Benghazi Talking Points: Petraeus’ Revenge

It has taken three days for the bleating press corps in DC to wade through the roll-out of Benghazi talking point emails and realize that the tension behind the emails — as has been clear from just days after the attack — is that Benghazi was really a CIA, not a State, Mission, and therefore CIA bears responsibility for many of the security lapses. So State, in making changes to the emails, was making sure it didn’t get all the blame for CIA’s failures.

David Corn describes it this way.

The revisions—which deleted several lines noting that the CIA months before the attack had produced intelligence reports on the threat of Al Qaeda-linked extremists in Benghazi—appear to have been driven by State Department spokesperson Victoria Nuland, who, it should be noted, is a career Foggy Bottomer who has served Republican and Democratic administrations [ed: including Dick Cheney], not a political appointee. Her motive seems obvious: fend off a CIA CYA move that could make the State Department look lousy.

Yet it’s only now, several days into this frenzy, that some reporters are coming to report this.

And they’re still not noting ways in which the CIA’s initial emails were self-serving. For example, when the CIA said,

Since April, there have been at least five other attacks against foreign interests in Benghazi by unidentified assailants, including the June attack against the British Ambassador’s convoy. We cannot rule out the individuals has [sic] previously surveilled the U.S. facilities, also contributing to the efficacy of the attacks.

They might have also said, “since February, people tied to CIA’s mission have twice been harassed by militia members, suggesting our OpSec was so bad they knew we were in Benghazi.”

And when CIA’s talking points said,

The crowd almost certainly was a mix of individuals from across many sectors of Libyan society. That being said, we do know that extremists with ties to al-Qa’ida participated in the attack.

They might also have said that the “trusted” militia, February 17 Brigade, trained by David Petraeus’ CIA, whose career legacy is based on false claims of successfully training locals, appears to have allowed the attack to happen (and, critically, delayed CIA guards from heading to the State mission to help).

Note that Congressman Frank Wolf is just now showing some interest in why CIA’s vetting of the militia central to the mission’s defense was so bad. Maybe if CIA had included that detail in their self-serving initial talking points, Congress would have turned to this issue more quickly, particularly since we’re currently training more potentially suspect militias in Syria.

In other words, the story CIA — which had fucked up in big ways — wanted to tell was that it had warned State and State had done nothing in response (which, perhaps unsurprisingly, is precisely the story Darrell Issa and Jason Chaffetz are trying to tell). The truthful story would have been (in part) that CIA had botched the militia scene in Benghazi, and that had gotten the Ambassador killed.

Yet that appears to be just the half of the self-serving function this email release has had for CIA.

The Blame Game Begins: Who Will Be Held Responsible for Creating the Afghan “Vertically Integrated Criminal” Government?

Last Sunday, the Beltway professed to be shocked — shocked!! — that the CIA has been bribing Hamid Karzai for years.

Moreover, there is little evidence that the payments bought the influence the C.I.A. sought. Instead, some American officials said, the cash has fueled corruption and empowered warlords, undermining Washington’s exit strategy from Afghanistan.

“The biggest source of corruption in Afghanistan,” one American official said, “was the United States.”

Fred Kaplan, author of a fawning David Petraeus biography, described how Petraeus tried to fix that corruption but was stymied by practicality.

Petraeus was impressed with their analysis but found their proposals impractical. First, he couldn’t simply bypass Karzai. One of his strategic goals was to help stabilize Afghanistan. Overhauling the districts’ governing boards and transferring power to new officials—who may themselves just be a new array of warlords—was hardly a recipe for stability. Second, the plan would undermine another strategic goal—protecting the Afghan population. The local officials who were taking bribes and extorting merchants were also helping out with local security, sometimes guarding convoys of NATO supply trucks. If the cash spigot were shut off, they might let the Taliban attack those trucks, maybe even join in.

Then Sarah Chayes, one of the civilian advisors who fought against Afghan corruption in the transition period from Stanley McChrystal to Petraeus, wrote an account of what Petraeus really did.

Our PowerPoint presentation spelling out this plan ran to more than 40 slides. We selected a dozen we really planned to brief, but at a meeting with the entire command staff, General Petraeus read through every one. With a calculated flourish, he marked a check on each page as he turned it over. Petraeus was on board.

But when he stood up to address the assembled brass, Petraeus seemed to skip past — or even argue against — the slides we had prepared explaining the new governance approach. We were stunned. What had happened? Had we misunderstood? Had he changed his mind?

For another month, we kept at it; I hammered out a detailed implementation of our general concept to be employed in Kandahar province, alongside the troop surge. But by mid-September 2010, it was clear to me that Petraeus had no intention of implementing it, or of pursuing any substantive anti-corruption initiative at all. Four months later, in an intense interagency struggle over the language of a document spelling out objectives for Afghanistan by 2015, the U.S. government, at the cabinet level, explicitly reached the same decision.

That was the moment I understood the Afghanistan mission could not succeed.

Like Kagan, Chayes ultimately blames CIA. But she does so, specifically, in the context of the attempted July 2010 arrest of the CIA’s bagman, Muhammad Zia Salehi.

I spent weeks wracking my brain, trying to account for the about-face. Eventually, after a glance in my calendar to confirm the dates, it came to me. It was the Salehi arrest. The Salehi arrest had changed everything.

Throughout the unfolding investigation, two senior U.S. officials have told me, through Salehi’s arrest and release after a few hours of police detention, CIA personnel never mentioned their relationship with him. Even afterwards, despite pressure in Kabul and Washington, the CIA refused to provide the ambassador or the key cabinet officials a list of Afghans they were paying. The CIA station chief in Kabul continued to hold private meetings with Karzai, with no other U.S. officials present.

So whom did Salehi call from his jail cell the afternoon of his arrest? Was it Karzai, as many presumed at the time? Or was it the CIA station chief?

However lethal our bribes to Karzai have been to our so-called strategy in Afghanistan (though I wonder: have they simply forestalled an all-out civil war?), he’s still going to proudly receive the cash.

“Yes, we received cash from the CIA for the past 10 years. It was very useful, and we are very thankful for this aid,” the president said during a news conference Saturday in Kabul.

“Yesterday, I thanked the CIA’s chief in Kabul and I requested their continued help, and they promised that they will continue.”

If all this sounds vaguely familiar, it should.

That’s because much of this dispute played out in reporting at the time. After NYT first reported CIA’s ties to Salehi a month after the attempted arrest in 2010 — and quoted one official saying “Fighting corruption is the very definition of mission creep” — the WaPo reported more anonymous sources almost boasting of the bribes (and reminding they went back to the mujahadeen era). CIA Bags O’ Cash Total Tens of Millions of Dollars, But Over $4.5 Billion Left Afghanistan in 2011

Today’s New York Times carries a frank exposure of blatant moves by the CIA to curry favor with Hamid Karzai and high ranking members of Afghanistan’s government through direct cash payments brazenly dropped off at Karzai’s office:

For more than a decade, wads of American dollars packed into suitcases, backpacks and, on occasion, plastic shopping bags have been dropped off every month or so at the offices of Afghanistan’s president — courtesy of the Central Intelligence Agency.

All told, tens of millions of dollars have flowed from the C.I.A. to the office of President Hamid Karzai, according to current and former advisers to the Afghan leader.

Perhaps the most disturbing aspect of these cash payments is that they seem to have been designed in large part to pay off Afghan warlords:

Moreover, there is little evidence that the payments bought the influence the C.I.A. sought. Instead, some American officials said, the cash has fueled corruption and empowered warlords, undermining Washington’s exit strategy from Afghanistan.

And it’s not just any warlords who are being funded by this cash. We learn in the article that the current corruption pay for Rashid Dostum, who committed the largest single war crime in the Afghan war, is now $80,000 per month.

And in the funding of warlords, keep in mind that they form the backbone of David Petraeus’ Afghan Death Squads Local Police under the “direction” of US special operation forces and the CIA. After particularly egregious behavior by one of these groups earlier this year, Karzai first expelled US special forces from Maidan Wardak province and then eventually backed off somewhat on that move. Today’s article suggests that Karzai is trying to play a major role in controlling these groups. Given the main topic of the article, we are left to presume that Karzai’s control is through the allocation of these CIA funds:

Now, Mr. Karzai is seeking control over the Afghan militias raised by the C.I.A. to target operatives of Al Qaeda and insurgent commanders, potentially upending a critical part of the Obama administration’s plans for fighting militants as conventional military forces pull back this year.

Although an off the books cash influence-buying program that has totaled tens of millions of dollars over the course of a decade sounds like a huge scandal, this is chump change compared to the real theft of US funds in Afghanistan. The Special Inspector General for Afghanistan Reconstruction noted in the January, 2013 report (pdf) that huge sums of cash exit Afghanistan through the Kabul airport:

The U.S. government has long had serious concerns about the flow of cash out of the Kabul International Airport. According to the Congressional Research Service, some $4.5 billion was taken out of Afghanistan in 2011.

Where does all this cash come from? The largest flow of money into Afghanistan of course comes from the US and the biggest program we fund there supports Afghan security forces:

The Congress created the Afghanistan Security Forces Fund (ASFF) to provide the ANSF with equipment, supplies, services, and training, as well as facility and infrastructure repair, renovation, and construction.

John Brennan’s Review of How He Killed an American Teenager

Jeremy Scahill’s book, Dirty Wars, comes out tomorrow. I’m sure I’ll have more to say about it over the next few weeks.

But for now, he’s got an adaptation at the Nation that describes a Senior Administration Official involved in drone targeting, who would have left sometime between October 14, 2011 and now (so, maybe Petraeus, Panetta, Clinton, or Vietor?? Update: Or Jeh Johnson?), claiming that the strike was all a mistake, launched in response to apparently crappy intelligence from Ali Abdullah Saleh’s government (or possibly the Saudis?) claiming that senior AQAP leader Ibrahim al-Banna was present, alone.

A former senior official in the Obama administration told me that after Abdulrahman’s killing, the president was “surprised and upset and wanted an explanation.” The former official, who worked on the targeted killing program, said that according to intelligence and Special Operations officials, the target of the strike was al-Banna, the AQAP propagandist. “We had no idea the kid was there. We were told al-Banna was alone,” the former official told me. Once it became clear that the teenager had been killed, he added, military and intelligence officials asserted, “It was a mistake, a bad mistake.”

The now-former SAO goes on to describe how pissed the Moral Rectitude Drone Assassination Czar John Brennan was about the strike, because he believed Abdulrahman was deliberately set up to be killed (though Scahill’s source doesn’t appear to specify whom Brennan thought was setting up an American teenager for death, JSOC, Yemeni partners, or the Saudis).

However, John Brennan, at the time President Obama’s senior adviser on counterterrorism and homeland security, “suspected that the kid had been killed intentionally and ordered a review. I don’t know what happened with the review.”

So Brennan sets up a review … that apparently got stashed in the same black hole as every other report on drone killing.

Because the whole thing is embarrassing.

Brennan, who is now director of the CIA, recently answered an inquiry from the Senate Intelligence Committee on such after-strike reviews. When civilians are killed, Brennan said, “we not only take account of the human tragedy, but we also go back and review our actions.” Analysts “draw on a large body of information—human intelligence, signals intelligence, media reports, and surveillance footage—to help us make an informed determination about whether civilians were in fact killed or injured,” Brennan asserted in his written response. “In those rare instances in which civilians have been killed, after-action reviews have been conducted.” No such review of Abdulrahman’s killing has ever been made public.

The consensus that has emerged from various anonymous officials commenting on Abdulrahman’s killing was that it was a mistake. I asked the former senior administration official why, if that was the case, the White House didn’t publicly acknowledge it. “We killed three US citizens in a very short period,” he told me. “Two of them weren’t even targets: Samir Khan and Abdulrahman Awlaki. That doesn’t look good. It’s embarrassing.”

Recall, when JSOC killed almost an entire Bedouin clan in al-Majala, David Petraeus claimed that only the alleged targets immediate family had been killed, well after people had been to the site to document the carnage. Immediately after Abdulrahman’s death, the Administration immediately, almost boisterously, claimed the boy was 21, either based on crappy intelligence or in an attempt to justify a “military aged male” claim.

This is why it is so important to declassify the documents on targeted killing. Even according to the Moral Rectitude Drone Assassination Czar, this kid was set up.

He just won’t tell us by whom.

Is the Government Going to Claim Bradley Manning “Harmed” the US by Exposing Drone Details?

Screen shot 2013-04-17 at 9.46.44 PMLast week’s Bradley Manning hearing significantly focused on how much the government could hide about its witnesses. A big part of the discussion pertained to how a Seal Team 6 member would testify to finding WikiLeaks material at Osama bin Laden’s compound. But the government also advanced its case to have a list of other government employees testify, at least partly, in secret, mostly in the “harm” phase of sentencing.

Here’s Alexa O’Brien’s transcription of that list (click through for the list). There are a number of interesting names on this list. But the one that popped out at me is Ambassador Stephen Seche.

You see, while Seche was Chargé d’Affaires in Syria mid-decade and more recently was in charge of Near Eastern affairs at State, he will almost certainly testify about how WikiLeaks disclosures of cables he wrote while Ambassador to Yemen “harmed” relations with that country.

Indeed, as the image above shows, Seche wrote one of the most newsworthy cables ever released by WikiLeaks, the January 4, 2010 cable recounting a January 2 meeting between then CentCom head David Petraeus and Yemeni President Ali Abdullah Saleh.

The cable is best known for this statement, laying out the agreement by which Saleh would lie about missile and drone strikes and pretend they were Yemen’s.

“We’ll continue saying the bombs are ours, not yours,” Saleh said, prompting Deputy Prime Minister Alimi to joke that he had just “lied” by telling Parliament that the bombs in Arhab, Abyan, and Shebwa were American-made but deployed by the ROYG.

But there are several other inflammatory details in this cable. There’s the nugget of our agreement to shift from using cruise missiles to drones.

Saleh did not have any objection, however, to General Petraeus’ proposal to move away from the use of cruise missiles and instead have U.S. fixed-wing bombers circle outside Yemeni territory, “out of sight,” and engage AQAP targets when actionable intelligence became available.

Potentially more damning still, there’s the passage that suggests Anwar al-Awlaki was an intended target of the December 24, 2009 attack (a day before the US believed he was an operational and at least a month before it had evidence he was). In addition, there’s Petraeus’ absolutely incorrect contention that only three civilians had died at al-Majala instead of the Bedouin clan we know died.

(S/NF) Saleh praised the December 17 and 24 strikes against AQAP but said that “mistakes were made” in the killing of civilians in Abyan. The General responded that the only civilians killed were the wife and two children of an AQAP operative at the site, prompting Saleh to plunge into a lengthy and confusing aside with Deputy Prime Minister Alimi and Minister of Defense Ali regarding the number of terrorists versus civilians killed in the strike. (Comment: Saleh’s conversation on the civilian casualties suggests he has not been well briefed by his advisors on the strike in Abyan, a site that the ROYG has been unable to access to determine with any certainty the level of collateral damage. End Comment.) AQAP leader Nassr al-Wahishi and extremist cleric Anwar al-Awlaki may still be alive, Saleh said, but the December strikes had already caused al-Qaeda operatives to turn themselves in to authorities and residents in affected areas to deny refuge to al-Qaeda. [my emphasis]

At the very least, this passage demonstrates how shoddy our intelligence was both before and after we killed a bunch of civilians. But it may also support the case that the first time we tried to kill Awlaki, we didn’t believe he met the standards laid out in the memo that would ultimately authorize his killing: being a senior operational leader of AQAP involved in planning attacks against the US.

In other words, this cable, by itself, may include evidence of possible war and domestic crimes.

And yet the government wants to send Seche to a classified hearing to talk about the “harm” Bradley Manning caused.

While I think it possible that release of this particular cable made it harder for Djibouti to partner with us (recall we moved the drones targeting Awlaki to Saudi Arabia in 2011), the government at least maintains that Yemen continues to allow us to shoot drones in the country.

Yet it seems highly likely the government wants to claim disclosures of crimes like this amounted to “harm” of the US.

But here’s the punchline.

Washington Post Tries to Ram Petraeus Down Our Throats Again

No. In the name of God, Thor, Zeuss, Cthulhu and the Flying Spaghetti Monster, no. There are few people who personify the vapid, amoral fetid swamp of Washington politics and defense policy more than David Petraeus. Taking a huge part of the blame for propelling Petraeus from a solely military into an entirely political career is the Washington Post, which gave Petraeus a prime op-ed slot in September 2004, where he spewed wildly optimistic numbers on his accomplishments while training Iraqi troops. Petraeus further told us how victory was just around the corner, implying that if only Americans would re-elect George W. Bush, his plan would achieve full fruition. Active military personnel are not supposed to engage in politics, but Petraeus became political with that op-ed and Washington overlooked it, because that’s what Washington does and that’s what the Washington Post does.

Bush rewarded Petraeus for his role in the election by putting him in charge of US troops in Iraq. Petraeus didn’t impress his immediate superior, Admiral Fallon, who termed Petraeus an “ass-kissing little chickenshit” after their first meeting. Once in charge, Petraeus quickly established death squads. Things didn’t go all that well in Iraq, in part because everything Petraeus does fails miserably while he is busy explaining to us what a good job he is doing. By 2007, the Kagan brain-trust came up with the idea of the surge to “save” Iraq. Washington politics and defense policy prostitute Michael O’Hanlon was brought onto the job of helping to sell the surge. In the fall of 2007, an orchestrated  Washington event, complete with a sideshow purchased in the New York Times for the “General Betrayus” ad, gave us Congressional hearings that resulted in approval for the surge. Completely overlooked at that time was the inconvenient fact that a major part of the Iraq plan moving forward from that point involved a total restart of training Iraqi troops because Petraeus failed spectacularly in his previous attempt at training. But Washington and the Washington Post did not call out Petraeus for that failure, because that’s what Washington and the Washington Post do.

Petraeus was next promoted by Bush in late 2008 to Fallon’s previous position in charge of CentCom.  It was quite clear to Barack Obama once he took office that Petraeus had his sights set on becoming president, so Obama made a very interesting move when he sent Petraeus down in rank to take command in Afghanistan after Petraeus’ protege Stanley McChrystal was fired for insubordination in July of 2010. Because lying about training had worked in advancing his career in Iraq, it appears that fudging the numbers on ANSF capabilities was one of the first things Petraeus did once in charge in Afghanistan. He was caught in this by the GAO, who pointed out that criteria for ANSF readiness were being changed to increase the number of troops qualifying for the most advanced classification, but it appears that only SIGAR and I care about those lies. Washington and the Washington Post ignored those dishonest moves by Petraeus, because that’s what Washington and the Washington Post do.

After Petreaus had been in charge in Afghanistan for six months or so, political handlers stepped into the picture to try to burnish his image for a future run for president. Read more

The Perils of “Strategic Messaging”

The WSJ has a fascinating account of how President Obama’s efforts to extend our will without military intervention failed in Syria.

Early in the article, it describes that, as the Administration was debating intervening directly last summer, senior officials “misjudged” the situation because rebels “appeared” to be getting close to killing Bashar al-Assad.

Just as pressure to intervene grew last summer, White House officials were buoyed by a series of attacks where rebels appeared to be getting close to killing Mr. Assad. Several senior officials now acknowledge the U.S. misjudged how long Mr. Assad could hold on.

Many paragraphs later, the article elaborates on what caused this “misjudgment” about Assad’s resilience. It describes how in this period last summer, the Obama Administration was focused on post-Assad planning, rather than on getting rid of Assad, because the intelligence had “created a sense” that Assad would be ousted by the rebels acting alone.

The administration committee charged with Syria policy was kept on a tight leash by Mr. McDonough, then the deputy national security adviser and a close confidante to Mr. Obama, participants say. They said Mr. McDonough made clear that Mr. Obama wasn’t interested in proposals that could lead the U.S. down a slippery slope to military intervention; instead, he had the committee focus mostly on post-Assad planning.

“It was clear to all participants that this was what the White House wanted, as opposed to really focusing on key questions of how do you get to the post-Assad period,” one participant said.

Administration officials said one of the reasons the committee was told to focus on post-Assad planning was because intelligence at the time created “a sense” in the White House that Mr. Assad could be killed by rebels or his own people, eliminating the need for riskier measures to support the rebel campaign.

“Appeared to be getting close” … “created a sense.”

The article doesn’t say it explicitly, but either the intelligence the White House was getting about Syria was faulty, or the White House was reading into the intelligence what it wanted to hear (perhaps in their hopes that the “Obama Doctrine” would work better than Donald Rumsfeld’s fetish for a light footprint).

That passage on how problematic intelligence led the Administration to assume Assad’s downfall is almost immediately followed by the airing of a dispute about whether or not the Administration was also focused on “strategic messaging.”

Likewise, high-level White House national security meetings on Syria focused on what participants called “strategic messaging,” how administration policy should be presented to the public, according to current and former officials who took part in the meetings.

Another administration official disputed that account, saying there were multiple cabinet-level meetings “with extensive and rigorous analysis presented” and that he didn’t recall strategic messaging ever being a “central topic of discussion at senior levels.” [my emphasis]

I find it telling that WSJ so closely follows a description of some kind of problem with intelligence with the (disputed) suggestion that even as the Administration was acting on faulty intelligence, it was focusing on its own “strategic messaging.”

Go skim Moon of Alabama’s archive from last July. It’s a very good read not only of the abundant open source evidence Assad might not be ousted so easily (and if he was, the problems that would create), but also of how much western propaganda was spinning what was going on in Syria.

That’s the thing: much of what was being reported — in public western reports, at least — was propaganda. Perhaps Israeli, perhaps rebel, perhaps Turkish, perhaps American. But obviously propaganda.

Now, the article presents a different chronology: the Administration got faulty intelligence (or misread what it got), and in response moved onto spinning what they were doing in Syria.

But I can’t help but wonder whether the Administration fell for its own propaganda about what it was doing in Syria?

No SOFA? Then Transition Death Squad Control from Special Operations to CIA

A little over a year ago, Greg Miller outlined what he said would be the CIA’s roles in Iraq and Afghanistan in the near future.  It appears now that he was only half right:

The CIA is expected to maintain a large clandestine presence in Iraq and Afghanistan long after the departure of conventional U.S. troops as part of a plan by the Obama administration to rely on a combination of spies and Special Operations forces to protect U.S. interests in the two longtime war zones, U.S. officials said.

The withdrawal of U.S. forces from Iraq in December has moved the CIA’s emphasis there toward more traditional espionage — monitoring developments in the increasingly antagonistic government, seeking to suppress al-Qaeda’s affiliate in the country and countering the influence of Iran.

In Afghanistan, the CIA is expected to have a more aggressively operational role. U.S. officials said the agency’s paramilitary capabilities are seen as tools for keeping the Taliban off balance, protecting the government in Kabul and preserving access to Afghan airstrips that enable armed CIA drones to hunt al-Qaeda remnants in Pakistan.

Note that bit about the US withdrawing all of its troops from Iraq in December of 2011. The full withdrawal of course wasn’t what the US intended, but was a result of the botched negotiations for a Status of Forces Agreement that would confer immunity to US troops who remained behind in Iraq after the official “withdrawal”. A significant portion of those troops that would have been left behind would have been Special Operations Forces to train and control counterinsurgency militia groups. We were reminded just last week that these groups in Iraq were responsible for so many atrocities that they became known as death squads. As I pointed out, Petraeus’ counterinsurgency program in Afghanistan was built in the same way.

We have a report today in the Wall Street Journal that shows Miller’s prediction of “espionage only” for the CIA’s role in Iraq was wrong, as militias formerly trained and run by Special Operations Forces are now under CIA control (h/t to Joanne Leon for tweeting me a link to this article):

In a series of secret decisions from 2011 to late 2012, the White House directed the CIA to provide support to Iraq’s Counterterrorism Service, or CTS, a force that reports directly to Iraqi Prime Minister Nouri al-Maliki, officials said.

The CIA has since ramped up its work with the CTS—taking control of a mission long run by the U.S. military, according to administration and defense officials. For years, U.S. special-operations forces worked with CTS against al Qaeda in Iraq. But the military’s role has dwindled since U.S. troops pulled out of the country at the end of 2011.

In Afghanistan, it turns out that the CIA trained its own secret militia very soon after arriving there. Kimberly Dozier and Adam Goldman described the CIA’s Afghan militia back in 2010: Read more

Mark Mazzetti, Charlie Savage, and Scott Shane team up to provide the government’s best case — and at times, an irresponsibly credulous one — for the killing of Anwar al-Awlaki and the collateral deaths of Samir Khan and Abdulrahman al-Awlaki.

Yet even in a 3,600 word story, they don’t present any evidence against the senior Awlaki that was fresher than a year old — the October 2010 toner cartridge plot — at the time the Yemeni-American was killed. (I’m not saying the government didn’t have more recent intelligence; it just doesn’t appear in this very Administration-friendly case.) Not surprisingly, then, the story completely ignores questions about the definition of “imminent threat” used in the OLC memo and whether Awlaki was an “imminent” threat when he was killed.

Moreover, the case they do present has various weaknesses.

The story provides a fair amount of space to Awlaki’s celebration of the Nidal Hasan attack (though it does make it clear Awlaki did not respond enthusiastically to Hasan’s queries before the attack).

Investigators quickly discovered that the major had exchanged e-mails with Mr. Awlaki, though the cleric’s replies had been cautious and noncommittal. But four days after the shootings, the cleric removed any doubt about where he stood.

“Nidal Hassan is a hero,” he wrote on his widely read blog. “He is a man of conscience who could not bear living the contradiction of being a Muslim and serving in an army that is fighting against his own people.”

It uses far vaguer language to describe Awlaki’s role in the Faisal Shahzad and toner cartridge plots.

Meanwhile, attacks linked in various ways to Mr. Awlaki continued to mount, including the attempted car bombing of Times Square in May 2010 by Faisal Shahzad, a naturalized American citizen who had reached out to the preacher on the Internet, and the attempted bombing by Al Qaeda in the Arabian Peninsula of cargo planes bound for the United States that October.

“Linked in various ways” seems to be the new standard for killing an American. That, in spite of the fact that Shahzad’s tie to Awlaki seems to be the same Hasan had: an inspiration, but not any involvement in the plot. And while Awlaki is reported to have had some role in the toner cartridge plot, reports from Saudi infiltrator Jabir al-Fayfi apparently fingered others in AQAP as the chief plotters.

I guess that would be too much nuance to include in a 3,600 word article.

NYT doesn’t care about problems with the Abu Tarak explanation

Which leaves the UndieBomb attack as the sole attack in which the NYT presents evidence about Awlaki’s direct role. But there’s a problem with their claims there, too.

The would-be underwear bomber told F.B.I. agents that after he went to Yemen and tracked down Mr. Awlaki, his online hero, the cleric had discussed “martyrdom and jihad” with him, approved him for a suicide mission, helped him prepare a martyrdom video and directed him to detonate his bomb over United States territory, according to court documents.

In his initial 50-minute interrogation on Dec. 25, 2009, before he stopped speaking for a month, Mr. Abdulmutallab said he had been sent by a terrorist named Abu Tarek, although intelligence agencies quickly found indications that Mr. Awlaki was probably involved. When Mr. Abdulmutallab resumed cooperating with interrogators in late January, an official said, he admitted that “Abu Tarek” was Mr. Awlaki. With the Nigerian’s statements, American officials had witness confirmation that Mr. Awlaki was clearly a direct plotter, no longer just a dangerous propagandist.

I don’t doubt that Awlaki was directly involved in this attack in some way. And I got the same explanation about Abu Tarak from “an official” back when I first noted the discrepancy between DOJ’s public claims (thanks for not crediting me on that one, NYT boys). But either Abdulmutallab said something beyond “Abu Tarak was Awlaki,” or the entire explanation is not credible.

That’s because Abdulmutallab’s initial interrogation — according to the version presented by Jonathan Tukel in the opening arguments of Abdulmutallab’s trial — said Abu Tarak did the following:

  1. Spoke daily with Abdulmutallab about jihad and martyrdom
  2. Suggested to Abdulmutallab that he become involved in a plane attack against the United States aircraft
  3. Gave him training in detonating the bomb
  4. Told him to make sure he attacked a U.S. aircraft and make sure the attack takes place over the United States

Yet according to the version of Abdulmutallab’s interrogation presented in his sentencing memo, here’s who did those things:

  1. Awlaki and Abdulmutallab discussed martyrdom and jihad
  2. Defendant and Ibrahim Al Asiri discussed defendant’s desire to commit an act of jihad; Asiri discussed a plan for a martyrdom mission with Awlaki, who gave it final approval
  3. Asiri trained defendant in the use of the bomb
  4. Awlaki instructed defendant that the only requirements were that the attack be on a U.S. airliner, and that the attack take place over U.S. soil

Yesterday, the Guardian published an article detailing how the US turned to the use of death squads in Iraq to quell the rise of Sunni militias. The article provides convincing evidence that this was an intentional policy and was in fact a central tenet of David Petraeus’ often-praised counterinsurgency, or COIN, strategy. The key person in the Guardian’s reporting is James Steele, who was a veteran in organizing Central American death squads on behalf of the US during the Reagan years.

In reading the material from the Guardian, however, it should be kept in mind that Petraeus did not institute his COIN strategy only in Iraq. He put it into place in Afghanistan as well, and the fact that it lead to widespread allegations of torture and murder there demonstrates that the atrocities committed by these militias is a feature of the funding and training provided to them and not an unfortunate outgrowth, because this practice has now produced death squads in Central America, Iraq and Afghanistan. Recall that less than two weeks ago, Hamid Karzai called for the expulsion of US Special Operations forces from Maidan Wardak province due to allegations of abuse by the Afghan Local Police there. The Afghan Local Police are in reality groups of local militias trained and funded by US Special Operations forces and operating separately from the Karzai government. The ALP became one of the primary features of Petraeus’ COIN strategy when he moved it to Afghanistan.

The Pentagon sent a US veteran of the “dirty wars” in Central America to oversee sectarian police commando units in Iraq that set up secret detention and torture centres to get information from insurgents. These units conducted some of the worst acts of torture during the US occupation and accelerated the country’s descent into full-scale civil war.

Colonel James Steele was a 58-year-old retired special forces veteran when he was nominated by Donald Rumsfeld to help organise the paramilitaries in an attempt to quell a Sunni insurgency, an investigation by the Guardian and BBC Arabic shows.

Via email, my friend Kirk pointed out this report from Newsweek back in early 2005 where the concept of the Salvador option was floated openly by the Bush administration:

What to do about the deepening quagmire of Iraq? The Pentagon’s latest approach is being called “the Salvador option”–and the fact that it is being discussed at all is a measure of just how worried Donald Rumsfeld really is. “What everyone agrees is that we can’t just go on as we are,” one senior military officer told NEWSWEEK. “We have to find a way to take the offensive against the insurgents. Right now, we are playing defense. And we are losing.” Last November’s operation in Fallujah, most analysts agree, succeeded less in breaking “the back” of the insurgency–as Marine Gen. John Sattler optimistically declared at the time–than in spreading it out.

Now, NEWSWEEK has learned, the Pentagon is intensively debating an option that dates back to a still-secret strategy in the Reagan administration’s battle against the leftist guerrilla insurgency in El Salvador in the early 1980s. Then, faced with a losing war against Salvadoran rebels, the U.S. government funded or supported “nationalist” forces that allegedly included so-called death squads directed to hunt down and kill rebel leaders and sympathizers. Eventually the insurgency was quelled, and many U.S. conservatives consider the policy to have been a success–despite the deaths of innocent civilians and the subsequent Iran-Contra arms-for-hostages scandal. (Among the current administration officials who dealt with Central America back then is John Negroponte, who is today the U.S. ambassador to Iraq. Under Reagan, he was ambassador to Honduras. There is no evidence, however, that Negroponte knew anything about the Salvadoran death squads or the Iran-Contra scandal at the time. The Iraq ambassador, in a phone call to NEWSWEEK on Jan. 10, said he was not involved in military strategy in Iraq. He called the insertion of his name into this report “utterly gratuitous.”)

The most disgusting aspect of this apparent “trial balloon” floated by the Bush administration is that the program quite possibly was already underway when the Newsweek article came out. The Guardian article reminds us that Petraeus, the architect of this program,  was sent to Iraq in June of 2004 (this was his second deployment to Iraq) to begin training Iraqis, and the Newsweek article wasn’t published until January of 2005. Steele, who was reporting directly to Rumsfeld, first went to Iraq in 2003 (Rumsfeld delighted in running his own people separately from the chain of command; he did this at times with McChrystal as well).

More evidence that the program was entirely intentional comes from the role of torture in the program and the moves the US made to ignore torture just as the program was put into place. Read more
