The NYT “Scoop” Appears To Be an Effort to Spin Opening an Investigation into Trump as an Erratic Act

I’d like to point out something strongly suggested by the stories based on gossiping about Andrew McCabe memos. These stories portray what people not at a meeting that took place just after Comey’s firing think happened at the meeting based off hearing about memos memorializing them. From the WaPo’s far more responsible version of the story, we know that Lisa Page was also present at the meeting.

Another official at the meeting, then-FBI lawyer Lisa Page, wrote her own memo of the discussion which does not mention any talk of the 25th amendment, according to a second person who was familiar with her account.

And the WaPo’s version of the “wire” comment puts it in context, making it clear that Rosenstein was questioning how they could investigate the President.

That person said the wire comment came in response to McCabe’s own pushing for the Justice Department to open an investigation into the president. To that, Rosenstein responded with what this person described as a sarcastic comment along the lines of, “What do you want to do, Andy, wire the president?”

Now go back to earlier in the week, to the frothy right rehashing some texts Page and Peter Strzok sent, talking about opening an investigation into … someone, while Andrew McCabe was Acting Director. (Apologies for the Fox slurs about Page and Strzok.)

Text messages from disgraced FBI figures Peter Strzok and Lisa Page, discussing whether to open a “case” in a “formal chargeable way” after Director James Comey was fired, are under fresh scrutiny after Page told congressional investigators there was no evidence of Russian collusion at the time, according to three congressional sources.

Two hours after Comey’s termination became public on May 9, 2017, Strzok, a now-former FBI agent, texted Page, his then-colleague and lover: “We need to open the case we’ve been waiting on now while Andy is acting.”

“Andy” is a reference to then-Deputy Director Andrew McCabe who temporarily took over the bureau until Christopher Wray was confirmed as director in August 2017.

Page, a former FBI attorney, replied to Strzok: “We need to lock in (redacted). In a formal chargeable way. Soon.”

Strzok concurred. “I agree. I’ve been pushing and I’ll reemphasize with Bill,” believed to be Bill Priestap, the head of the FBI’s counterintelligence division.

Finally, here’s the WaPo version of Michael Bromwich’s description of the memos.

McCabe’s lawyer, Michael Bromwich, said in a statement that his client “drafted memos to memorialize significant discussions he had with high level officials and preserved them so he would have an accurate, contemporaneous record of those discussions. When he was interviewed by the special counsel more than a year ago, he gave all of his memos — classified and unclassified — to the special counsel’s office. A set of those memos remained at the FBI at the time of his departure in late January 2018. He has no knowledge of how any member of the media obtained those memos.”

These are “significant memos” and went right to Mueller when he was appointed. The kind of memos that might back investigative decisions, such as whether to open an investigation into the President.

So what the NYT spin of the story is about is suggesting that at the moment when DOJ opened an investigation into the President, the guy who opened it was “acting erratically.” Presumably based off the third-hand opinions of people like Jim Jordan, who knows a bit about acting erratically. It’s also about whether a discussion of removing the President took place at the same meeting where a discussion of investigating him did.

Likely, the messages are muddled, because they always are when getting laundered through Jim Jordan’s feverish little mind.

Update: NYT has now updated their story with two details designed to rebut the more responsible reporting of other outlets. First, they cite their sources claiming — without having to explain — that Rosenstein spoke about recording the President on another occasion, with the suggestion that that time it wan’t sarcastic.

Mr. Rosenstein also mentioned the possibility of wearing a wire on at least one other occasion, the people said, though they did not provide details.

More remarkably, they include a paragraph that reveals their original story was inaccurate as to timing. To rebut WaPo’s report that Lisa Page’s version of events don’t include the reference to the 25th Amendment, the NYT has now decided there were “at least two meetings that took place on May 16” (but note the knowledge of their sources all appears to come from memos, not from witnessing the events).

At least two meetings took place on May 16 involving both Mr. McCabe and Mr. Rosenstein, the people familiar with the events of the day said. Mr. Rosenstein brought up the 25th Amendment during the first meeting of Justice Department officials, they said. He did not appear to talk about it at the second, according to a memo by one participant, Lisa Page, a lawyer who worked for Mr. McCabe at the time, that did not mention the topic.

Well, okay, maybe that’s true. But that utterly demolishes some key premises of the story as originally written. The story collapses the timing of all this, emphasizing that it happened just two weeks into the job.

Mr. Rosenstein was just two weeks into his job. He had begun overseeing the Russia investigation and played a key role in the president’s dismissal of Mr. Comey by writing a memo critical of his handling of the Hillary Clinton email investigation. But Mr. Rosenstein was caught off guard when Mr. Trump cited the memo in the firing, and he began telling people that hefeared he had been used.

The president informed them of his plan to oust Mr. Comey. To the surprise of White House aides who were trying to talk the president out of it, Mr. Rosenstein embraced the idea, even offering to write the memo about the Clinton email inquiry. He turned it in shortly after.

A day later, Mr. Trump announced the firing, and White House aides released Mr. Rosenstein’s memo, labeling it the basis for Mr. Comey’s dismissal. Democrats sharply criticized Mr. Rosenstein, accusing him of helping to create a cover story for the president to rationalize the termination. [my emphasis]

All this suggests the response was a direct response to the Comey firing.

And while the story does note the meetings take place a week later, the update emphasizes the actual date.

A determined Mr. Rosenstein began telling associates that he would ultimately be “vindicated” for his role in the matter. One week after the firing, Mr. Rosenstein met with Mr. McCabe and at least four other senior Justice Department officials, in part to explain his role in the situation. [my emphasis]

The “wire the president” comment (and the 25th Amendment one, if it did happen as described) took place on May 16, almost a week later.

In this update, the NYT also took out language about Rosenstein wondering about motive.

wondered whether Mr. Trump had motives beyond Mr. Comey’s treatment of Mrs. Clinton for ousting him, the people said.

By May 16, of course, Rosenstein wouldn’t have to wonder about Trump’s motives, because he had already gone on TV and explained what his motive was — it was to end the Russia investigation.

More troublingly, he had taken a meeting with Sergei Lavrov and Sergei Kislyak — the latter of whom was a key figure in any conspiracy investigation — without American press present at which he shared highly sensitive Israeli secrets. While the public didn’t know it yet, at the meeting Trump also said he fired Comey to ease the pressure on him.

More importantly, if there were two meetings — one on whether Trump was handling the FBI hiring properly, and one on whether to open an investigation into the President — then it means those different topics have a different meaning. One meeting was about whether Trump was capable of doing the job, the other was about whether he had broken the law.

Anyway, what we’re not getting is any real understanding of the real context of these comments.

Devin Nunes’ Promise of Shock!! Shock!! in the Evolving Steele Claims in the Fourth Carter Page FISA Application

As I laid out a few weeks ago, I provided information to the FBI on issues related to the Mueller investigation, so I’m going to include disclosure statements on Mueller investigation posts from here on out. I will include the disclosure whether or not the stuff I shared with the FBI pertains to the subject of the post.

Devin Nunes and the right wing press corps (Catherine HerridgeByron York, Chuck Ross) have now made it clear where Nunes’ games to discredit the Mueller investigation goes next: to claiming that a portion of the Carter Page FISA application say “shocking” things about Christopher Steele and the FBI. That’s based on a letter the House Intelligence Republicans signed inviting President Trump to “declassify and release publicly, and in unredacted form, pages 10-12 and 17-34, along with all associated footnotes, of the third renewal of the FISA application on Mr. Page. That renewal was filed in June 2017 and signed by Deputy Attorney General Rod Rosenstein.”

They’re playing a bit of a game with this, permitting right wing scribes to compare the first and the fourth application as if nothing (including applications signed by people not named Rod Rosenstein) came between.

So what is on pages 10-12 and 17-34? That is certainly a tantalizing clue dropped by the House Intel members, but it’s not clear what it means. Comparing the relevant sections from the initial FISA application, in October 2016, and the third renewal, in June 2017, much appears the same, but in pages 10-12 of the third renewal there is a slightly different headline — “The Russian Government’s Coordinated Efforts to Influence the 2016 U.S. Presidential Election” — plus a footnote, seven lines long, that was not in the original application.

As for pages 17-34, there appear to be, in the third renewal, new text and footnotes throughout the section headlined “Page’s Coordination with Russian Government Officials on 2016 U.S. Presidential Election Influence Activities.” (That is the same headline as the original application.) The Republican lawmakers ask that it be unredacted in its entirety, suggesting they don’t believe revealing it would compromise any FBI sources or methods.

Clearly, the GOP lawmakers believe pages 10-12 and 17-34 contain critical information, so it seems likely that the release of those pages would affect the current public debate over the FISA application

I guess, in this, they’re working a bit harder than Jim Jordan and Mark Meadows did in their Rosenstein impeachment effort.

As it happens, I’ve done a ridiculously anal 20 page analysis of the application (for the near future, I’m not going to be releasing any of my surveillance analysis publicly; for those interested, let me know separately), so I’ve tracked what changes in each application. So, for example, whereas York suggests that the title in the first section the Republicans want declassified changed in the fourth application, it actually changed in the second, submitted in early January 2017. Here’s how that title looks in each of the four applications, in order (see PDF 8, 93, 191, and 301 for the start of this section in each application).

It’s pretty clear the changes in this section stem in part from a shift to the past tense and an understanding of the extent of Russian interference.

Similarly, while York points to a footnote in the fourth application he claims doesn’t appear in the first, a footnote of similar length, though not the same shape (suggesting slightly different wording) appears in the third application. Here’s how footnote 4 looks in those two applications.

Otherwise, the discussion in applications three and four in this section appears the same. Which is to say that Republicans are trying to suggest this “shocking!!!” content derives from Rosenstein, when in fact much of it was probably approved by Dana Boente. It turns out Nunes’ efforts to discredit Rosenstein are barely more rigorous than Meadows’.

The second section Republicans want selectively declassified pertains to Steele. And there, there are significant changes to the application over the course of the four applications, second only to section where the most changes get made over the course of the four applications, the entirely redacted Section VI (it grows from 3 pages in the first application to 23 in the fourth). The Steele section grows from 7 pages in the first application to 11 in the last, with changes in each application and substantial changes in the last two. Here are all the sections that are new in the fourth, the one the Republicans want declassified:

As a measure of how inattentive the right wing story line is, Byron claims in follow-up reporting that DOJ never told FISC about Steele’s reaction to Jim Comey’s reopening of the Hillary investigation, in spite of unclassified language in footnote 22 (as numbered in the fourth application, though it was added in the second) revealing that,

In or about late October 2016, however, after the FBI Director sent a letter to the U.S. Congress, which stated that the FBI had learned of new information that might be pertinent to an investigation that the FBI was conducting of Candidate #2, Source #1 told the FBI that he/she was frustrated with this action and believed it would likely influence the 2016 U.S. Presidential election. In response to Source #1’s concerns, Source #1 independently, and against the prior admonishment from the FBI to speak only with the FBI on this matter, released the reporting discussed herein to an identified news organization. Although the FBI continues to assess Source #1’s reporting is reliable, as noted above, the FBI closed Source #1 as an active source. (PDF 320)

Byron appears not to understand that Steele’s response to Comey’s actions on October 28 could not have added bias to his reporting from prior to that date, which is when all of his reports shared formally with the FBI date to (the one other report, dated December 13, was only shared informally).

Whatever the additional caveats on Steele that Nunes is so sure will shock! shock!! the press when all his past predictions of shock have fallen flat, the Minority apparently disagrees. That’s because the Schiff Memo cites precisely the passage that Nunes is so sure will shock us for the following claims:

How odd that the Majority didn’t fight to have these passages, which derive from the passage they claim is so critical to have declassified, declassified in the Schiff Memo (not that I totally buy the Schiff memo on this point either: he claims that Page’s meeting with other key Russians, not the ones Steele described him meeting with, corroborate Steele’s reporting when it doesn’t). Similarly, the Majority also doesn’t want the passages of the fourth application that support this claim to be declassified.

For what it’s worth, a Republican who has reviewed these things told me last week that there was abundant evidence to support the surveillance on Page. So mostly this is just an attempt to beat up the Democrats for the Steele dossier; honest Republicans agree that Page was a legitimate surveillance target.

This is something the right wing press corps is struggling with (the cognitive dissonance among people like Ross would be palpable if logic were a requirement in his work) as much as the left wing, however. It appears increasingly likely that Steele was fed disinformation as a way to confuse the Democrats and ensure any investigation would look at marginal dolts like Page rather than centrally important dolts like Don Jr. I’ll even present a new factoid about how that may have happened in a follow-up.

That doesn’t mean that when the FBI relied on Steele, using the same measure they use for all consultants (past track record), they had reason to know it was disinformation. Rather, it’s yet another indication that Russia was really really intent on making sure it could get Trump elected, via whatever deceit.

But that doesn’t help the GOP claim that Trump isn’t thereby implicated.

The Worm Turns: Neither Devin Nunes Nor Ron DeSantis (Thus Far) Support Jim Jordan’s Impeachment Bid

As I laid out a few weeks ago, I provided information to the FBI on issues related to the Mueller investigation, so I’m going to include disclosure statements on Mueller investigation posts from here on out. I will include the disclosure whether or not the stuff I shared with the FBI pertains to the subject of the post.

I was in DC when Mark Meadows and Jim Jordan rolled out articles of impeachment against Rod Rosenstein. As a number of people have noted, the articles themselves are batshit crazy, calling over-redaction subsequently corrected a high crime and misdemeanor.

And some of the articles would require a time machine to prove, such as holding Rosenstein responsible for a FISA application submitted when he was merely the US Attorney for MD with no role in the investigation.

But something else is even more interesting to me.

The original press release included the names of 6 congressmen, in addition to Mark Meadows and Jim Jordan, who co-sponsored the articles HR 1028:

  1. Mark Meadows
  2. Jim Jordan
  3. Andy Biggs
  4. Scott Perry
  5. Paul “Dentists Read Body Language” Gosar
  6. Jody Hice
  7. Matt Gaetz
  8. Scott DesJarlais

And while the other three congressmen who joined as co-sponsors seemed a lot more sheepish about signing on, the following me also joined:

  1. John Duncan
  2. Louie Gohmert
  3. Bill Posey

By mid-morning yesterday, in the face of opposition from Paul Ryan and citing some deal with Bob Goodlatte, Meadows and Jordan admitted defeat. Shortly thereafter, Jordan announced a bid to be Speaker, with support from Meadows.

Apparently this morning, the following men signed on:

  1. Tom Massie
  2. Ted Yoho
  3. Ralph Norman
  4. Duncan Hunter

We’re two days into this effort, and thus far, two names are conspicuously absent: Devin Nunes (who has admittedly refrained from officially participating in some of the batshittery to — apparently — limit his legal exposure) and Ron DeSantis, who has spent the last seven months leading efforts to discredit Mueller’s investigation.

While I was in DC, a Republican admitted to me that this was just about ginning up votes and predicted that the House is done meeting until November — meaning Rosenstein should be safe from Congressional tampering until then.

If so, DeSantis’ non-participation in this stunt is telling. He’s running for governor with the vocal support of President Trump.

Indeed, DeSantis currently has a healthy lead against Adam Putnam in the GOP primary, with the primary date a month away, August 28, largely due to Trump’s support.

DeSantis is also one of the people who most obviously benefitted from Russian interference in 2016.

That Ron DeSantis has not (yet) signed onto this stunt suggests he’s not sure that, in a month (or perhaps in three, in the general), having done so will benefit his electoral chances to be governor.

So apparently Jim Jordan (facing sexual assault cover-up charges) and Duncan Hunter (facing even more serious legal troubles) think it’s a smart idea to go all-in on supporting Trump. But Ron DeSantis does not.

Steve King Just Voted to Subject Americans to “Worse than Watergate”

Devin Nunes has launched the next installment of his effort to undercut the Mueller investigation, a “Top Secret” four page report based on his staffers’ review of all the investigative files they got to see back on January 5. He then showed it to a bunch of hack Republicans, who ran to the right wing press to give alarmist quotes about the report (few, if any, have seen the underlying FBI materials).

Mark Meadows (who recently called for Jeff Sessions’ firing as part of this obstruction effort) said, “Part of me wishes that I didn’t read it because I don’t want to believe that those kinds of things could be happening in this country that I call home and love so much.”

Matt Gaetz (who strategized with Trump on how to undercut the Mueller investigation on a recent flight on Air Force One) said, “The facts contained in this memo are jaw-dropping and demand full transparency. There is no higher priority than the release of this information to preserve our democracy.”

Ron DeSantis (who joined Gaetz in that Air Force One strategy session with Trump and also benefitted directly from documents stolen by the Russians) said it was “deeply troubling and raises serious questions about the [the people in the] upper echelon of the Obama DOJ and Comey FBI,” who of course largely remain in place in the Sessions DOJ and Wray FBI.

Steve King claimed what he saw was, “worse than Watergate.” “Is this happening in America or is this the KGB?” Scott Perry said. Jim Jordan (who joined in Meadows’ effort to fire Sessions) said, “It is so alarming.” Lee Zeldin said the FBI, in using FISA orders against Russians and facilities used by suspected agents of Russia was relying “on bad sources & methods.”

It all makes for very good theater. But not a single one of these alarmists voted the way you’d expect on last week’s 702 reauthorization votes if they were really gravely concerned about the power of the FBI to spy on Americans.

Indeed, Gaetz, DeSantis, and King — three of those squawking the loudest — voted to give the same FBI they’re claiming is rife with abuse more power to spy on Americans, including political dissidents. Nunes, who wrote this alarming report, also wrote the bill to expand the power of the FBI he’s now pretending is badly abusive.

Even those who voted in favor of the Amash-Lofgren amendment and against final reauthorization — Meadows, Jordan, and Perry, among some of those engaging in this political stunt — voted against the Democratic motion to recommit, which would have at least bought more time and minimally improved the underlying bill (Justin Amash and Tom Massie, both real libertarians, voted with Democrats on the motion to recommit). Zeldin was among those who flipped his vote, backing the bill that will give the FBI more power after making a show of supporting Amash’s far better bill.

In short, not a single one of these men screaming about abuse at the FBI did everything they could do to prevent the FBI from getting more power.

Which — if you didn’t already need proof — shows what a hack stunt this is.

2nd Circuit Decision Striking Down Dragnet Should Require Tighter “Specific Selection Term” Language in USA F-ReDux 

The 2nd Circuit just ruled that the phone dragnet was not authorized by Section 215. The language in the opinion on DOJ’s misinterpretation of “relevant to” ought to lead Congress to tighten the definition of “Specific Selection Term” in the bill to better comply with the opinion.

USA F-ReDux: Chaining on “Session Identifying Information” that Is Not Call Detail Records

Some months ago, Bob Litt emphasized USA Freedom would only work if the telecoms retained enough data for pattern analysis (which may or may not back my worry the government plans to outsource such pattern analysis to the telecoms). Nevertheless, no one seems to want to discuss whether and if so how USA F-ReDux will ensure providers do keep data. Except Dianne Feinstein, who today once again suggested there is a kind of “data handshake” whereby the telecoms will retain our data without being forced.

Unlike the Existing Phone Dragnet, USA F-ReDux Does Not Include “Telephony” in Its Definition of Call Detail Record 

The definition of Call Detail Record that will be adopted under USA F-ReDux is closely related to the definition currently used in the phone dragnet — though the USA F-ReDux does not require CDRs to be comprehensive records of calls as the existing phone dragnet does. Nine Members of Congress Vote to Postpone the Fourth Amendment

John Conyers, Jim Sensenbrenner, Darrell Issa, Steve Cohen, Jerry Nadler, Sheila Jackson Lee, Trey Gowdy,  John Ratcliffe, Bob Goodlatte all voted to postpone the Fourth Amendment today.

At issue was Ted Poe’s amendment to the USA Freedom Act (USA F-ReDux; see the debate starting around 1:15), which prohibited warrantless back door searches and requiring companies from inserting technical back doors.

One after another House Judiciary Committee member claimed to support the amendment and, it seems, agreed that back door searches violate the Fourth Amendment. Though the claims of support from John Ratcliffe, who confessed to using back door searches as a US Attorney, and Bob Goodlatte, who voted against the Massie-Lofgren amendment last year, are suspect. But all of them claimed they needed to vote against the amendment to ensure the USA Freedom Act itself passed.

That judgment may or may not be correct, but it’s a fairly remarkable claim. Not because — in the case of people like Jerry Nader and John Conyers — there’s any question about their support for the Fourth Amendment. But because the committee in charge of guarding the Constitution could not do so because the Intelligence Committee had the sway to override their influence. That was a point made, at length, by both Jim Jordan and Ted Poe, with the latter introducing the point that those in support of the amendment but voting against it had basically agreed to postpone the Fourth Amendment until Section 702 reauthorization in 2017.

(1:37) Jordan: A vote for this amendment is not a vote to kill the bill. It’s not a vote for a poison pill. It’s not a vote to blow up the deal. It’s a vote for the Fourth Amendment. Plain and simple. All the Gentleman says in his amendment is, if you’re going to get information from an American citizen, you need a warrant. Imagine that? Consistent with the Fourth Amendment. And if this committee, the Judiciary Committee, the committee most responsible for protecting the Bill of Rights and the Constitution and fundamental liberties, if we can’t support this amendment, I just don’t see I it. I get all the arguments that you’re making, and they’re all good and the process and everything else but only in Congress does that trump — I mean, that should never trump the Fourth Amendment.

(1:49) Poe; We are it. The Judiciary Committee is it. We are the ones that are protecting or are supposed to protect, and I think we do, that Constitution that we have. And we’re not talking about postponing an Appropriations amount of money. We’re not talking about postponing building a bridge. We’re talking about postponing the Fourth Amendment — and letting it apply to American citizens — for at least two years. This is our opportunity. If the politics says that the Intel Committee — this amendment may be so important to them that they don’t like it they’ll kill the deal then maybe we need to reevaluate our position in that we ought to push forward for this amendment. Because it’s a constitutional protection that we demand occur for American citizens and we want it now. Not postpone it down the road to live to fight another day. I’ve heard that phrase so long in this Congress, for the last 10 years, live to fight another day, let’s kick the can down the road. You know? I think we have to do what we are supposed to do as a Committee. And most of the members of the Committee support this idea, they agree with the Fourth Amendment, that it ought to apply to American citizens under these circumstances. The Federal government is intrusive and abusive, trying to tell companies that they want to get information and the back door comments that Ms. Lofgren has talked about. We can prevent that. I think we should support the amendment and then we should fight to keep this in the legislation and bring the legislation to the floor and let the Intel Committee vote against the Fourth Amendment if that’s what they really want to do. And as far as leadership goes I think we ought to just bring it to the floor. Politely make sure that the law, the Constitution, trumps politics. Or we can let politics trump the Constitution. That’s really the decision.

Nevertheless, only Louie Gohmert, Raul Labrador, Zoe Lofgren, Suzan DelBene, Hakeem Jeffries, David Cicilline, and one other Congressman–possibly Farenthold–supported the amendment.

The committee purportedly overseeing the Intelligence Community and ensuring it doesn’t violate the Constitution has instead dictated to the committee that guards the Constitution it won’t be permitted to do its job.
