Barack Obama (and the Three Musketeers of Selective Leaking) Says Barack Obama Wanted an OBL Trial

The AP made some news yesterday with this Barack Obama quote from Mark Bowden’s new book, The Finish.

Frankly, my belief was if we had captured him, that I would be in a pretty strong position, politically, here, to argue that displaying due process and rule of law would be our best weapon against al-Qaida, in preventing him from appearing as a martyr.

It’s a quote repeated and expanded in this exclusive piece from Vanity Fair, which will have an excerpt of the book in its next edition.

Now, both of these excerpts make it clear: This is a direct quote of an Obama claim, made after the fact. But if that didn’t already make you suspect the political efficacy of telling this story just weeks before the election, check out Bowden’s acknowledgements, above.

Not only does Bowden thank the Three Musketeers of Obama’s selective leaking, John Brennan, Tom Donilon, and Denis McDonough.

But it also thanks Obama personally.

(It also thanks CIA Director David Petraeus, a man who never met press coverage he didn’t like.)

Look, I’d love to imagine that Obama would have made the political effort to give Osama bin Laden a trial had he been captured alive. I’ve even rationalized how much easier that would be, given that we presumably would avoid the whole torture phase that has made trying Khalid Sheikh Mohammed.

There are both political and legal reasons why it serves Obama’s interests to say he considered the possibilities of a live capture followed by a trial. And given how closely Bowden worked with those trying to make the most of Obama’s OBL killing, I don’t see any reason to treat the claim as credible.

And this book–with Obama’s top aides identified as sources so clearly–is yet another reason why I think Mark Bissonnette won’t experience any legal troubles for publishing a book covering the same topic.

Why Can’t Darrell Issa Read the Wall Street Journal?

In addition to the rather amusing fact that Darrell Issa is conducting an investigation that Mike Rogers should be conducting, there’s another oddity about his “investigation.” The answers to the questions he asks Hillary Clinton have been available for over 10 days in this WSJ front page article.

In his letter, Issa asks,

  1. Was State Department headquarters in Washington aware of all the above incidents? If not, why not?
  2. If so, what measures did the State Department take to match the level of security provided to the U.S. Mission in Libya to the level of threat?
  3. Please detail any requests made by Embassy Tripoli to State Department headquarters for additional security, whether in general or in light of specific attacks mentioned above. How did the Department respond to each of these requests.

In the September 21 article, the WSJ listed several of the attacks in Issa’s letter (as well as an April 10 attack on the UN’s envoy). More importantly, it provided anonymous explanations from senior State Department officials describing their thinking about security in Benghazi.

The State Department chose to maintain only limited security in Benghazi, Libya, despite months of sporadic attacks there on U.S. and other Western missions. And while the U.S. said it would ask Libya to boost security there, it did so just once, for a one-week period in June, according to Libyan officials.

State Department officials said security for the consulate was frequently reviewed and was deemed sufficient to counter what U.S. officials considered to be the most likely threat at the time: a limited hit-and-run attack with rocket-propelled grenades or improvised explosive devices, or IEDs.

There was a string of attacks in Benghazi in the months before Sept. 11, including a June 6 IED explosion outside the consulate compound. “These types of incidents were the ones that were our principal concerns,” a senior State Department official said. Based on the outcome of the June 6 attack, in which a perimeter wall was damaged but no Americans hurt, a second State Department official added: “Our security plan worked.”

[After the Brits pulled out of their consulate in Benghazi] The U.S. deemed the security level sufficient and decided to stay, “given the very important mission that we have in eastern Libya to support U.S. national security interests,” said a senior State Department official. He said “robust” security improvements had been made to the compound since the Americans moved into it in May 2011, including cement barriers and barbed wire.

More importantly, the article describes who made the decision to opt for a light security approach over something more aggressive: Ambassador Stevens.

Current and former officials said the security choices in Benghazi reflected efforts by Mr. Stevens to maintain a low-profile security posture and show faith in Libya’s new leaders, despite questions about their ability to rein in heavily armed bands of militants. Read more

Beginning of the End in Afghanistan? Most Joint Operations Below Battalion Level Suspended

In the most significant move yet that suggests the NATO plan for Afghan security forces to take over as NATO withdraws from Afghanistan by the end of 2014 has failed, the US has halted most joint activities between US and Afghan forces below the battalion level. Any joint action at the lower force level will require approval from a General before it is permitted. Because the bulk of the training and joint patrol work of US and Afghan forces occurs at these lower force size levels, this order effectively brings training to a close until the order is reversed.

Jim Miklaszewski of NBC News first reported this development last night:

Most joint U.S.-Afghan military operations have been suspended following what authorities believe was an insider attack Sunday that left four American soldiers dead, officials told NBC News.

“We’re to the point now where we can’t trust these people,” a senior military official said. So far this year, 51 NATO troops have been killed in these so-called blue-on-green attacks. Sunday’s attack came a day after two British soldiers were shot dead by an Afghan policeman, Reuters reported.

“It’s had a major impact on our ability to conduct combat operations with them, and we’re going to have to back off to a certain degree,” the official said.

The suspensions of the joint operations are indefinite – according to one official, they “could last three days or three months.”

ISAF took issue with some of the early reporting and issued this “clarification” this morning:

 Recent media coverage regarding a change in ISAF’s model of Security Force Assistance (SFA) to the Afghan National Security Forces is not accurate. ISAF remains absolutely committed to partnering with, training, advising and assisting our ANSF counterparts. The ISAF SFA model is focused at the battalion level and above, with exceptions approved by senior commanders. Partnering occurs at all levels, from Platoon to Corps. This has not changed.

In response to elevated threat levels resulting from the “Innocence of Muslims” video, ISAF has taken some prudent, but temporary, measures to reduce our profile and vulnerability to civil disturbances or insider attacks. This means that in some local instances, operational tempo has been reduced, or force protection has been increased. These actions balance the tension of the recent video with force protection, while maintaining the momentum of the campaign.

We’ve done this before in other high tension periods, and it has worked well. Under this guidance, and as conditions change, we will continue to adapt the force posture and force protection. The SFA model is integral to the success of the ANSF, and ISAF will return to normal operations as soon as conditions warrant.

It seems to me that just as the “Innocence of the Muslims” video and its associated protests was used as cover for the sophisticated attack on the US Consulate in Benghazi, ISAF now is using the film and protests as cover for suspending training even though this suspension was a development that was easily predicted when Special Forces halted training of the Afghan Local Police on September 2. Petraeus Tie to Afghan Local Police Program Hits NYTimes One Day After ALP Role in Revenge Killings Noted

On Saturday, we learned that US Special Operations forces have suspended training of Afghan Local Police while a re-screening of the backgrounds of those already in the force is carried out. I noted then that only Reuters dared to connect the ALP program to David Petraeus, who put it in place, presumably because the news on the program was not good. Yesterday, the New York Times also linked Petraeus to the program, and, remarkably, this came only one day after running an article exposing further problems with the ALP program.

Sunday’s article on problems with the Afghan Local Police program informs us that a number of atrocities have been linked to groups some claim have been enabled by the ALP program:

It was the second time in a month that one of the controversial militia groups, known as arbakai, had carried out reprisal killings of people believed to be Taliban sympathizers.

In both cases, residents complained that the groups received support and protection from American Special Operations forces, which the United States military has denied. The Special Operations units train arbakai militiamen only when they are enrolled in official programs for recruits of the Afghan Local Police, American officials insist.

Although the term “reprisal killing” has a specific definition in International Humanitarian Law (see this comment by joanneleon), the article linked by the Times when they used the term discusses what looks like a case of revenge killing fueled by ethnic hatred:

At least nine Afghans and perhaps many more were forced out of their homes in rural Afghanistan and executed in what Afghan officials called an act of revenge by one ethnic group against another, underscoring the long shadow cast by the country’s ethnic hatreds.

So, while at least some of the atrocities attributed to the ALP may be due to ethnic tensions, what seems clear is that in many cases these groups claim a relationship to US Special Operations forces that the US sometimes disputes. From this same early August article:

Two Afghan officials, including a member of Parliament, asserted that the man who is accused of leading the executions has had a relationship with American Special Operations forces — an assertion that an American spokesman denied. The other Afghan official, the provincial police chief, said the authorities in the area had tried to have the man arrested on past accusations of killing civilians, but that “foreigners” provided refuge for him.

The spokesman for the Special Operations Command, Lt. Col. Todd Harrell, said there were no Special Operations forces in the area and emphasized that it remained unclear if those who were killed were civilians or Taliban.

That is a very interesting dual-level denial by Harrell. First, he denies a link to the leader of the group carrying out the executions, but, just in case that claim later becomes non-operational, he throws in the suggestion that those killed may have been Taliban, presumably making the fact that they were executed okay.

The article goes on to state that perhaps some ALP units have direct links to Special Operations forces rather than operating under Afghan control. Complicating matters further, it appears that although the ALP program got a large push under Petraeus’ command, the practice of buying off militia groups has been going on from the beginning of our presence in Afghanistan and may go beyond Special Operations: Read more

Did Karzai Fire NDS Head Nabil for Confirming ISI Shared Intelligence on Badruddin Haqqani’s Killing?

Afghan President Hamid Karzai today fired the head of Afghanistan’s intelligence agency, the National Directorate of Security. This move comes as a great surprise, as the NDS was credited with thwarting a recent Haqqani network attack on Kabul and a subsequent attack by another group of militants targeting Afghanistan’s Parliament. Complicating the effort to understand Karzai’s move is the fact that he is engaged in a battle with the Afghan Parliament. Karzai made a number of moves today that are sure to anger Parliament even further. Citing border incursions from Pakistan, Parliament voted earlier this month to remove the Defense and Interior Ministers. Today, Karzai reappointed the ousted Interior Minister as Defense Minister while at the same time announcing the firing the head of the National Directorate of Security. Parliament has vowed to support the ousted intelligence chief.

Reuters brings us the basics of Karzai’s moves today:

Afghan President Hamid Karzai filled gaps in two top security ministries on Wednesday as part of a reshuffle forced on him by a fractious parliament, but risked a destabilising row with lawmakers by reappointing a sacked minister.

Parliament, in a rebuff to Karzai, earlier this month voted to remove Defence Minister Abdul Rahim Wardak and Interior Minister Bismillah Khan Mohammadi over deteriorating security, corruption accusations clouding the government and cross-border attacks blamed on Pakistan.

But Karzai appointed Mohammadi, an ethnic Tajik with a strong powerbase in northern Afghanistan, as Defence Minister, while removing spy agency chief Rahmatullah Nabil, charged with countering the Taliban and cutting insider attacks by Afghan police and soldiers on foreign troops.

“Intelligence chiefs cannot serve more than two years. President Karzai called Nabil today and thanked him for his services,” Karzai’s chief spokesman Aimal Faizi told Reuters ahead of the announcement.

We get more on the politics of these moves from Khaama Press:

Afghan lawmakers on Wednesday criticized Afghan president Hamid Karzai for dismissing Afghan National Directorate of Security (NDS) chief Rahmatullah Nabeel from his position.

Farkhunda Zahra Naderi Afghan parliament member called Rahmatullah Nabil an effortful person and said neighboring intelligence agencies are behind the decision of president Hamid Karzai to dismiss Rahmatullah Nabeel.

Note the reference to “neighboring intelligence agencies” being behind Karzai’s move to fire Nabil. This is a very thinly veiled reference to Pakistan’s Inter-Services Intelligence. I had previously noted that there were signs since the new ISI head Zaheer ul-Islam visited the US August 1-3 that important new intelligence information was flowing from ISI to the US. In fact, it seems to me that the sudden intelligence victories by Afghanistan’s NDS could well be explained by this new flow of information from ISI to the US (and then to NDS). Read more

Signs of Intelligence Sharing Give Way to Call for “Divorce”: US-Pakistan Relations Continue Extreme Swings

Back on August 2, I noted a very interesting development. At a time when the US and Pakistan were holding high-level meetings both in Washington and Pakistan, a terror plot in Afghanistan reported to be in preparation by the Haqqani network was disrupted. This was a surprising development to me because at the time I was predicting that the talks between the new head of Pakistan’s ISI and CIA head David Petraeus would go badly and that the US would launch poorly targeted drone attacks in retaliation, perhaps even while General ul-Islam was in transit back to Pakistan. Instead, there seemed to be a distinct possibility that Pakistan had provided intelligence on movement of Haqqani network members from Pakistan into Afghanistan and that this intelligence allowed the plot to be disrupted before it was carried out.

Once the meetings in Washington ended, no new drone strikes occurred in Pakistan. In fact, another attack plot was thwarted in Afghanistan on August 12. Although this plot was not believed to be at the hands of the Haqqani network, there was evidence that Pakistanis were involved, which again led me to postulate that this plot also was disrupted with the help of intelligence information from Pakistan.

The absence of drone strikes continued and then on August 13 Defense Secretary Leon Panetta was interviewed by Lolita Baldor and Robert Burns of AP. As seen in the video excerpt above, Panetta said that he expected Pakistan to launch military operations soon against Taliban militants in Pakistan’s Federally Administered Tribal Areas. As Bill Roggio noted at Long War Journal, this was a shocking development. After opening with “This is absolutely stunning”, Roggio went on to list his reasoning for why the announcement didn’t make much sense. He concluded:

How many times has Pakistan promised to take action in North Waziristan, or claimed to take action there, only to make fools of top US defense officials?

The lull in drone strikes continued.

Did the US lose patience with Pakistan’s promise to launch an operation in North Waziristan? On August 18, the lull in drone strikes ended (don’t bother looking this or any other drone strike up in New America Foundation’s database, as it now appears to have been taken down). And it ended in a particularly ugly way, at midday on the day when the religious feast of Eid al-Fitr would begin at sunset. That strike has been followed up with three others, so that as of Tuesday, there were four drone strikes in as many days. The lull does not match up with Ramadan. Ramadan started on July 20 and The Bureau for Investigative Journalism’s database shows attacks on July 23 and July 29. Instead, that last strike prior to the lull was just before ul-Islam’s meetings in Washington, which started on August 1.

This sequence of events suggests to me that if there was indeed a time of increased cooperation in which ISI shared intelligence on movement of militants from the tribal areas into Afghanistan for attacks in return for no drone strikes occurring, this agreement has now fallen apart. The intense rate of drone strikes once they re-started is typical of US actions when retaliation is desired. It would not be surprising, then, for the next attack by militants moving from Pakistan to Afghanistan to be successful instead of being disrupted before it can take place.

It appears that I am not alone in thinking we are again at a low point in US-Pakistan relations. Former Pakistani envoy to the United States Hussein Haqqani suggested yesterday that the US and Pakistan should “divorce”. This latest outbreak of drone attacks could then be seen as the US serving notice of separation.

Poor Responses by US Military, Press to Increased Green on Blue Attacks

Yesterday, I noted the dramatic increase recently in green on blue attacks in Afghanistan, where Afghan security personnel turn their weapons on NATO forces. This disturbing development clearly has rattled both the US military and the press, because their responses have been entirely bungled.

Late yesterday, we learned from CNN that all NATO troops will now be required to carry loaded weapons at all times, even while on their bases:

The uptick in attacks by Afghan security forces against coalition troops has hit home, with all troops at NATO headquarters and all bases across Afghanistan now ordered to carry loaded weapons around the clock, CNN learned Friday.

Gen. John Allen, the NATO commander in Afghanistan, ordered the move, according to a U.S. official with direct knowledge of the orders. The order, made in recent days, was divulged amid two more so-called green-on-blue or insider attacks Friday.

This move sets the stage for accidental friendly fire deaths (blue on blue in this case) set off by an unexpected noise. If I were an enlisted US soldier with brown skin and black hair, you can bet I’d wear my uniform 24/7 on the base and be ready to dive for the floor quickly when the bullets start flying.

NATO official posturing on the attacks is at least changing slightly. Despite increasing documentation of green on blue killings and outright defections by Afghan forces, NATO now grudgingly admits some infiltration is occurring, but their estimate seems to me to be a serious lowball:

NATO says the majority of attacks by Afghan security forces against coalition troops are driven primarily by personal grievances rather than an infiltration by insurgents.

“Some 10% we know are related to the insurgency,” Brig. Gen. Gunter Katz, a spokesman for the NATO-led International Security Assistance Force, said late Friday.

Perhaps the most stunning failure of all, though, in the surge of coverage of increased green on blue (I still can’t get completely to the new official-speak of “insider”) attacks, is this morning’s brainless Washington Post article looking “behind the scenes” at an attack from last week. The Post opens by laying out a number of facts surrounding the attack:

The teenage assailant who killed three Marines last week on a U.S. military base in southern Afghanistan had easy access to the weapons arsenal of the Afghan police. He was in near-constant contact with U.S. troops, often when they were without their guns and body armor.

But although Aynoddin, 15, lived among American and Afghan security forces, he was not a soldier or a police officer. He had never been vetted. According to U.S. and Afghan officials, his role on base was hardly formal: He was the unpaid, underage personal assistant of the district police chief.

Officials would later learn that the quiet, willowy boy was also working for the insurgency.

Nowhere in the article, however, does the Post point out that it is the US, and specifically the “advisors” whom the infiltrator targeted, who had been responsible for training the Afghan security forces the youth infiltrated. Read more

Afghanistan War: Now With Even More Suckitude

Just because I happened to read one post and point out a small error before going on a beach walk, Marcy had a hard time believing I really did go on vacation last week. While I was gone, one of the topics I usually track carefully went completely out of control. The rate of green on blue attacks in Afghanistan spiked dramatically, with today’s nonfatal attack bringing the total to five attacks in the past week:

An Afghan policeman opened fire on NATO forces and Afghan soldiers Monday morning in the fifth apparent attack in a week by Afghan security forces on their international partners. The U.S.-led military coalition says none of its service members were killed.

At least seven American service members have been killed in the past week by either their Afghan counterparts or attackers wearing their uniforms.

Notably, NATO is unable to deviate from its current script of claiming the attacks are all “isolated incidents” and that we should consider just how large the Afghan forces are becoming due to our superior recruiting and training:

Coalition officials say a few rogue policemen and soldiers should not taint the overall integrity of the Afghan security forces and that the attacks have not impeded plans to hand over security to Afghan forces, which will be 352,000 strong in a few months.

But the same AP article doesn’t seem to buy the NATO spin:

A recent rash of “green-on-blue” attacks, in which Afghan security forces or attackers wearing their uniforms turn their guns on the coalition troops training them, has raised worries about a deterioration of trust between the two sides as well as the quality of the Afghan police and soldiers who will take over full security responsibility for fighting the Taliban when most international troops leave by the end of 2014. It also raises renewed worry that insurgents may be infiltrating the Afghan army and police despite heightened screening.

When AP wire stories begin to describe the problems with Afghan force training in terms of “deterioration of trust” and express concerns about the “quality of Afghan police and soldiers” while also pointing out infiltration by insurgents, it is clear that the Obama administration and NATO are losing their propaganda campaign in which they continue to insist that everything is just fine in Afghanistan and that progress toward the hand-off of security responsibility in 2014 is on schedule.

But the spike in green on blue attacks isn’t the only bad news in Afghanistan. In addition to attacking NATO forces, infiltrators in the Afghan police force are killing fellow policemen and defecting in large groups. Also, local officials in Afghanistan continue to be targeted in attacks.

Slightly Better News

On another front, more evidence is accumulating on improved relations and information sharing between the US intelligence community and Pakistan’s ISI. Read more

Did Pakistan Provide Intelligence Against Haqqani Network?

As I mentioned on Tuesday, the head of Pakistan’s spy agency is in the US for meetings with the CIA and other US intelligence interests. Those meetings started yesterday and appear to be slated to go through tomorrow. I had predicted that if the meetings, and particularly the discussions regarding the Haqqani network, don’t go well, we will see a poorly targeted drone attack in Pakistan’s tribal area within the first day or two after the meetings conclude. Developments today, however, point in the opposite direction, with it looking as though perhaps the ISI has decided to share intelligence on the Haqqani network.

There is word today out of Kabul that a pre-dawn raid has disrupted plans for a major attack by the Haqqani network. Wire services are attributing the raid to Afghan security forces, but as I have pointed out more than once, there is a definite push by the US to over-state the capabilities of Afghan forces so that the best possible spin can be kept on US plans to withdraw from Afghanistan. It seems likely that the US had a large role in the raid but is pushing the story that Afghan forces pulled it off on their own.

Here is the Reuters story on the raid:

Afghan security forces killed five insurgents and wounded one during a pre-dawn raid in Kabul on Thursday, with authorities saying they had thwarted a mass attack and captured intelligence pointing to the militant Haqqani network.

Soldiers from Afghanistan’s spy agency, the National Directorate of Security (NDS), launched the raid just after midnight, entering a single-story house compound on the fringes of Kabul which the insurgents were using as a base.

“They planned mass attacks in different parts of Kabul disguised in burqas,” the NDS said in a statement, referring to the head-to-toe covering worn by many Afghan women and sometimes used by insurgents to evade detection.

With that raid occurring in the very early hours of this morning, statements coming out of the meeting later this morning between the US commander in Afghanistan, General John Allen, and Pakistan’s army chief, Ashfaq Kayani, take on added significance. From the Express Tribune:

The US commander in Afghanistan said Thursday that “significant progress” was being made in improving cooperation with Pakistan, after his first visit since Islamabad ended a blockade on Nato supplies.

The talks between General John Allen and General Ashfaq Kayani focused on improving security along the border between Afghanistan and Pakistan, and cooperation between Afghan, Pakistani and Nato troops, said a statement released by both sides.

“I look forward to these visits and am pleased with the upward spiral in our relationship they represent,” Allen said.

“We are making significant progress toward building a partnership that is enduring, strategic, carefully defined, and that enhances the security and prosperity of the region.”

A bit later in the article we have this:

US officials have called repeatedly on Pakistan to move against the Haqqani network whose leaders are based on Pakistan’s side of the border.

Did the ISI provide information that allowed the Haqqani network team in Kabul to be found? That would certainly explain the optimism that Allen is voicing after today’s meeting.   However, obtaining intelligence on a forward operating team is nothing compared to the real goal the US wants, which is actionable intelligence on the leaders of the Haqqani network. It still seems very unlikely the ISI would hand over information on the Haqqani leaders, so perhaps their “compromise” position will be rein in the network and prevent them from carrying out attacks in Afghanistan until after the US departs. Such a position by the ISI might even achieve their goal of reducing drone strikes in the tribal regions by the US if it becomes clear that Haqqani network forays into Afghanistan have been reduced dramatically.

Using Pensions to “Punish” “Leaks” Will Subject Clearance Holders to Arbitrary Power

The Senate Intelligence Committee’s new anti-leak laws are the part of the Intelligence Authorization that will generate the most attention. Greg Miller already got Dianne Feinstein to admit there’s no reason to think one of the new provisions–permitting only the most senior intelligence officials to do background briefings–will limit leaks.

Feinstein acknowledged that she knew of no evidence tying those leaks or others to background sessions, which generally deal broadly with analysts’ interpretations of developments overseas and avoid discussions of the operations of the CIA or other spy services.

Another of the provisions–requiring intelligence committee heads to ensure that every sanctioned leak be recorded–ought to be named the Judy Miller and Bob Woodward Insta-Leak Recording Act.

(a) RECORD REQUIREMENT.—The head of each element of the intelligence community shall ensure that such element creates and maintains a record of all authorized disclosures of classified information to media personnel, including any person or entity under contract or other binding agreement with the media to provide analysis or commentary, or to any person or entity if the disclosure is made with the intent or knowledge that such information will be made publicly available.

I’m sure someone can think of some downside to this provision, but I can’t think of it at the moment (which is why Obama will probably find some way to eliminate it). It will end some of the asymmetry and abuse of classification as it currently exists.

In addition, there are a bunch of provisions that are just dumb bureaucracy.

But it’s this one that is deeply troubling. Among the other provisions making nondisclosure agreements more rigorous is a provision that would allow an intelligence community head to take away a person’s pension if they “determine” that an individual violated her nondisclosure agreement.
