January 6 Defendants Succeed in Proving They Were Treated Better than Other DC Detainees

As I’ve noted, because of Christopher Worrell’s claims he has been denied medical treatment (many claims of which don’t match his own medical record), Royce Lamberth held the Warden and the Director of the DC jail in contempt, leading to a Civil Rights Division investigation.

I’ve also noted Nate DeGrave’s fantastic complaints about jail conditions, including that he has to eat baloney sandwiches.

Yesterday, the Marshal Service revealed that, seemingly in response to Lamberth’s Worrell order, it did unannounced visits at several DC jail facilities. It determined that one DC jail facility was not fit to house inmates.

But that was the other DC jail facility — not the more modern one where all the January 6 defendants are housed.

The USMS inspection was prompted by recent and historical concerns raised regarding conditions at the DC DOC facilities, including those recently raised by various members of the judiciary.

The inspection encompassed two DC DOC housing facilities – the Central Treatment Facility (CTF) and the Central Detention Facility (CDF). During the unannounced inspection, the U.S. Marshal reviewed both housing facilities and conducted more than 300 voluntary interviews with detainees.

The U.S. Marshal’s inspection of CTF did not identify conditions that would necessitate the transfer of inmates from that facility at this time. CTF houses approximately 120 detainees in the custody of the USMS, including all the defendants in pre-trial custody related to alleged offenses stemming from events that took place on January 6 at the U.S. Capitol, as well as other federal detainees. Housing assignments for detainees are determined by the DC DOC.

The U.S. Marshal’s inspection of CDF revealed that conditions there do not meet the minimum standards of confinement as prescribed by the Federal Performance-Based Detention Standards. CDF houses approximately 400 detainees in the custody of the USMS.

Too be clear: The conditions the January 6 defendants are held in are still inadequate, at least with respect to their access to discovery and the limits on video conference rooms (which limit how quickly judges can schedule hearings, one of Judge Lamberth’s underlying complaints).

But as Judge Mehta has said in response to such claims, the conditions January 6 defendants are experiencing are the same that a number of other predominantly brown defendants, some of them who’ve been jailed significantly longer than the January 6 defendants, have been experiencing.

Or, in some cases, those other detainees were experiencing significantly worse conditions.

Update: Judge Lamberth ordered Worrell moved to Alexandria jail immediately, and released to home detention in Florida once Pre-trial services vets someone to take over his custody.

    Sure. But you should see state level jails. None are good. And they are not anywhere. Including the UK.

      I have read that the Federal prisons are better* than State prisons and deduce that County lock-ups are probably the bottom of the barrel.

        Worrell got what he wanted with this (needed?).

        Yeah, I have the distinct pleasure of having been in all of the categories. None are good. As a general rule, yes the federal ones are usually better than state and local ones. There must also be the distinction between jails and prisons, and, yes, there is a real difference. If you have to do time, it is generally better in actual prison than jail.

        FWIW, I used to get walked into quads to see clients, so really got to see what was going on. Even a couple of times into CB6, which was the state death row block at the time. That was long ago, It has changed now.

        Trust me, you do not ever want to be in any of these places, even the so called “Club Feds”. You would need a bath after even visiting the depths of any of them. Here is the thing, as bad as it is, is this worse than other countries? My only experience outside of the US is Mexico, and the US is far better than that.

          I had to visit Otisville not that long ago, with a reputation for being an “easy” bit. It looked and felt like a twenty year unwashed bus station.

          It has been my limited experience that while the conditions may be better federal-time is all-the-time, there’s little to no “time off for good behavior,” while at the state and county, in particular the county level there’s a high likelihood of getting matrixed out in a month.

          It’s been a long time, but I still have a hard time getting warm …

          In Arizona, an inmate does day-for-day, with the maximum of credit for good behavior and completed programs being 15% of the total sentence.

          One exception to the better off in prison than in jail is Texas during the summer time. County jails (mostly folks who haven’t been convicted of anything) have to be cooled to 85 degrees. And if you’re thinking 85 degrees indoors is pretty unbearable, you’re right. Except Texas prison cells, on the other hand, are mostly not air conditioned at all. And that means temperatures constantly over 100 degrees (even at night due to the way they are constructed) for weeks at a time. In 2011 there was a heat wave that killed 10 inmates from heat exhaustion.
          Let’s be honest. Most of Texas was and is uninhabitable without air conditioning. This problem is going to get worse with climate change. To me, this is the very definition of cruel and unusual punishment.

      A few years ago, the warden for the North Dakota state pen took trips to Norway to learn about their model for incarceration and, as I understand, has made progress in applying the model. I’d forgotten about that, and don’t have any direct knowledge. It’s a small enough state that when horrible things happen in jails (and there have been a good number of deaths from medical issues in county lockups that could have been prevented, and some sanctions) it makes the news, but doesn’t seem to happen much.

        The American jail/prison system can be much better, and should be much better. There is no question about that. There are better models of it, and Norway may be one.

        Unfortunately, doing it to scale in a place with different things is hard. Any progress is good progress though. Out on a limb maybe, but this needs to start with less incarceration, both pre-trial and post conviction.

          This is prison? Maybe. It depends on what you’re trying to do.

          Bmaz mentioned “less incarceration”, and I think (please correct me) that he includes “shorter” when he says “less”. My Lovely Wife is active in prison ministry, and I’ve had the privilege of seeing a guy who was released from the Texas prison system after 23 years, who had never used a cell phone – much less used (for instance) Google Maps on a cell phone to figure out what buses to ride. He was an excellent electrician – he worked on electrical systems at more than one Texas prison – but when he was released, he couldn’t be a licensed electrician because he’s an ex-felon. I’m pretty sure what we’re doing in Texas is warehousing people who have been convicted.

          If you think people in prison are ever going to get OUT of prison, you have to do things differently. I don’t know everything that needs to change, but my friend needed something between “life skills (what’s changed since you went inside)” and “shorter terms (so less changes while you’re inside)”.

          I happened to flip past one of the “behind bars” reality shows that toured (if I remember correctly) Belgian prisons, and at least some prisoners there were released every Friday to spend the weekend “outside”, so that they could recognize the world outside when their terms ended, including their families (especially children). The film crew said they were told that the prisoners come back (I have no idea whether they are wearing ankle bracelets), which makes sense if they miss the world outside and think they can make it.

          That’s … different from Texas. And probably not warehousing.

          “Less incarceration” can also mean “fewer people being incarcerated”, which would also be an improvement, considering where we are with prison overcrowding, but that’s another story.

    That’s quite a large movement of prisoners. No small task, and I hope the massive disruption is worth it to those involved.

    I’ve just learned that Mr. DeGrave 1) claimed that his “battle rattle” getup at the Capitol was a mere costume for a documentary; 2) had sent out a request on the crazy-people’s forums, in the days leading up to the big show, for a former SEAL or FBI agent to teach him how to shoot; 3) was coy about whether or not he was going to carry a weapon into the Capitol during a video he made on the way there; 4) is planning to run for mayor of Las Vegas.
