going to be killed, so why don’t you help in saving his life by helping us capture him?” Chris said. Then he added, “You know, there’s a $5 million bounty on your brother’s head. You won’t be helping us for free.”

Ammar told Chris that he didn’t want the money, that he hadn’t seen Anwar since 2004 and had no idea where he was. The American countered, “That $5 million would help raise [Anwar’s] kids.”

“I don’t think there’s any need for me to meet you again,” Ammar told Chris. Even so, the American told Ammar to think it over, perhaps discuss it with his family. “We can meet when you go to Dubai in two weeks,” he said. Ammar was stunned: his tickets for that trip had not yet been purchased, and the details were still being worked out. Chris gave Ammar an e-mail address and said he’d be in touch.

Clearly, by 2011, the CIA was willing to try any scheme that might help them find Awlaki, regardless of the family bounds it abused. So it is conceivable, at least, that they might try to use Abdulrahman as “bait,” a word Awlaki’s mother used.

I wonder if John Brennan considered this possibility in his review of why the United States assassinated one of its teenaged citizens?

Are We Confusing CIA’s Leader-Centered Collection and Debates about Its Paramilitary or Military Focus?

In his written testimony for yesterday’s drone hearing, Peter Bergen noted that the CIA keeps failing to warn policy makers of important developments.

Has the increased emphasis at the CIA on targeted killings hampered the agency’s ability to understand really important political developments in the Muslim world, such as the Arab Spring? As a senior Obama official has noted: “The CIA missed Tunisia. They missed Egypt. They missed Libya.” Even after the Egyptian revolution occurred, the CIA appears to have entirely missed the fact that the ultra-fundamentalist Salafists would do very well at the election box, winning around quarter of the votes in the 2011 parliamentary election, making them the second largest political bloc in Egypt after the Muslim Brotherhood.

At the hearing, Bergen more closely connected what he called CIA’s paramilitary focus and its recent intelligence failures.

It’s a judgment often repeated: that the CIA has had some big recent intelligence failures because it has been too busy running drone programs in Pakistan and Yemen.

But is that right?

John Brennan’s Review of How He Killed an American Teenager

Jeremy Scahill’s book, Dirty Wars, comes out tomorrow. I’m sure I’ll have more to say about it over the next few weeks.

But for now, he’s got an adaptation at the Nation that describes a Senior Administration Official involved in drone targeting, who would have left sometime between October 14, 2011 and now (so, maybe Petraeus, Panetta, Clinton, or Vietor?? Update: Or Jeh Johnson?), claiming that the strike was all a mistake, launched in response to apparently crappy intelligence from Ali Abdullah Saleh’s government (or possibly the Saudis?) claiming that senior AQAP leader Ibrahim al-Banna was present, alone.

A former senior official in the Obama administration told me that after Abdulrahman’s killing, the president was “surprised and upset and wanted an explanation.” The former official, who worked on the targeted killing program, said that according to intelligence and Special Operations officials, the target of the strike was al-Banna, the AQAP propagandist. “We had no idea the kid was there. We were told al-Banna was alone,” the former official told me. Once it became clear that the teenager had been killed, he added, military and intelligence officials asserted, “It was a mistake, a bad mistake.”

The now-former SAO goes on to describe how pissed the Moral Rectitude Drone Assassination Czar John Brennan was about the strike, because he believed Abdulrahman was deliberately set up to be killed (though Scahill’s source doesn’t appear to specify whom Brennan thought was setting up an American teenager for death, JSOC, Yemeni partners, or the Saudis).

However, John Brennan, at the time President Obama’s senior adviser on counterterrorism and homeland security, “suspected that the kid had been killed intentionally and ordered a review. I don’t know what happened with the review.”

So Brennan sets up a review … that apparently got stashed in the same black hole as every other report on drone killing.

Because the whole thing is embarrassing.

Brennan, who is now director of the CIA, recently answered an inquiry from the Senate Intelligence Committee on such after-strike reviews. When civilians are killed, Brennan said, “we not only take account of the human tragedy, but we also go back and review our actions.” Analysts “draw on a large body of information—human intelligence, signals intelligence, media reports, and surveillance footage—to help us make an informed determination about whether civilians were in fact killed or injured,” Brennan asserted in his written response. “In those rare instances in which civilians have been killed, after-action reviews have been conducted.” No such review of Abdulrahman’s killing has ever been made public.

The consensus that has emerged from various anonymous officials commenting on Abdulrahman’s killing was that it was a mistake. I asked the former senior administration official why, if that was the case, the White House didn’t publicly acknowledge it. “We killed three US citizens in a very short period,” he told me. “Two of them weren’t even targets: Samir Khan and Abdulrahman Awlaki. That doesn’t look good. It’s embarrassing.”

Recall, when JSOC killed almost an entire Bedouin clan in al-Majala, David Petraeus claimed that only the alleged targets immediate family had been killed, well after people had been to the site to document the carnage. Immediately after Abdulrahman’s death, the Administration immediately, almost boisterously, claimed the boy was 21, either based on crappy intelligence or in an attempt to justify a “military aged male” claim.

This is why it is so important to declassify the documents on targeted killing. Even according to the Moral Rectitude Drone Assassination Czar, this kid was set up.

He just won’t tell us by whom.

The Downside of Losing Blabby Brennan as Homeland Security Czar

Screen shot 2013-04-17 at 4.03.26 PMAs I’ve noted in passing, the Boston Marathon will be the first major homeland security episode that John Brennan’s replacement, Lisa Monaco, will coordinate at the White House. As NJ describes in this profile, Monaco has worked for years at FBI and DOJ in national security, so it’s not like the Administration loses expertise with Monaco in the Homeland Security Czar.

But it does mean the Administration doesn’t have John Brennan, who has been known to give briefing on crises to his predecessors with TV contracts, as when he leaked that UndieBomb 2.0 was an Saudi sting to Fran Townsend and Richard Clarke.

About an hour or two ago, the media was buzzing, with CNN in the lead. The FBI had identified a suspect, they reported. The FBI had arrested someone, and would be bringing the suspect to the Court House, they reported. Along the way John King suggested, video evidence to the contrary, the suspect was a “dark skinned male.”

A key source in those report was Fran Townsend, working from tips from people inside government.

Ultimately, FBI actually released a press release making clear there hadn’t been an arrest.

Meanwhile, in response to CNN and other outlets’ reporting, a big crowd had formed at the courthouse. Predictably, a bomb threat came into the courthouse, so then the police had to evacuate the courthouse.

As CNN’s reporters were standing around trying to avoid apologizing for possibly tipping of the suspect of the attack, they started blaming their sources, suggesting they had been “used” to flush out the suspect, even while warning that saying “too much” might lead the suspect to do some undesirable things.

It was a thorough clusterfuck.

Mind you, I have every reason to believe that Monaco is doing a great job, and I actually don’t think it’s the job of the Homeland Security Advisor to hand feed the cable news channels.

But I guess blabby Brennan would have at least ensured that Townsend got her story correct.

The White House Decides Maybe They’re Not “Targeted Killings” After All

In the 15 paragraphs that make up the core of John Brennan’s so-called transparency on drone killings, he used the word “target” in one or another form 24 times.

… the United States Government conducts targeted strikes against specific al-Qaida terrorists … the debate over strikes targeted at individual members of al-Qaida has centered on their legality, their ethics, the wisdom of using them, and the standards by which they are approved. … First, these targeted strikes are legal. … Second, targeted strikes are ethical.  Without question, the ability to target a specific individual, from hundreds or thousands of miles away, raises profound questions. …

Targeted strikes conform to the principle of necessity, the requirement that the target have definite military value.  In this armed conflict, individuals who are part of al-Qaida or its associated forces are legitimate military targets.  We have the authority to target them with lethal force just as we target enemy leaders in past conflicts, such as Germans and Japanese commanders during World War II.

Targeted strikes conform to the principles of distinction, the idea that only military objectives may be intentionally targeted and that civilians are protected from being intentionally targeted.  With the unprecedented ability of remotely piloted aircraft to precisely target a military objective while minimizing collateral damage, one could argue that never before has there been a weapon that allows us to distinguish more effectively between an al-Qaida terrorist and innocent civilians.

Targeted strikes conform to the principle of proportionality, … By targeting an individual terrorist or small numbers of terrorists with ordnance that can be adapted to avoid harming others in the immediate vicinity, … targeted strikes conform to the principle of humanity which requires us to use weapons that will not inflict unnecessary suffering. For all these reasons, I suggest to you that these targeted strikes against al-Qaida terrorists are indeed ethical and just. … Targeted strikes are wise. Remotely piloted aircraft … strike their targets with astonishing precision, … Yet they are also a wise choice because they dramatically reduce the danger to innocent civilians, especially considered against massive ordnance that can cause injury and death far beyond their intended target. … a pilot operating this aircraft remotely … might actually have a clearer picture of the target and its surroundings, … There’s another reason that targeted strikes can be a wise choice, the strategic consequences that inevitably come with the use of force.  As we’ve seen, deploying large armies abroad won’t always be our best offense. … In comparison, there is the precision of targeted strikes.

Andy Card LOL: Bush Can’t Pardon Himself for Torture (But Obama Has)

As part of the discussion in his book explaining how the CIA shifted from torture to killing, Mark Mazzetti tells the story of how the CIA balked at engaging in further torture after the Detainee Treatment Act.

After President Bush signed the bill into law, then-CIA Director Porter Goss wrote the White House saying the CIA would refuse to torture unless and until they got a guarantee they wouldn’t be prosecuted for doing it. In response, the Bush Administration sent Andy Card to the CIA to try to calm them down.

Card drove out to Langley intending to soothe the fears at CIA headquarters, but his visit was a disaster. Inside a packed conference room, Card thanked the assembled CIA officers for their service and their hard work but refused to make any firm declarations that agency officers wouldn’t be criminally liable for participating in the detention-and-interrogation program.

The room became restless. Prodded by his chief of staff, Patrick Murray, Porter Goss interrupted Card.

“Can you assure these people that the politicians will not walk away from the people who carried out this program?” Goss asked. Card didn’t answer the question directly. Instead, he tried to crack a joke.

“Let me put it this way,” he said. “Every morning I knock on the door of the Oval Office, walk in, and say, ‘Pardon me, Mr. President.’ And of course, the only person the president can’t pardon is himself.”

Card giggled after he said this, but his joke landed with a thud. The White House chief of staff, when asked whether President Bush would protect CIA officers from legal scrutiny, had suggested that the most they might be abel to rely on is a presidential pardon after the indictments and convictions were handed down. Goss effectively repeated a request the CIA had made, unsuccessfully, as early as July 13, 2002 (when, it should be said, Goss was ostensibly in charge of overseeing the program at the House Intelligence Committee, though there’s no reason to believe he knew about the earlier request): for an Administration guarantee that everyone involved in the torture program would be shielded from criminal consequences for kidnapping and torturing.

And in response, Card implied to these CIA officers and executives two things:

  • President Bush would pardon anyone convicted of crimes related to torture
  • Bush, himself, was ultimately exposed to prosecution for those crimes as well (all the more so, since he couldn’t pardon his own crimes)

Now, Card wouldn’t have even tried such a joke unless he knew his audience knew that the torture program was based on a Presidential Finding — what we know to be the September 17, 2001 Gloves Come Off Memorandum of Notification.

There’s fairly clear evidence that CIA’s officers did know about it.

George Tenet had made that clear on every single page of his January 2003 Guidelines on Interrogations, which at least some CIA interrogators had to sign.  Read more

Scott Shane Defends the Commander-in-Chief’s Language

NYT’s excellent new ombud, Margaret Sullivan, returns to a perennial ombud issue, how the Grey Lady refers to Executive Branch actions and abuses. She includes a long quote from Scott Shane that reveals a great deal about his reporting, and ultimately convinces me we should be calling drone killing assassination.

Adherence to “Targeted Killing” Even While Admitting It’s Not

Let’s start with Shane’s defense of the term “targeted killing” (a term I sometimes use but should not). Sadly, Sullivan cuts off the direct quote from Scott Shane at its most important part, but in the following, the first paragraph here is a direct quote from Shane, the second Sullivan’s report of his comment.

This leaves “targeted killing,” which I think is far from a euphemism. It denotes exactly what’s happening: American drone operators aim at people on the ground and fire missiles at them. I think it’s a pretty good term for what’s happening, if a bit clinical.

Mr. Shane added that he had only one serious qualm about the term. That, he said, was expressed by an administration official: “It’s not the targeted killings I object to — it’s the untargeted killings.” The official “was talking about so-called ‘signature strikes’ that target suspected militants based on their appearance, location, weapons and so on, not their identities, which are unknown; and also about mistaken strikes that kill civilians.”

Shane defends using “targeted killing,” even while admitting that a great deal of drone killing is not targeted. Unless Shane knows a great deal more about individual strikes than he lets on — and therefore knows which drone strikes are targeted at known identities and which are targeted at crowds of unknown military aged males — then he is party to an apparently deliberate strategy on the part of the Administration to spin its killing program as much more orderly and legally justified than it actually is. We saw this operate as recently as yesterday, when John Brennan responded to a question from Jan Schakowsky about signature strikes by telling her to look back at speeches that address only “targeted killing.”

SCHAKOWSKY: Let me ask you this, is there any way that you can define and distinguish between targeted strikes and signature strikes by the — by drones?

BRENNAN: I would refer to the comments that were made by a number of U.S. government officials publicly in speeches, including when I was at the White House. I’m not going to engage in any type of discussion on that here to the Congress, ma’am.

As I said, I’m as guilty of using this term without sufficient awareness as Shane. But doing so consciously really is participating in a propaganda effort the Administration is engaged in.

Executive Order 12333’s Invisible Ink

Then there’s Shane’s refusal to use “assassination” based on Administration claims about Executive Order 12333, which ostensibly prohibits the practice.

“Assassination” is banned by executive order, but for decades that has been interpreted by successive administrations as prohibiting the killing of political figures, not suspected terrorists. Read more

ICRC President Visits Obama, Brennan, Hagel Regarding “International Humanitarian Law”

Peter Maurer, President of the International Committee of the Red Cross, yesterday completed four days of meetings with US officials in Washington. According to the blog site for the ICRC, Maurer met with President Barack Obama, senior members of Congress and a number of high-ranking government figures, including “Secretary of Defense Chuck Hagel, Secretary of Homeland Security Janet Napolitano, Director of National Intelligence James Clapper, Director of the Central Intelligence Agency John Brennan, Deputy Secretary of State William Burns, and Deputy Attorney General James Cole.”

It is perhaps not surprising that since there is a widespread hunger strike at Guantanamo (and since the ICRC visited Guantanamo earlier this month), detention issues were high on the list of topics for the meetings:

A focus of Mr Maurer’s visit was detention-related matters. “The United States, including its Congress, must urgently find a way to resolve all pending humanitarian, legal and policy issues relating to the detention of persons held at Guantanamo Bay, including those deemed to no longer represent a threat that justifies their continued detention there,” said Mr Maurer.

But Guantanamo was not the only topic. It comes as a welcome development to me that Maurer would widen the scope of discussion with key figures such as Obama, Brennan and Hagel to remind them of their duties under international humanitarian law:

“We enjoy a robust and multi-faceted dialogue with the United States, and my visit was an opportunity to discuss issues and contexts of mutual concern such as Syria and Afghanistan,” said Mr Maurer. “The United States values the mandate, positions and input of the ICRC and I am confident that this interaction will continue to bring concrete results, notably in terms of implementation of and respect for international humanitarian law in current and future battlefields.”

Especially when it comes to Obama and Brennan, it is striking that this statement can be construed as saying that the US needs to implement international humanitarian laws and to respect them. Although not stated outright, it is impossible to come to any other conclusion than to believe that the ICRC now believes that the US does not abide by international humanitarian law. I would think that the US practice of targeted killings, which is viewed by the UN as an issue for international law (and where the UN has called “double tap” drone strikes war crimes) would likely have been a topic for Maurer when talking with Brennan, who has played a key role in ordering drone strikes.

Sadly, I don’t share the ICRC’s optimism regarding our government’s respect for the “mandate, positions and input of the ICRC”. We need look no further than the sad news out of Guantanamo yesterday where it now appears that hundreds of thousands of confidential files and communications belonging to Guantanamo defense lawyers have been provided to the prosecution. I Hate to Say I Told You So, John Brennan Covering Up Torture Report Edition

Man, have the Democrats on the Senate Intelligence Committee — particularly Dianne Feinstein and Jay Rockefeller — been pawned. One of their key issues during John Brennan’s confirmation was the declassification of the 6,000 page torture report.

Based on both Saxby Chambliss’ representation of comments Brennan made in their private meeting and on the delayed CIA response about the report, I predicted Brennan would be stating publicly what he stated privately (not having read most of the report yet) to Saxby.

During John Brennan’s confirmation process, he answered questions about the Senate Intelligence Committee report on torture with two faces. To Saxby Chambliss in private, he said he thought the report was a prosecutorial document, set up to come to pre-ordained conclusions. Publicly, to Democrats, he said he was shocked–shocked!–by what he had read in the Executive Summary of the report.

It was quite clear that Brennan was playing the lawmakers who would get to vote on his confirmation, but they didn’t delay his confirmation to resolve the report declassification.

When Brennan’s confirmation got delayed by demands to exercise oversight, the CIA delayed its response — originally due February 15 — on the contents of the report. Indefinitely.

All of this, of course, sets up Brennan to refuse to declassify the report because he believes (and, importantly, believed from the start, according to Saxby Chambliss) that the people who have now rushed his confirmation through were acting in an unfairly prosecutorial mode when they spent 5 years documenting what CIA did in its torture program.

Here’s what Brennan said to Jan Schakowsky yesterday when she asked about the report.

SCHAKOWSKY: Let me ask you also, Mr. Brennan, as you know, the Senate Intelligence Committee report on former CIA detention and interrogation practices is under review with the — within the administration and the agency. Comments were originally due back to the committee on February 15, though the reply has now been delayed indefinitely.

On March 7 in the New York Times, former CIA Senior Analyst, Emile Nakhleh said that if any person can take this on, it would be you, Director Brennan. It’s you and that, quote, “the institution would benefit from the eventual — eventual declassification and release of the study.”

What is the current status of the review of the report and can you please just, if you could, discuss the importance as a leader of the — the leader of the CIA of its release?

BRENNAN: Well, clearly, it’s — it’s an important report that was issued by the — the Senate Select Committee on Intelligence. I have as — as recently as earlier this [week] spoken with both the chairman and the vice chairman of the — the committee telling them that I am in the process of the reviewing of the — the document and will be getting back to them shortly. This is a 6,000 page document that has, you know, millions of pages behind it in terms of what was reviewed.

And so it’s my obligation as the Director of CIA to make sure that my response back to them is going to be thorough and as accurate as possible and will convey my views about what that report portrays about CIA’s past practices, what we have learned from that experience running the program as well as from that report and also to identify things that I might think that the — the committee may have — the committee’s report might not accurately represent. [my emphasis]

Schakowsky asked about the import of releasing the report, and Brennan instead responded by talking about using the report as a lessons learned document and also objecting to some of the things found in it.

But it sure looks like, unless someone starts pulling teeth, CIA will be “learning from this experience as well as from the report” in private, because Brennan pointedly didn’t respond to Schakowsky’s question about releasing the document publicly.

John Brennan Says All the Bad Reports about CIA Are Inaccurate

Kudos to Jan Schakowsky, who used today’s hearing on global threats to ask John Brennan some of the questions he so rarely gets asked.

She started by asking him generally about drones and his previous public comments about them. He responded by noting that he was a White House figure then, now he’s CIA Director (implying, I guess, that he shouldn’t be held to his previous comments).

She then asked specifically about Jonathan Landay’s reporting on the drone strikes — which, as you’ll recall, is reported directly from intelligence reports on drone strikes. Brennan responded, “A lot of things in press are reported inaccurately, in my opinion.” (Mind you, Landay’s reports did give Brennan an excuse for having lied so blatantly about civilian casualties in the past, so I guess his reporting is inaccurate, even though it helps Brennan!)

Schakowsky then asked about the difference between targeted and signature strikes. Brennan pointed back to the earlier dog and pony show on drones, which pretended signature strikes didn’t exist.

Schakowsky then asked for an update on the torture report. Brennan revealed he had spoken with Dianne Feinstein and Saxby Chambliss earlier this week. He told them he was in the process of reviewing the report (keep in mind, the original response to SSCI was due February 15, almost two months ago) and was doing a “thorough” review of some things he believed the committee did not report accurately.

If you’re John Brennan, if internal reports on drones make the CIA look bad, and if internal reports on torture make the CIA look bad, they are by definition inaccurate.
