Trump’s Never-Declined Invitation from Deputy Prime Minister Sergei Prikhodko

In an interview with NYT last year, George Papadopoulos claimed that he had a call scheduled with Stephen Miller on April 27, 2016, when he probably would have told him that Joseph Mifsud had just told him that Russians had dirt on Hillary Clinton in the form of thousands of emails they planned to drop anonymously to help Donald Trump. But the call didn’t go through.

PAPADOPOULOS: That’s all I can say. I mean, actually, and the reason why I don’t know how much wiggle room — I don’t think I’m really leaving myself any wiggle room at all because probably 99 percent of my communication with the campaign was over email. You know, I was living in London. You know, I met some officials face to face very briefly. So the place I would have potentially sent this information — I think it’s public — I mentioned to Stephen Miller I’m receiving interesting messages from Moscow about a meeting, when the time is right. That was the same day that I had received that information. I think I had a scheduled call with Miller that same day, never went through, and perhaps that’s where it went. It just stayed in my mind.

MAZZETTI: One of the things that seems the most puzzling out of this whole Trump-Russia story is that you’re told about this pretty explosive information. It is information that would no doubt help the Trump campaign. You wanted to help the Trump campaign. You were very eager to gain, cement, a place in the campaign. And yet, you say you didn’t tell anyone about it but you did tell the Australian diplomat and the Greek foreign minister. Seems strange for people to sort of —

PAPADOPOULOS: I allegedly told the Australian, and I certainly told the Greek foreign minister, but let’s not forget, though, at the time I was shuffling between Europe quite frequently. I wasn’t at a campaign headquarters, where I would have the opportunity to sit down and probably talk with campaign heads. So, I actually I don’t find it shocking that I wouldn’t have told them something like this, considering my interactions with the campaign was, as I stated, probably 99 percent done via email. And maybe — you never know — maybe if the call between myself and Stephen Miller occurred that day, I would have told him. But that call never went through, and we’re left with receiving interesting messages from Moscow. It’s how fate works sometimes, I guess.

According to his statement of offense, after his second interview with the FBI, he got a new phone number, suggesting he ditched his cell phone.

On or about February 23, 20 17, defendant PAPADOPOULOS ceased using his cell phone number and began using a new number.

According to the government’s sentencing memo in his case, Papadopoulos hid the existence of a different phone he used to communicate with Mifsud while in London until his fourth and final interview with the FBI.

The defendant also did not notify the government about a cellular phone he used in London during the course of the campaign – that had on it substantial communications between the defendant and the Professor – until his fourth and final proffer session.

This was a guy working pretty hard to hide his communications — including any he had on encrypted apps that would bypass his phone company.

Which is why I find details about the Trump Organization response — or rather, non-response — to an invitation from Russia’s Deputy Prime Minister, Sergei Prikhodko, to attend the St. Petersburg International Economic Forum, the same event Cohen was supposed to attend to arrange the Trump Tower Moscow deal.

Here’s what the timeline of that invitation looks like, according to the Mueller Report (starting at page 78 of Volume I).

January 14, 2016: Graff replies to Duma by email saying Trump would have to decline because of his travel schedule, asking whether she should send a formal declination

March 17, 2016 (according to Trump’s written response, though no email is cited in the report): Prikhodko emails Graff again inviting Trump to SPIEF

March 31, 2016: Graff prepares a two-paragraph letter declining the invitation and forwards it to another assistant to have Trump sign it, which he doesn’t sign

March 31, 2016: Robert Foresman follows up a phone introduction by Mark Burnett with an email to Graff, explaining that he had set up a back channel between George W Bush and Putin and discussing an “approach” by “senior Kremlin officials” asking for a meeting with Lewandowski about topics he did not want to include on an unsecure email

May 5, 2016: Sater extends invitation purportedly from Peskov to SPIEF

Ultimately, there’s no record Trump did decline the invitation from Prikhodko (nor does the report cite the email he purportedly sent to Graff). Nor does the report describe what happened after Foresman’s invite got sent to Miller.

But it does show that in the wake of Papadopoulos purportedly failing to tell Miller the Russians were offering dirt, he was the guy Lewandowski wanted to field an offer a possible back channel with Russia.

As I disclosed last July, I provided information to the FBI on issues related to the Mueller investigation, so I’m going to include disclosure statements on Mueller investigation posts from here on out. I will include the disclosure whether or not the stuff I shared with the FBI pertains to the subject of the post. 

Why Did Mueller Include the June 9 Meeting Statement in His Obstruction Case?

I’ve got a bunch more posts on the Mueller Report I’m going to eventually write; I’ve still got a slew of theories and observations to share. But there’s one topic I just have guesses on, one I’d love to have more people weigh in on.

Why did Mueller’s team include Donald Trump’s statement on the June 9 meeting — which is described not as a false statement, but an effort to prevent the disclosure of Don Jr’s emails setting up the meeting — in his obstruction analysis?

The obstruction analysis on the June 9 meeting shows it’s not itself obstruction

As a number of reviews of the Mueller Report obstruction analysis show, the June 9 meeting cover-up is the one obstructive act where the report concludes the evidence did not establish it as an act of obstruction for all three factors:

As the obstruction analysis lays out, Trump talked hopefully about ensuring the emails didn’t get out, but there’s no evidence he took action, beyond lying publicly, to suppress them.

Each of these efforts by the President involved his communications team and was directed at the press. They would amount to obstructive acts only if the President, by taking these actions, sought to withhold information from or mislead congressional investigators or the Special Counsel. On May 17, 2017, the President’s campaign received a document request from SSCI that clearly covered the June 9 meeting and underlying emails, and those documents also plainly would have been relevant to the Special Counsel’s investigation.

But the evidence does not establish that the President took steps to prevent the emails or other information about the June 9 meeting from being provided to Congress or the Special Counsel. The series of discussions in which the President sought to limit access to the emails and prevent their public release occurred in the context of developing a press strategy.

It then repeats that analysis by showing that while withholding the emails might amount to obstruction, he did not withhold emails.

As noted above, the evidence does not establish that the President sought to prevent disclosure of the emails in those official proceedings.

Then, in the intent section, it shows Trump’s central role in crafting the adoptions statement, while again concluding that the statement doesn’t amount to withholding the email.

The evidence establishes the President’s substantial involvement in the communications strategy related to information about his campaign’s connections to Russia and his desire to minimize public disclosures about those connections. The President became aware of the emails no later than June 29, 2017, when he discussed them with Hicks and Kushner, and he could have been aware of them as early as June 2, 2017, when lawyers for the Trump Organization began interviewing witnesses who participated in the June 9 meeting. The President thereafter repeatedly rejected the advice of Hicks and other staffers to publicly release information about the June 9 meeting. The President expressed concern that multiple people had access to the emails and instructed Hicks that only one lawyer should deal with the matter. And the President dictated a statement to be released by Trump Jr. in response to the first press accounts of the June 9 meeting that said the meeting was about adoption.

But as described above, the evidence does not establish that the President intended to prevent the Special Counsel’s Office or Congress from obtaining the emails setting up the June 9 meeting or other information about that meeting.

Curiously, this analysis of intent doesn’t talk about why Trump may have wanted to hide the truth about the June 9 meeting, even though elsewhere the report suggests that, overall, one motive for Trump obstructing the investigation might be because he thought the June 9 meeting would be found to be criminal.

So Mueller spent over eight pages laying out whether Trump’s role in crafting a deceitful statement about the June 9 meeting was obstruction of justice when, according to the report’s analysis of obstruction of justice, it was not even a close call.

So why — in a report that might better be understood as an impeachment referral — did they include that?

Trump’s statement on the June 9 meeting as evidence of corrupt intent for other obstructive acts

I’ve commented elsewhere that one of the posts I’ll eventually do is a narratological analysis of the report. I said that, in part, for the way the report intersperses several acts of potential Trump obstruction that all happened during the same time period in summer 2017. While the report only mentions this in passing, Trump’s lies about the June 9 meeting occur during the same time frame as three other potential obstructive acts that the report shows do amount to obstruction: the effort to get Don McGahn to get Rod Rosenstein to fire Mueller, the request that Corey Lewandowski (!!) fire Jeff Sessions, and the effort to get Sessions to unrecuse.

And, as noted, the June 9 meeting is one of three things — along with the Trump Tower Moscow deal and Trump’s push to have Roger Stone optimize the release of the stolen emails — that the report posits might be the underlying facts Trump was attempting to hide with his other obstruction (note that the report never focuses on Mike Flynn’s discussion on sanctions, which I’ll return to in a later post).

Which suggests Trump’s involvement in the June 9 statement is there not for those actions themselves, but for the way his actions prove corrupt intent for other obstructive actions.

A story describing Trump’s unique actions that nevertheless leaves out the biggest detail

Still, the specific story the report tells is damning. It includes details that suggest this was a unique event, with Trump trying to retain plausible deniability even though several witnesses say he knew about the meeting, and describing Trump preferring to break his cardinal sin, remaining silent on a story. But note that the story leaves out one of the most important details: Vladimir Putin’s interactions with the President during the day Trump wrote his deceitful statement.

Here’s the story, as told in the obstruction section.

Trump claims he didn’t know about the meeting ahead of time, contrary to what several witnesses said.

According to written answers submitted by the President in response to questions from this Office, the President had no recollection of learning of the meeting or the emails setting it up at the time the meeting occurred or at any other time before the election 668

The Chief of Staff learns about the meeting from Sean Hannity, which is just crazy train.

[Reince] Priebus recalled learning about the June 9 meeting from Fox News host Sean Hannity in late June 2017.672

Trump tells Jared not to share details of the meeting with him, according to Hope Hicks.

According to Hicks, Kushner said that he wanted to fill the President in on something that had been discovered in the documents he was to provide to the congressional committees involving a meeting with him, Manafort, and Trump Jr.678 Kushner brought a folder of documents to the meeting and tried to show them to the President, but the President stopped Kushner and said he did not want to know about it, shutting the conversation down.’

On June 28, 2017, Hicks viewed the emails at Kushner’s attorney’s office 68° She recalled being shocked by the emails because they looked “really bad.”68′ The next day, Hicks spoke privately with the President to mention her concern about the emails, which she understood were soon going to be shared with Congress.682 The President seemed upset because too many people knew about the emails and he told Hicks that just one lawyer should deal with the matter.”‘ The President indicated that he did not think the emails would leak, but said they would leak if everyone had access to them.684

Later that day, Hicks, Kushner, and Ivanka Trump went together to talk to the President.685 Hicks recalled that Kushner told the President the June 9 meeting was not a big deal and was about Russian adoption, but that emails existed setting up the meeting.686 Hicks said she wanted to get in front of the story and have Trump Jr. release the emails as part of an interview with “softball questions.”687 The President said he did not want to know about it and they should not go to the press 688 Hicks warned the President that the emails were “really bad” and the story would be “massive” when it broke, but the President was insistent that he did not want to talk about it and said he did not want details!'” Hicks recalled that the President asked Kushner when his document production was due.699 Kushner responded that it would be a couple of weeks and the President said, “then leave it alone.”‘ Hicks also recalled that the President said Kushner’s attorney should give the emails to whomever he needed to give them to, but the President did not think they would be leaked to the press.692 Raffel later heard from Hicks that the President had directed the group not to be proactive in disclosing the emails because the President believed they would not leak.693

But Jared claims that didn’t happen. This narrative is largely sourced to interviews with Hope Hicks. Even in his second interview, Jared said it didn’t happen this way.

Hicks 12/7/17 302, at 7; Hicks 3/13/18 302, at I. Counsel for Ivanka Trump provided an attorney proffer that is consistent with Hicks’s account and with the other events involving Ivanka Trump set forth in this section of the report. Kushner said that he did not recall talking to the President at this time about the June 9 meeting or the underlying emails. Kushner 4/11/18 302, at 30.

Hicks is confused about why Trump wants to commit his ultimate sin.

On July 7, 2017, while the President was overseas, Hicks and Raffel learned that the New York Times was working on a story about the June 9 meeting.695 The next day, Hicks told the President about the story and he directed her not to comment.696 Hicks thought the President’s reaction was odd because he usually considered not responding to the press to be the ultimate sin.697 Later that day, Hicks and the President again spoke about the story.698 Hicks recalled that the President asked her what the meeting had been about, and she said that she had been told the meeting was about Russian adoption.699 The President responded, “then just say that.”706

The Report neglects to mention the Putin meeting where he and Trump talked about the subject of the statement.

Trump edits Jr’s statement because it admits they were offered dirt and discussed sanctions relief, defaulting on Putinesque spin.

On the flight home from the G20 on July 8, 2017, Hicks obtained a draft statement about the meeting to be released by Trump Jr. and brought it to the President.701 The draft statement began with a reference to the information that was offered by the Russians in setting up the meeting: “I was asked to have a meeting by an acquaintance I knew from the 2013 Miss Universe pageant with an individual who I was told might have information helpful to the campaign.”702 Hicks again wanted to disclose the entire story, but the President directed that the statement not be issued because it said too much.703 The President told Hicks to say only that Trump Jr. took a brief meeting and it was about Russian adoption.704 After speaking with the President, Hicks texted Trump Jr. a revised statement on the June 9 meeting that read:

It was a short meeting. I asked Jared and Paul to stop by. We discussed a program about the adoption of Russian children that was active and popular with American families years ago and was since ended by the Russian government, but it was not a campaign issue at that time and there was no follow up. 705

Hicks’s text concluded, “Are you ok with this? Attributed to you.”706 Trump Jr. responded by text message that he wanted to add the word “primarily” before “discussed” so that the statement would read, “We primarily discussed a program about the adoption of Russian children.”707 Trump Jr. texted that he wanted the change because “[t]hey started with some Hillary thing which was bs and some other nonsense which we shot down fast. “708 Hicks texted back, “I think that’s right too but boss man worried it invites a lot of questions[.) [U]ltimately [d]efer to you and [your attorney] on that word Be I know it’s important and I think the mention of a campaign issue adds something to it in case we have to go further.” 709 Trump Jr. responded, “lfl don’t have it in there it appears as though I’m lying later when they inevitably leak something.” 710

Hope Hicks channels the President hoping the damning emails would never leak.

Corallo told the President the statement had been authorized and further observed that Trump Jr. ‘s statement was inaccurate and that a document existed that would contradict it.722 Corallo said that he purposely used the term “document” to refer to the emails setting up the June 9 meeting because he did not know what the President knew about the emails.723 Corallo recalled that when he referred to the “document” on the call with the President, Hicks responded that only a few people had access to it and said “it will never get out.”724 Corallo took contemporaneous notes of the call that say: “Also mention existence of doc. Hope says ‘ only a few people have it. It will never get out.”‘725 Hicks later told investigators that she had no memory of making that comment and had always believed the emails would eventually be leaked, but she might have been channeling the President on the phone call because it was clear to her throughout her conversations with the President that he did not think the emaiis would leak.726

Trump’s flunkies deny that the guy who met Vladimir Putin twice during the drafting of the statement wrote the statement.

Over the next several days, the President’s personal counsel repeatedly and inaccurately denied that the President played any role in drafting Trump Jr. ‘s statement.729 After consulting with the President on the issue, White House Press Secretary Sarah Sanders told the media that the President “certainly didn’t dictate” the statement, but that “he weighed in, offered suggestions like any father would do.”730

The Report again neglects to mention the Putin meeting where he and Trump spoke about the subject of the statement.

On July 19, 2017, the President had his follow-up meeting with Lewandowski and then met with reporters for the New York Times. In addition to criticizing Sessions in his Times interview, the President addressed the June 9, 2016 meeting and said he “didn’t know anything about the meeting” at the time.734 The President added, “As I’ve said-most other people, you know, when they call up and say, ‘By the way, we have information on your opponent,’ I think most politicians – I was just with a lot of people, they said … , ‘Who wouldn’ t have taken a meeting like that?”‘735

Providing the framework for the Putin involvement

As I’ve said, I think it remarkable — though perhaps explicable on constitutional grounds — that the report does not mention Putin’s role in all of this, and Trump’s bizarre behavior at the G20 (where he had Ivanka sit in on a meeting while he worked on the statement) more generally. Trump’s interactions with Putin — and his efforts to keep them secret even from staffers — is the subject of other congressional investigation. Which is why this passage from the beginning of the obstruction section sticks out.

Given those considerations, the facts known to us, and the strong public interest in safeguarding the integrity of the criminal justice system, we conducted a thorough factual investigation in order to preserve the evidence when memories were fresh and documentary materials were available.

As noted, I think Mueller included the June 9 meeting statement not because it, by itself, amounts to obstruction, but because the evidence laid out — plus evidence available publicly or via separate congressional investigation — provides an important motivational explanation for the rest of it. Trump made three separate attempts to gut the Mueller investigation in this period, all at a time he was acting unusually (for him) in his efforts to bury the June 9 meeting.

This is the lie he was telling while using his office to try to stop the investigation. Or rather, this is the lie he and Vladimir Putin were telling.

The Commander-in-Chief Keeps Instructing His National Security Officials Not to Protect the Country

One of the most alarming passages in the Mueller Report describes how, in an effort to get Corey Lewandowski to convince Jeff Sessions to reverse his recusal in the Russian investigation, Trump suggested that Mueller could be limited to investigating future election hacks. (h/t to TC who has been emphasizing this passage)

During the June 19 meeting, Lewandowski recalled that, after some small talk, the President brought up Sessions and criticized his recusal from the Russia investigation.605 The President told Lewandowski that Sessions was weak and that if the President had known about the likelihood of recusal in advance, he would not have appointed Sessions.606 The President then asked Lewandowski to deliver a message to Sessions and said “write this down.” 607 This was the first time the President had asked Lewandowski to take dictation, and Lewandowski wrote as fast as possible to make sure he captured the content correctly.608 The President directed that Sessions should give a speech publicly announcing:

I know that I recused myself from certain things having to do with specific areas. But our POTUS . .. is being treated very unfairly. He shouldn’t have a Special Prosecutor/Counsel b/c he hasn’t done anything wrong. I was on the campaign w/ him for nine months, there were no Russians involved with him. I know it for a fact b/c I was there. He didn’t do anything wrong except he ran the greatest campaign in American history.609

The dictated message went on to state that Sessions would meet with the Special Counsel to limit his jurisdiction to future election interference:

Now a group of people want to subvert the Constitution of the United States. I am going to meet with the Special Prosecutor to explain this is very unfair and let the Special Prosecutor move forward with investigating election meddling for future elections so that nothing can happen in future elections.610

The President said that if Sessions delivered that statement he would be the “most popular guy in the country.”6 11 Lewandowski told the President he understood what the President wanted Sessions to do.612

In June 2017, the Commander-in-Chief of the United States suggested that the FBI should not investigate a historic cyberattack by an adversary on the United States. The investigation Trump was obstructing was not just of his own conduct, but also that of Russia.

That revelation puts two other events in dramatically different light.

First, recall that when Congress was considering bills to ensure election integrity last year, Trump pre-empted the effort with an Executive Order imposing a two step review, after the fact, to see if foreign adversaries had attempted to interfere in the election. First, ODNI does a report on the election, then he delivers it to other Executive Branch Officials. Then DHS Secretary and the Attorney General deliver a report based on that describing whether the effort to interfere had had a material effect. That report, too, just gets delivered to Executive Branch officials.

Section 1. (a) Not later than 45 days after the conclusion of a United States election, the Director of National Intelligence, in consultation with the heads of any other appropriate executive departments and agencies (agencies), shall conduct an assessment of any information indicating that a foreign government, or any person acting as an agent of or on behalf of a foreign government, has acted with the intent or purpose of interfering in that election. The assessment shall identify, to the maximum extent ascertainable, the nature of any foreign interference and any methods employed to execute it, the persons involved, and the foreign government or governments that authorized, directed, sponsored, or supported it. The Director of National Intelligence shall deliver this assessment and appropriate supporting information to the President, the Secretary of State, the Secretary of the Treasury, the Secretary of Defense, the Attorney General, and the Secretary of Homeland Security.

(b) Within 45 days of receiving the assessment and information described in section 1(a) of this order, the Attorney General and the Secretary of Homeland Security, in consultation with the heads of any other appropriate agencies and, as appropriate, State and local officials, shall deliver to the President, the Secretary of State, the Secretary of the Treasury, and the Secretary of Defense a report evaluating, with respect to the United States election that is the subject of the assessment described in section 1(a):

(i) the extent to which any foreign interference that targeted election infrastructure materially affected the security or integrity of that infrastructure, the tabulation of votes, or the timely transmission of election results; and

(ii) if any foreign interference involved activities targeting the infrastructure of, or pertaining to, a political organization, campaign, or candidate, the extent to which such activities materially affected the security or integrity of that infrastructure, including by unauthorized access to, disclosure or threatened disclosure of, or alteration or falsification of, information or data.

The report shall identify any material issues of fact with respect to these matters that the Attorney General and the Secretary of Homeland Security are unable to evaluate or reach agreement on at the time the report is submitted. The report shall also include updates and recommendations, when appropriate, regarding remedial actions to be taken by the United States Government, other than the sanctions described in sections 2 and 3 of this order.

Predictably, when the deadlines for these reports came due after the mid-term elections last year, the Trump Administration balked at sharing all this reporting with the Senate Intelligence Committee.

Then there’s this NYT report revealing that the Mick Mulvaney told DHS Secretary Kirstjen Nielsen not to involve the Commander-in-Chief in any effort to keep this country’s elections safe, which (the report implicitly suggests) made it far more difficult for Nielsen to make protecting elections a priority.

Ms. Nielsen left the Department of Homeland Security early this month after a tumultuous 16-month tenure and tensions with the White House. Officials said she had become increasingly concerned about Russia’s continued activity in the United States during and after the 2018 midterm elections — ranging from its search for new techniques to divide Americans using social media, to experiments by hackers, to rerouting internet traffic and infiltrating power grids.

But in a meeting this year, Mick Mulvaney, the White House chief of staff, made it clear that Mr. Trump still equated any public discussion of malign Russian election activity with questions about the legitimacy of his victory. According to one senior administration official, Mr. Mulvaney said it “wasn’t a great subject and should be kept below his level.”

Even though the Department of Homeland Security has primary responsibility for civilian cyberdefense, Ms. Nielsen eventually gave up on her effort to organize a White House meeting of cabinet secretaries to coordinate a strategy to protect next year’s elections.

Ms. Nielsen grew so frustrated with White House reluctance to convene top-level officials to come up with a governmentwide strategy that she twice pulled together her own meetings of cabinet secretaries and agency heads. They included top Justice Department, F.B.I. and intelligence officials to chart a path forward, many of whom later periodically issued public warnings about indicators that Russia was both looking for new ways to interfere and experimenting with techniques in Ukraine and Europe.

A second senior administration official said Ms. Nielsen began pushing after the November midterms for the governmentwide efforts to protect the 2020 elections, but only after it became increasingly clear that she had fallen out of Mr. Trump’s favor for not taking a harder line against immigration.

That official said Ms. Nielsen wanted to make election security a top priority at meetings of Mr. Trump’s principal national security aides, who resisted making it a focus of the discussions given that the 2020 vote was, at the time, nearly two years away.

Trump’s refusal to protect elections accompanies a de-emphasis — one enforced by John Bolton — on cybersecurity generally.

This is, quite literally, a case where the Commander-in-Chief is refusing to take the action necessary to protect the country from being attacked in the same way were most recently were attacked.

Update: Earlier this week Politico reported on the effects of a reorganization in Office of Management and Budget’s cybersecurity office before Mulvaney left OMB to become Chief of Staff.

Few Americans may have heard of the Office of the Federal Chief Information Officer, but the unit inside the Office of Management and Budget coordinates tech improvements across the government, helping agencies boost cybersecurity and manage technology and cybersecurity budgets that totaled $105 billion in the past fiscal year.

But many OFCIO employees are overwhelmed by unclear and changing priorities, while others are simply checked out or feeling increasingly marginalized, according to an internal February staff survey that POLITICO obtained, along with data from an annual governmentwide report and interviews with a current OMB employee, five former OFCIO employees and three former senior federal officials familiar with the office.

The unit is grappling with “high turnover,” “a lot of infighting,” a “crushing workload” and “inaction from leadership,” said the current employee, who — like others interviewed for this story — requested anonymity to discuss sensitive personnel matters.

“Things do slip through the cracks,” the OMB employee said. OFCIO’s guidance “impacts the long-term implementation strategy out in the agencies,” and if that’s lacking, there will be “a debilitating effect on overall cybersecurity in the long run,” the person said, adding that there was “real concern at the staff level that if this continues, something bad will happen and we won’t be ready for it.”

“This organization looks like it’s in free fall,” said a former senior federal IT official who worked closely with the office.

[A] November reorganization appeared to cause significant confusion and discontent among employees. It replaced a structure built around three core units — agency oversight, cybersecurity and policy development — with one centered on “workstreams” for activities such as cybersecurity risk and data strategy.

But the reorganization was “built on the fly” and poorly explained, said a former staffer. More than 80 percent of survey respondents said it was unclear how the reorganization improved office communication.

Adding to these woes is significant frustration with OFCIO’s senior leaders, especially Kent, a former Ernst & Young consultant who took over the office in March 2018 after the team went more than a year without a leader.

Kent, who lacks a cybersecurity or IT background, has fostered “a closed-door culture,” the current OMB employee said.

It Is Objectively False that Trump Provided Unprecedented Cooperation; Stop Parroting Rudy Claiming He Did

If a President makes an expansive new claim to Executive Privilege and the press reports the opposite, did it really happen?

That’s a question presented by the coverage of yesterday’s news that after a year of resistance, President Trump finally provided the answers to his open book test to Mueller. That’s because a slew of journalists repeated Rudy Giuliani’s claim, made in his official statement, that Trump has provided “unprecedented cooperation” with Mueller’s team, without noting that the claim is objectively false.

I showed back in February — when the press first started parroting this claim credulously, which was first made by John Dowd — that it was not true.

A simple comparison of the Bush White House’s cooperation the CIA leak case, which investigated events that occurred in a more narrow period two month period of time, showed Dowd’s claim about cooperation on discovery and witnesses was overblown.

More importantly, a key detail distinguished George W Bush’s cooperation from Trump’s: Bush sat for an interview with Patrick Fitzgerald and answered questions about the orders he gave, while President, to at least one of his Assistants and the Vice President about an exclusive executive authority, declassification.

Bush sat for an interview in June 2004, and Cheney — who himself made some grossly false statements in his tenure — sat for one in May 2004 and a little-known follow-up that August. According to Cheney’s autobiography, “[T]he second session was conducted under oath so that [his] testimony could be submitted to the grand jury.”

[Randall] Samborn, the Fitzgerald spokesperson who was famously reticent during the whole CIA leak investigation, offered an expansive rebuttal to Dowd’s claim that this White House has offered unprecedented cooperation. “Trump’s team can claim all the cooperation it wants, and whether justifiably so or not, it seems to me that it all gets negated, if at the end, he personally refuses to be questioned when so much substance depends on what he knew and did, as well as his state of mind.”

Any refusal to sit for an interview, Samborn said, was central evaluating the level of cooperation.

“That’s sort of the ultimate in noncooperation,” he explained, “especially after saying he looks forward to being interviewed and under oath.”

By limiting his cooperation to an open book test, Trump has stopped far short of the cooperation Bush offered.

And yet, because Rudy included the claim in the statement he released to the press, many news outlets are repeating that false claim, uncontested. The outlets that subscribe to the AP feed are propagating false claim today, because Eric Tucker repeated that line from Rudy’s statement with no correction to it.  Unsurprisingly, Fox News parroted Rudy. But so did some more credible outlets, like NBC, ABC, CNN, and Reuters. Even the WaPo’s otherwise superb report from Carol Leonnig and Robert Costa repeated the claim in the last line of their story.

NYT’s Maggie and Mike, incidentally, avoided repeating Rudy’s claim, choosing to include the part of his statement that provided quasi-factual numbers, but leaving out the superlative claim.

It’s bad enough that most of the press has repeated Rudy and Dowd’s claim uncritically since January. But for yesterday’s stories, it is all the more important to get it right. That’s because Trump is not just refusing to answer questions on Mueller’s obstruction investigation, he’s also refusing to answer questions about the transition period, before any claim of Executive Privilege should kick in. While that’s consistent with what Trump did with Hope Hicks’ and Corey Lewandowski’s testimony to the House Intelligence Committee, it nevertheless represents an expansion of accepted claims to executive power.

The emphasis, here, should be on Trump’s claim to be above the law even before he took an oath to protect and defend the Constitution.

Instead, a bunch of copy and paste journalism has made it the opposite.

On Corey Lewandowski’s Big Legal Bills and Mueller’s Deadline from Rosenstein

Quarterly political spending reports are out and they provide some hints about which current or former Trump aides have been spending a lot of time with Mueller’s investigators. The NYT reported the other day that the Trump campaign has paid $173,000 in the past quarter to the law firm representing Corey Lewandowski.

The campaign also paid $173,000 to Mintz Levin, a law firm that has helped Mr. Trump’s first campaign manager, Corey Lewandowski, handle inquiries related to the Russia investigations.

The suggestion that Lewandowski has spent quality time with Mueller’s team of late is particularly interesting, for several reasons. First, Lewandowski had a number of key interactions with George Papadopoulos regarding the outreach from Russia, including drafting Trump’s first foreign policy speech, which Papadopoulos reportedly told Ivan Timofeev was a sign that the campaign was interested in pursuing a Trump-Putin meeting.

“to discuss Russia’s interest in hosting Mr. Trump. Have been receiving a lot of calls over the last month about Putin wanting to host him and the team when the time is right.”

June 19: Papadopoulos to Lewandowski

“New message from Russia”: “The Russian ministry of foreign affairs messaged and said that if Mr. Trump is unable to make it to Russia, if campaign rep (me or someone else) can make it for meetings? I am willing to make the trip off the record if it’s in the interest of Mr. Trump and the campaign to meet specific people.”

Lewandowski was also the person that the House Intelligence Committee treated most curiously. HPSCI originally interviewed him in January, during the phase when HPSCI seemed to be interviewing key witnesses to be able to pass on to Trump how they would testify. At that point, Mueller had not yet contacted Lewandowski.

Even though Lewandowski never worked in the Administration, in that first appearance with HPSCI, he invoked privilege over parts of his testimony. On March 8, HPSCI brought him back, the very last witness in their so-called investigation. After his three hour appearance, Adam Schiff discussed subpoenaing Lewnadowski to compel him to answer questions he had still refused to answer (Schiff had also demanded HPSCI compel full testimony from Hope Hicks). In the same discussion of compelling Lewandowski to answer questions,  Schiff suggested the committee should subpoena Stephen Miller.

After Lewandowski’s testimony had wrapped, Schiff raised a new name he wanted to speak to: White House aide Stephen Miller.

Which is curious because WSJ reports that the legal defense fund supporting specific former campaign staffers paid Akin Gump $115,000.

The fund directed most of its third-quarter spending to legal consulting, paying nearly $115,000 to the law firm Akin Gump Strauss Hauer & Feld LLP and another $8,500 to Schertler & Onorato LLP. The latter firm has represented Keith Schiller, Mr. Trump’s longtime bodyguard who was interviewed by the House Intelligence Committee as part of its Russia investigation.

It’s not publicly known which former campaign staffer Akin Gump represents, but two of the few key Trump people whose lawyers have not been publicly identified are Brad Parscale (though the campaign would probably pay for his legal defense at this point) and Miller.

Miller is the person whom Papadopoulos has said he would have told about the Russian offer of emails had he actually connected by phone the day he learned of it.

Meanwhile, Bloomberg reports (possibly based on Congressional sources) that Mueller is preparing to offer “reports” on his investigation.

Mueller is close to rendering judgment on two of the most explosive aspects of his inquiry: whether there were clear incidents of collusion between Russia and Donald Trump’s 2016 campaign, and whether the president took any actions that constitute obstruction of justice, according to one of the officials, who asked not to be identified speaking about the investigation.

Rosenstein has made it clear that he wants Mueller to wrap up the investigation as expeditiously as possible, another U.S. official said.

This is actually not at all surprising. Trump is going to start firing people after the election, so Mueller’s ability to work unimpeded may be dramatically curtailed shortly after that. If he’s going to bring a big indictment, he has to do so in that time frame. Plus, after securing Paul Manafort and Michael Cohen’s cooperation, he has cooperating witnesses on all the elements of a conspiracy Mueller had identified by last March, not to mention slam dunk obstruction charges tied to floated pardons. Everyone is scheduled to start being sentenced after the election, too. With the hints he has gotten extensive Lewandowski testimony (and reports that he had obtained far more documentation pertaining to Don Jr’s actions), it would suggest that Mueller has at least tracked the game of telephone between Russians offering emails to the candidate anxious to accept that offer.

So this tells us what we might expect: the denouement of the Mueller investigation will happen, unless Trump works to undercut it, just after the election.

Update: In their plan for further investigation released in March, HPSCI Dems described that in his second committee appearance Lewandowski refused, “to answer questions regarding his communication with President Trump regarding former FBI Director Comey, Special Counsel Mueller, and Attorney General Sessions, as well as his communications with certain administration officials pertaining to the June 9, 2016 meeting at Trump Tower.” So it sounds like he’s also got evidence pertaining to the June 9 meeting.

Paul Manafort Is One of 37 People in an Omertà with the President

Apparently, Bob Woodward committed some journalism along with canonizing racist John Kelly and wife-beater Rob Porter in his book: he got a number for how many people are included the Joint Defense Agreement that gives Rudy Giuliani such confidence the President is not at risk: 37.

And Politico committed still more journalism and answered the question we’ve all been asking: yes, Paul Manafort is among those 37.

Giuliani also confirmed that Trump’s lawyers and Manafort’s have been in regular contact and that they are part of a joint defense agreement that allows confidential information sharing.

“All during the investigation we have an open communication with them,” he said. “Defense lawyers talk to each other all the time where as long as our clients authorize it therefore we have a better idea of what’s going to happen. That’s very common.”

Giuliani confirmed he spoke with Manafort’s lead defense lawyer Kevin Downing shortly before and after the verdicts were returned in the Virginia trial, but the former mayor wouldn’t say what he discusses with the Manafort team. “It’d all be attorney-client privilege not just from our point of view but from theirs,” he said.

That means when John Dowd complained that the raid of Manafort’s condo (where his eight iPods were seized), that was based on privileged conversations between lawyers. And when, in January, Trump confidently said he was sure Manafort would protect him, that was based on privileged conversations between lawyers.  And when, just before the EDVA trial, Kevin Downing was ostentatiously saying there was no way Manafort was flipping, and when he was balking on a plea with Mueller immediately after the trial, he was also talking to Rudy Giuliani.

Mind you, Rudy G will learn right away if Manafort starts considering cooperating, rather than just pleading, because Manafort will have to (finally!) drop out of the JDA before those discussions start.

And while I suspect Mueller has slowly been peeling away people like Sam Patten, that the JDA is so big likely means some or most of the following people are part of the omertà (and Michael Cohen, Rick Gates, and Mike Flynn were part of it):

  • Paul Manafort and Konstantin Kilimnik
  • Jared Kushner
  • The Trump Org defendants: Don Jr, Rhonna Graff
  • Bill Burck’s clients: Steve Bannon, Reince Priebus, Don McGahn (and up to three more)
  • Victoria Toensing’s clients: Mark Corallo, Erik Prince, Sam Clovis
  • The hush payment recipients: Hope Hicks, Brad Parscale, Keith Schiller
  • Roger Stone and his buddies: Stone, Michael Caputo, Sam Nunberg, Andrew Miller, plus some (probably)

That’s 20. Some other likely (and enticing) JDA members are: Devin Nunes, Jeff Sessions, Tom Barrack, Keith Kellogg, John Mashburn, KT McFarland, JD Gordon, Walid Phares, Stephen Miller, Sean Spicer, Rob Porter, Corey Lewandowski, John Kelly. Heck, it’s not even clear that George Papadopoulos is not part of the JDA.

But that still leaves space in the JDA for people who were already comparing notes with known members of the JDA, including Rinat Akhmetshin, Rob Goldstone, and Ike Kaveladze (along with Emin and Aras Agalarov, who are all represented by Scott Balber).

No wonder Rudy thinks he knows everything that Mueller has.

That’s why the collective panic on the discovery that Stone’s phone was likely among the ~10 or so that Mueller got warrants for in the wake of Rick Gates’ cooperation agreement is so interesting, and also why Manafort, playing his part as point, tried so hard to find out who the other four AT&T users whose phones were obtained with his own.

These guys may be good at omertà. But every single one we’ve seen so far has shitty OpSec; they’ve been saying their co-conspiracy communications on their phones and on iCloud. Plus there are people like Omarosa wandering among them, dismissed as irrelevant even while they record everything they hear. And meanwhile, Mueller is chipping away at the edges, people they haven’t considered (like Patten). And all the while he’s been building his case against Stone and Don Jr.

Those Sexy Details in the Papadopoulos Sentencing Memo Aren’t Intended for Your Consumption

In this post, I argued that George Papadopoulos’ sentencing memo was written to make a case to Donald Trump for a pardon, not to judge Randolph Moss for no prison time (even though that’s what he asks for).

It would follow logically, then, that the details of his testimony Papapdopoulos chose to highlight in a claim that “George provided investigators with critical information” — details that have attracted much of the press coverage of this memo — also aren’t intended for our benefit, but for Trump and other co-conspirators.

Jeff Sessions lies as much as “young George” Papadopoulos

Consider the one that has attracted the most attention, revealing that (according to Papadopoulos), he told the government that Trump approved of his plan to pursue a meeting with Putin and — even more importantly — Jeff “Sessions … appeared to like the idea.”

On March 31, 2016, he joined Mr. Trump, Senator Jeff Sessions, and other campaign officials for a “National Security Meeting” at the Trump Hotel. George’s photograph at this meeting flashed around the world via Twitter. Eager to show his value to the campaign, George announced at the meeting that he had connections that could facilitate a foreign policy meeting between Mr. Trump and Russian President Vladimir Putin. While some in the room rebuffed George’s offer, Mr. Trump nodded with approval and deferred to Mr. Sessions who appeared to like the idea and stated that the campaign should look into it.

At a minimum, after 11 months of being prevented from sharing this detail, including it here tells all the other co-conspirators what Papadopoulos said. The allegation is not new; at least two other participants in the meeting offered a similar version to Reuters in March (and presumably to the FBI before that). Still, Papadopoulos provides the detail in such a way and at such a time that it’s sure to generate pressure on Sessions, just as Trump is trying to convince Republican members of Congress he should fire the Attorney General. Not to mention that Papadopoulos raises an example of a person who has thus far avoided all consequences for lying in official settings.

The offer of emails came during a discussion finalizing a meeting

An even more delicious mention is the specific description Papadopoulos gives of the meeting at which Joseph Mifsud told him the Russians had Hillary emails they planned to release to help Trump.

George strived to organize a meeting with the Russian government and help the Trump campaign promote its foreign policy objective: improve U.S. and Russian relations. He believed that such a meeting would be a boon for the campaign as Mr. Trump had not yet hosted any major foreign policy events with officials from other countries.

George joined Professor Mifsud for breakfast in London on April 26, 2016, with the intention of finalizing plans for the foreign policy meeting. It was during this breakfast meeting, however, that Professor Mifsud told George that individuals in Moscow possessed “dirt” on candidate Hillary Clinton in the form of “thousands of emails.” Not knowing what to make of this comment, George continued his efforts to make the Trump – Russia meeting a reality. [my emphasis]

Papadopoulos’ statement of the offense had made it clear that Mifsud mentioned the emails in the context of Papadopoulos’ efforts to set up a meeting.

On or about April 25, 2016, defendant PAPADOPOULOS emailed [Stephen Miller — see this story confirming Miller as the “Senior Policy Advisor” in the document]: “The Russian government has an open invitation by Putin for Mr. Trump to meet him when he is ready []. The advantage of being in London is that these governments tends to speak more openly in “neutral” cities.

On or about April 26, 2016, defendant PAPADOPOULOS met the Professor for breakfast at a London hotel. During this meeting, the Professor told defendant PAPADOPOULOS that he had just returned from a trip to Moscow where he had met with high-level Russian government officials. The Professor told defendant PAPADOPOULOS that on that trip he (the Professor) learned that the  Russians had obtained “dirt” on then-candidate Clinton. The Professor told defendant PAPADOPOULOS, as defendant PAPADOPOULOS later described to the FBI, that “They [the Russians] have dirt on her”; “the Russians had emails of Clinton”; “they have thousands of emails.”

[T]he day after his meeting at the hotel with the Professor, on or about April 27, 2016, defendant PAPADOPOULOS emailed [Miller]: “Have some interesting messages coming in from Moscow about a trip when the time is right.”

Also on or about April 27, 2016, defendant PAPADOPOULOS emailed a [Corey Lewandowski] “to discuss Russia’s interest in hosting Mr. Trump. Have been receiving a lot of calls over the last month about Putin wanting to host him and the team when the time is right.”

The Schiff memo and Alexander Downer have subsequently added the detail that Mifsud specifically told Papadopoulos that, “the Russians might use material that they have on Hillary Clinton in the lead-up to the election, which may be damaging,” to assist Trump’s campaign.

Remember, Papadopoulos worked with Lewandowski to draft Trump’s first foreign policy speech, delivered on April 27, which Papadopoulos reportedly told Ivan Timofeev (whose entire existence Papadopoulos’ lies had managed to hide from the FBI at first) was a signal to meet. That speech included these lines:

I believe an easing of tensions, and improved relations with Russia from a position of strength only is possible, absolutely possible. Common sense says this cycle, this horrible cycle of hostility must end and ideally will end soon. Good for both countries.

Some say the Russians won’t be reasonable. I intend to find out. If we can’t make a deal under my administration, a deal that’s great — not good, great — for America, but also good for Russia, then we will quickly walk from the table. It’s as simple as that. We’re going to find out.

Obviously, the tie between Russia releasing stolen emails and foreign policy meetings was always implicit. But Papadopoulos has just revealed that Mifsud said Russia might release emails in the context of setting up a meeting, after having floated such a meeting with Miller the day before.

The breakfast meeting ties the release of the stolen emails to help the Trump campaign and foreign policy meetings together directly. And having just sat through such a meeting, Papadopoulos worked with Stephen Miller and Corey Lewandowski to send a message to Russian that Trump was willing to meet — and would pursue improved relations with Russia.

Papadopoulos tells the Greeks of the dirt offer just in time to pass Putin a message

I’m most interested, however, in the inclusion of Papadopoulos’ admission he told the Greek Foreign Minister about the Russian offer of dirt just before Putin came to town on May 27, 2016.

George provided investigators with critical information. George told investigators about his interactions and meetings with other members of the campaign. He detailed a meeting in late May 2016 where he revealed to the Greek Foreign Minister that the Russians had “dirt” on Hillary Clinton. He explained that this meeting took place days before President Vladimir Putin traveled to Greece to meet with Greek officials.

Remember, Natalia Veselnitskaya dates the idea for the June 9 meeting to a conversation she had with Aras Agalarov at “the end of May” 2016.

Around the end of May 2016, during a conversation with a good acquaintance of mine, being my client, Aras Agalarov on a topic that was not related to the United States, I shared the story faced when defending another client, Denis Katsyv, about how terribly misled the US Congress had been by the tax defrauder William Browder, convicted in Russia, who, through his lobbyists and his close-minded rank-and-file Congress staffers, succeeded in adopting the Act in the name of a person whom Browder practically hardly ever knew. I considered it my duty to inform the Congress people about it and asked Mr. Agalarov if there was any possibility of helping me or my colleagues to do this. I do not remember who of us was struck by the idea that maybe his son could talk about this with Donald Trump, Jr., who, although a businessman, was sure to have some acquaintances among Congress people.

But it’s not just the tantalizing possibility that Papadopoulos left some kind of message for Putin just before Aras Agalarov started setting up the June 9 meeting.

Papadopoulos’ statement of the offense describes him emailing Paul Manafort about Russia’s desire to set up a meeting, which Manafort forwarded to the government’s most important now cooperating witness, Rick Gates, telling him that the candidate wasn’t going to do such meetings himself — someone else in the campaign would.

On or about May 21, 2016, defendant PAPADOPOULOS emailed another high-ranking Campaign official, with the subject line “Request from Russia to meet Mr. Trump.” The email included the May 4 MFA Email and added: “Russia has been eager to meet Mr. Trump for quite sometime and have been reaching out to me to discuss.”2

2 The government notes that the official forwarded defendant PAPADOPOULOS’s email to another Campaign official (without including defendant PAPADOPOULOS) and stated:

“Let[‘]s discuss. We need someone to communicate that DT is not doing these trips. It should be someone low level in the campaign so as not to send any signal.”

The House Intelligence Majority Report, however, reveals that that Papadopolous sent that email from Greece.

(U) While on a trip to Athens, Greece in May 2016, Papadopoulos sent an email to Manafort stating that he expected to soon receive “an official invitation for Mr. Trump to visit Greece sometime this summer should his schedule allow.”183 In the same email to Manafort, Papadopoulos also forwarded a meeting Invitation from Ivan Timofeev, Director or [sic] Programs for the Russian International Affairs Council, and claimed that “Russia has been eager to meet Mr. Trump for quite sometime and have been reaching out to me to discuss. thought it would be prudent to send to you.”184

(U) As of May 2016, Manafort had not yet been elevated to campaign chairman, but had a long track record of work abroad. Manafort forwarded Papadopoulos’ email to his business and campaign deputy [Rick Gates] noting that we need someone to communicate that D[onald] T[rump] is not doing these trips.” 185 Manafort and [Gates] agreed to assign a response of a “general letter” to “our correspondence coordinator.” the person responsible for “responding to all mail of non-importance.”186

While it’s clear nothing in that email could have reflected a discussion of passing a message to Putin via Papadopoulos’ Greek contacts, it does show that Papadopoulos used the opportunity of a verbal offer from Greece to raise a Russian meeting with Manafort directly. Manafort responded by saying other campaign aides would do such meetings. Papadopoulos then somehow saw reason to tell Greece’s Foreign Minister that the Russians were offering dirt to help Trump just before Putin arrived. And that’s precisely the timeframe when the June 9 meeting setting up a Russian meeting with Trump’s senior-most campaign officials, including Manafort, got born.

Maybe it’s all a big fat coinkydink, but Papadopoulos seems to believe it important enough to tell all his co-conspirators (even while it makes his repeated claims not to have told the campaign itself laughable), possibly because he knows the FBI has evidence from the Greeks as well.

As I disclosed in July, I provided information to the FBI on issues related to the Mueller investigation, so I’m going to include disclosure statements on Mueller investigation posts from here on out. I will include the disclosure whether or not the stuff I shared with the FBI pertains to the subject of the post. 

Devin Nunes Confirms Classified Information that “Henry Greenberg” Wasn’t Working for the FBI, and Other Tales of the Half-Wit Running our Intelligence Oversight

As I’ve been chronicling, Devin Nunes continues his effort to invent some reason to fire Rod Rosenstein. As part of his last extortion attempt, Nunes demanded information he thought would reveal that “Henry Greenberg,” a Russian offering dirt on Hillary Clinton, was secretly working for the FBI.

How did you use our nation’s counterintelligence capabilities. These are capabilities used to track terrorists and other bad guys around the globe. How did you weaponize that against a political campaign, against the Trump campaign, where ultimately it ended up in Carter Page having a FISA warrant put against him which allowed the government to go in and grab all of his emails and phone calls. So that’s primarily what we’ve been investigating for many many months. I will tell you that Chairman Gowdy was very very clear with the Department of Justice and FBI and said that if there was any vectoring of any informants or spies or whatever you want to call them into the Trump campaign before the investigation began, we better know about it by Sunday, meaning today. He was very very clear about that. And as you probably know there’s breaking news this morning that now you have a couple Trump campaign people who are saying that they were, that they’ve amended their testimony before the House Intelligence Committee, they sent in both Friday night and this morning, amendments to their testimony saying that in fact they feel like somebody, they’re not claiming that it was the FBI, but someone ran informants or spies into them to try to get information and offer up Russian dirt to the Trump campaign. Now this would have been in May of 2016. Which is obviously months before this counterintelligence investigation was opened by the FBI into the Trump campaign.

If I were them I would pick up the phone and let us know what this is about, this story that broke in the Washington Post, this morning, just hours ago. They probably ought to tell us whether or not they were involved in that or else they have a major major problem on their hands.

Last Friday, DOJ and FBI had provided most of the documents requested, pending a few technical issues and a review by Dan Coats of some intelligence equities. Included among those was a classified letter telling Nunes whether FBI used informants against the Trump campaign.

On June 22, 2018, the FBI submitted a classified letter to the Committee responding to the Chairman’s question regarding whether, in connection with the investigation into Russian activities surrounding the 2016 Presidential election, the FBI utilized confidential human sources prior to the issuance of the Electronic Communication (EC) initiating that investigation.

That answer clearly didn’t feed Nunes’ Witch Hunt conspiracies, so he’s reformulating his request, apparently certain that if he keeps trying he’ll discover the vast (yet totally ineffective) Deep State plot to undermine the Trump campaign. He’s asking for contacts not just between informants, but also undercover agents or confidential human sources who interacted with any of 14 Trump campaign associates.

The new request seeks information not only on “FBI informants,” but also on “undercover agents, and/or confidential human sources” who interacted with former Trump associates before July 31, 2016 — the start of the FBI’s counterintelligence investigation into connections between the Trump campaign and Russia.

The list of Trump associates Nunes indicated he’s interested in includes: Michael Caputo, Sam Clovis, Michael Cohen, Michael Flynn, Corey Lewandowski, Stephen Miller, Peter Navarro, Sam Nunberg, George Papadopoulos, Carter Page, Walid Phares, Joseph Schmitz, Roger Stone and Donald Trump Jr.

It’s a really awesome request. Aside from confirming the content of that classified letter (among other things, that “Henry Greenberg” wasn’t our intelligence asset when Roger Stone entertained offers of Hillary dirt), Nunes has given us a list of campaign associates who should be criminally investigated:

  • Corey Lewandowski
  • Stephen Miller
  • Peter Navarro
  • Sam Nunberg
  • George Papadopoulos

Notably, a number of these people — Caputo, Cohen, Lewandowski, Miller, Stone, and Navarro — aren’t on the list of document requests Mueller had submitted to the White House by January. Perhaps for the first three plus Stone, that’s because they never worked in the White House (and in the case of Caputo and Stone, pretended not to work for the campaign so as to give the campaign plausible deniability from the rat-fucking).

Nevertheless, their inclusion here seems to confirm that Nunes believes they are targets or at least subjects of Mueller’s investigation. Of those not on Mueller’s January list, we know that Stone and Cohen are in deep shit, so maybe the others are too!

Thanks Devin! Let’s hope leaking that classified information doesn’t get you in trouble with your colleagues, though.

A pity for the guy running our intelligence oversight that he can’t figure out that a number of these targets came from Rick Gates flipping, and not informants planted way back in May 2016.

Paul Manafort Wasn’t the “Campaign Boss” (Yet) during the June 9 Meeting

Someday soon I’ll be done reviewing the June 9 meeting materials. But as I’m revising my limited hangout post on it, I keep finding details I want to pull out.

When Don Jr told Rob Goldstone on June 7, 2016 who would attend the June 9 meeting, he said it’d be “Paul Manafort (campaign boss) my brother in law and me.”

Now, it is true that Trump had named Manafort campaign chairman on May 19, as it became clear the reason he was ostensibly hired — to managed a contested convention — would not be necessary in the light of Trump sealing his win. That set off a month of in-fighting between Manafort and Lewandowski, ultimately leading to Lewandowski’s firing — with the very active input of Trump’s children — on June 20.

I find that interesting for two reasons. First, Roger Stone and Sam Nunberg had a role in making Manafort’s case publicly, though neither was associated with the campaign anymore. Mueller has reportedly shown some interest in meetings that took place during this period. In other words, the process by which Manafort (temporarily) won the battle for Trump’s affection may be an investigative interest.

The detail is also interesting because that’s how Don Jr (implausibly) explains his enthusiastic response to Goldstone’s offer of information that would incriminate Hillary: “if it’s what you say I love it especially if it’s later in the summer.” Don Jr explained that he was busy ousting Lewandowski at the time, which is why they didn’t want dirt in June, but instead later in summer, when it came out.

Q. And in your response it says “If it’s what you say, I love it, especially later in the summer.” Specifically what did you love about it?

A . As I said in my statement, it was a colloquial term used to say, hey, great, thank you. I didn’t want to deal with anything right now. We had other stuff we had to worry about, namely a potential contested convention. We were in the process of replacing Corey Lewandowski, who was the campaign manager, with Paul Manafort. There was a lot of stuff on our plate.

On top of being totally unconvincing, Don Jr’s response is inconsistent with his response to Goldstone, which treated Manafort as the boss already.

Steve Bannon has suggested that the June 9 meeting happened because Don Jr was vying to impress his dad even as Jared assumed a greater role in the campaign. But I think at least possible–particularly given the way the Trump team tried to downplay Manafort’s role in the meeting–that the meeting happened because Manafort was vying for power with Corey Lewandowski.

Why Was Paul Manafort Fired?

In an attempt to sow outrage because the lifetime Republican Stefan Halper asked Carter Page and George Papadopoulos some questions, the frothy right is now focusing on why DOJ didn’t tell Donald Trump his campaign, the one that asked all manner of people to work for “free,” was infested with suspected foreign assets. They point to this passage in the GOP House Intelligence Report to suggest that if only DOJ had told Trump which of the suspected assets in his campaign they knew about, he would have fired them.

The Trump campaign did not receive a general counterintelligence briefing until August 2016, and even then, it was never specifically notified about Papadopoulos, Page, Manafort, or General Flynn’s Russia ties. 1o.; Further, the counterintelligence briefing provided to Trump and his top advisors did not identify any individuals by name, but rather focused on the general threat posed by adversaries, including Russia and China.

The suggestion that Trump would have fired these men is mostly without merit — after all, after President Obama gave Trump very specific warnings about Mike Flynn, Trump promoted him to oversee all of national security.

Moreover, these frothy defenders of individual liberty are effectively demanding that some kind of Nanny Running Mate do the vetting that — as the HPSCI report also admits — Trump never did.

While the Committee will not go into further detail on the charges against Manafort due to ongoing litigation concerns, Special Counsel Mueller’s indictment of Manafort illustrates the necessity for U.S. presidential campaigns to better investigate individuals who serve in senior positions within the campaign. If the accusations against Manafort are true, he should have never served as a senior official with a campaign for the U.S. presidency, much less campaign chairman or manager.

I mean, sure, DOJ could have done the vetting of Trump’s “free” staffers that the billionaire candidate refused to do, but it would have involved the kind of review of communications and balance sheets that Trump would call “Spying,” and it’d be much more intrusive “Spying” than asking lifetime GOP operative Halper to ask a few questions.

All that said, particularly giving how it took place the day after Trump’s first intelligence briefing on August 17, I am increasingly interested in the campaign’s decision to fire Paul Manafort. Here’s how the GOP House Intelligence Report spins it.

Then-campaign manager[Corey Lewandowski] testified that, when Manafort was hired, [redacted] made no attempt to vet him and was entirely unaware of Manafort’s past work in Ukraine.85 In May 2016, Manafort was promoted to campaign chairman and, after [Lewandowski] was fired the next month, “evolve[d]” into the role of de facto campaign manager.89

(U) Manafort left the campaign in August 2016 following news reports that he had received $12.7 million In secret payments for his work on behalf of Yanukovich’s Party of Regions; news reporting also alleged that Manafort and his aide Rick Gates had “directly orchestrated a covert Washington lobbying operation” on behalf of the party–while failing to register 90 as foreign agents. Campaign press secretary Hope Hicks recalled that, after receiving press inquiries about Manafort’s “professional history,” a major story broke91 on the evening of August 14, 2016. According to Hicks, “Trump had made a decision to make a change in leadership on the campaign outside of Paul’s issues that were being publicly reported,” but those issues “certainly contributed to expediting and intensifying the way in which his role changed, and then ultimately he was fired at the end of that week.”92 Trump directed his son-in-law Jared Kushner to ensure Manafort departed the campaign on August 19, which he did.93 As Kushner put it, ”[t]here was a lot of news that was out there and the decision was that it was time for him to resign.”

But here’s the story as told by Don Jr in his admittedly demonstrably false testimony to the Senate Judiciary Committee.

Q. And returning briefly to Mr. Manafort, what was your understanding of how Mr. Manafort ceased to be affiliated with the campaign?

A. I believe there was stuff coming out about Paul that he denied, but he didn’t want to drag any other aspects of that life into the campaign and the work that we were doing. So he removed himself from his position as campaign chairman.

Q. And did he discuss with you or, to the best of your knowledge, anyone else on the campaign his ties with Ukrainian business or Russian interests, his alleged ties?

A. No, not that I recall.

Now, these are not entirely inconsistent stories. In both versions, when Manafort’s ties to Yanukovych became a liability, he was ousted. Though if Manafort’s ties to Ukraine were the primary problem, then Rick Gates should have been ousted at the same time, and he not only remained on the campaign, but stayed on through the inauguration, helping Tom Barrack sell foreigners (including, but not limited to, wealthy Russians) inauguration access.

But, for starters, I find it absurd to suggest that Manafort was ousted because of allegations about his ties to Russia and Ukraine, but that he never spoke about that with the family. You might argue that Don Jr just remained ignorant of the details, but Trump’s spawn, including Don Jr., were instrumental in ousting Lewandowski and elevating Manafort in the first place, so I find it doubtful Manafort would in turn be ousted without their feedback. Indeed, Jared’s reported role in the firing makes it clear he, at least, was centrally involved.

So I find Junior’s claim that he didn’t discuss his Ukrainian and Russian ties just as dubious as these other answers.

Q. Are you aware of any ties, direct or indirect, past or present, between Mr. Manafort and the Russian government?

A. I’ve read that since, but I’m not aware of anything specific, no.

Q. Were you aware of Mr. Manafort’s relationship with and work on behalf of Viktor Yanukovych?

A. Again, I’ve heard that since, but not at the time, no.

Q. Do you know Konstantin Kilimnik?

A. Not that I’m aware of.

Plus — something that always gets forgotten in this timeline — between the time the most damning NYT story came out, the time Trump got his first intelligence briefing on August 17 and the day Trump fired Manafort on August 19, he demoted him, also on August 17, putting Steve Bannon and Kellyanne Conway in charge.

Donald Trump, following weeks of gnawing agitation over his advisers’ attempts to temper his style, moved late Tuesday to overhaul his struggling campaign by rebuffing those efforts and elevating two longtime associates who have encouraged his combative populism.

Stephen Bannon, a former banker who runs the influential conservative outlet Breitbart News and is known for his fiercely anti-establishment politics, has been named the Trump campaign’s chief executive. Kellyanne Conway, a veteran Republican pollster who has been close to Trump for years, will assume the role of campaign manager.

Trump issued a statement hours later. “I have known Steve and Kellyanne both for many years. They are extremely capable, highly qualified people who love to win and know how to win,” he said. “I believe we’re adding some of the best talents in politics, with the experience and expertise needed to defeat Hillary Clinton in November and continue to share my message and vision to Make America Great Again.”

Trump’s stunning decision effectively ended the months-long push by campaign chairman Paul Manafort to moderate Trump’s presentation and pitch for the general election. And it sent a signal, perhaps more clearly than ever, that the real estate magnate intends to finish this race on his own terms, with friends who share his instincts at his side.

Manafort, a seasoned operative who joined the campaign in March, will remain in his role, but the advisers described his status internally as diminished due to Trump’s unhappiness and restlessness in recent weeks over his drop in the polls and reports over lagging organization in several key states. He told some friends that he was unsure if he was being given candid assessments of news stories and the campaign’s management.

While Trump respects Manafort, the aides said, he has grown to feel “boxed in” and “controlled” by people who barely know him. Moving forward, he plans to focus intensely on rousing his voters at rallies and through media appearances.

Even after the NYT black ledger story, Manafort was being portrayed as a moderating influence in Trump’s campaign. Reports about Manafort’s firing focus more on his treatment of Trump as a child than on his corruption. Even the NYT’s coverage of the firing, in the wake of their blockbuster black ledgers story, minimized the import of that on his ouster, waiting until the very last paragraphs of a long article to describe how the stories led to his loss of support among his kids, especially Jared.

At the same time, the new accounts of Mr. Manafort’s ties to Ukraine quickly eroded the support that he had from Mr. Trump’s family during his earlier battles with Mr. Lewandowski.

According to people briefed on the matter, Jared Kushner, Mr. Trump’s son-in-law, expressed increasing concern after a Times article published on Sunday about allegations of cash payments made to Mr. Manafort’s firm for his work on behalf of his main client, Viktor F. Yanukovych, the former Ukranian president, who is an ally of Mr. Putin.

Mrs. Clinton’s campaign has repeatedly sought to yoke Mr. Trump to Mr. Putin, citing Mr. Trump’s praise for the Russian leader. And the avalanche of stories about his work for pro-Russian entities in Ukraine were becoming untenable for the campaign, according to people briefed on the discussions.

“The easiest way for Trump to sidestep the whole Ukraine story is for Manafort not to be there,” said Newt Gingrich, the former House speaker who has become a counselor to Mr. Trump.

In North Carolina on Thursday, Mr. Trump was informed of the newest such report: an Associated Press article that, citing emails, showed that Mr. Manafort’s firm had orchestrated a pro-Ukrainian lobbying campaign in Washington without registering as a foreign agent.

That was enough, according to people briefed on the calls, for Mr. Trump to call Mr. Bannon and Ms. Conway.

I raise this for two reasons. First, retaining Gates while firing Manafort shows that the concern about Russian ties was only PR, at best. I admit when I first started writing this, I thought firing Manafort might have been a reaction against his willingness to chum up to Russia, possibly up to and including sharing information via Kilimnik with Oleg Deripaska. I believe that at various times in the Trump campaign, he tried to get out of the devil’s bargain he made with Russia, and entertained the possibility that firing Manafort was one of those efforts. But the retention of Gates makes that unlikely.

All that said, Don Jr’s explanation, like his father’s, are convenient post hoc justifications (though this Corey Lewandowski story, which relies on Steve Bannon’s, has the same emphasis).

Still, I find the coincidence of the decision to fire Manafort and that first briefing to be interesting. Did the warning that Russia was attempting to infiltrate his campaign make him more sensitive to Manafort’s burgeoning Russia scandal?

One way or another, I’d love to revisit the events of that week to measure how much Trump and Junior — as distinct from Jared — cared about Manafort’s ties with Russia.
