Joe Biden Pardons Hunter
According to NBC, in the face of Trump’s vows of retaliation, Biden has changed his mind about pardoning his son.
President Joe Biden has decided to issue a pardon for his son Hunter and is expected to announce it Sunday night, according to a senior White House official with direct knowledge of the decision.
The decision marks a reversal for the president, who has repeatedly said he would not use his executive authority to pardon his son or commute his sentence. The pardon comes ahead of Hunter Biden’s Dec. 12 sentencing for his conviction on federal gun charges. Hunter Biden also is set to be sentenced in a separate criminal case on Dec. 16, after pleading guilty in September on federal tax evasion charges.
Such a pardon would still be insufficient to protect Hunter against the ongoing witch hunt into him — there’s the referral of the false claims claim from the House, for example.
Update: Here’s Biden’s statement. As I suspected, NBC’s view of the pardon was too narrow. It covers any crimes committed before today.
Today, I signed a pardon for my son Hunter. From the day I took office, I said I would not interfere with the Justice Department’s decision-making, and I kept my word even as I have watched my son being selectively, and unfairly, prosecuted. Without aggravating factors like use in a crime, multiple purchases, or buying a weapon as a straw purchaser, people are almost never brought to trial on felony charges solely for how they filled out a gun form. Those who were late paying their taxes because of serious addictions, but paid them back subsequently with interest and penalties, are typically given non-criminal resolutions. It is clear that Hunter was treated differently.
The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election. Then, a carefully negotiated plea deal, agreed to by the Department of Justice, unraveled in the court room – with a number of my political opponents in Congress taking credit for bringing political pressure on the process. Had the plea deal held, it would have been a fair, reasonable resolution of Hunter’s cases.
No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son – and that is wrong. There has been an effort to break Hunter – who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, they’ve tried to break me – and there’s no reason to believe it will stop here. Enough is enough.
For my entire career I have followed a simple principle: just tell the American people the truth. They’ll be fair-minded. Here’s the truth: I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice – and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision.

Not surprised. Surprised when he did not do so earlier. What’s in it for either Joe or Hunter for him to not pardon? Started to doubt my instinct when it took Joe so long after the election. It’s the same thing with his dropping out. People now carping he took so long. People my age or older, different gender, West Coast, not Heartland Midwest on the dropping out. Probably keeping quiet on the pardon.
I was afraid Joe would take the high road and this was not the time for that. I am very glad he did this and it is the First piece of good news in over a month.
Good for Joe. In normal times, Joe Biden could and would have let the system work. These are not normal times. If Donald Trump believes in anything, it is in retribution so vindictive, personal, outsized, and punitive, it would make the Israeli govt hesitate to commit it.
Trump would have bent any rule, law, or norm to put Hunter Biden, sole surviving son of the hated Joe, in prison for decades, and encouraged everyone involved not to be “too gentle.” If anything untoward were to have happened to Hunter, Trump could easily pull out his pardon power. However reluctant Joe Biden was to act, he made the right move.
Another breath of reality. I hope he gives us more in the next month and change.

The broad scope of Joe’s pardon was essential. Kash Patel is only one voice who has credibly said Trump would pull out all the stops to retaliate against Donald Trump’s perceived enemies. Patel has promised publicly that it wouldn’t matter what the basis for that retaliation was, whether civil, criminal, or imaginary. They would figure it out later.
A smart move considering the threats from Trump, his team, his appointees, who brag about their hatred, retaliation, revenge. Telling people to be afraid.
Prosecuting Hunter Biden for saying he wasn’t using drugs on a gun application was so ludacris.
If they followed that letter of the law there should be tens of thousands being prosecuted, including (alledged) coke head Don Jr

We’ll still see weeks worth of hearings on the pardon. I imagine days of testimony being required of Hunter or he’ll face immediate persecution [sic] for criminal contempt of Congress, brought in the Amarillo courthouse in North Texas district. If Hunter testifies differently than talk radio and Kash Patel pre-determined, then I imagine perjury charges, brought in the same court, would follow.
What’s the best route for Hunter to take?
PS: I imagine that Joe Biden will refuse to testify on separation of powers grounds and that’ll throw things for a loop since Biden testifying means that Trump would also have to.

Unlike other defendants, Hunter will have top notch legal counsel and he’ll listen to it, so criminal contempt would be a bloody hard charge to prove. And North Texas would be a hard jurisdiction to sustain, as the statute provides that Congress refer a matter of criminal contempt to the USA for the DC district.
Most likely, they’ll wait until Trump’s in office, when Joe can’t help Hunter any more, and when rule bending and breaking will be the norm.

Trump will let it go. He gains nothing going after Hunter. He has other active targets, and does not want to drag the retaliation out. He will go after Smith and Garland. Machiavelli advised his prince, do the dirty work quick and then if you ease up it is appreciated. This pardon he lets go. He fires plenty civil servants up front, and it drags on via opposition litigation. SCOTUS ultimately and in total phoniness blesses Trump’s mayhem, and we move on. Alito writes this one, it does not hang together or make sense, but it becomes the law. Civil Service protections, Kaput.
Respectfully disagree. Their team invested an amazing amount of resources demonizing Hunter and using his name to demonize all sorts of other persons,places and things. Hunter’s pardon becomes a way to rationalize the enormity of Trump’s upcoming abuses, a tactic that needs Hunter’s body to succeed. He will accept the gift of Biden’s pardon and use it to justify all his more corrupt pardons. Low information voters will (with a media assist) shrug and say both sides are corrupt. Mission accomplished. Biden has just provided him the cover he needs to do actually corrupt and egregious stuff with his pardons. They’ve got their both-sides narrative to feed the press.
And his persecution prosecutions will be for targets they need to eliminate, not has-been political families with no influence any longer. Ten years ago I would have said this was wrong. But our political world has changed, and it’s hardly fair that all of Trump’s buddies (and quite possibly the Jan. 6th defendants) walk while Hunter suffers. And if it were 10 years ago, Hunter wouldn’t have been prosecuted like that anyway.
As a practical matter, this means we’ll probably never find out whether Judge Cannon was right or wrong on the special counsel question. There is no realistic scenario where that gets decided before Trump takes office.
There is no right here; my money is that this will depend on the defendent.

Questions:
1. Can Weiss (or any other special prosecutor Trump could appoint) still investigate Hunter for the criminal activity? Does the pardon just prevent the option to prosecute as I would imagine Trump and Patel will try to get as much dirt allowed as they could justify legally.
2. Who are the top 10 candidates to run in 2028? As they should all have rigorous opsec policies implemented through all of their immediate family members and their spouses. No more laptops to frame election October Surprises! Lol

Biden was Trump’s on radar at least by April 2018 as a need to damage for the 2020 election.
Whoever Trump or Elon sees as a viable threat in 2028 will be likely targeted by weaponized parts of government.

Joe’s pardon of Hunter was global and applies to any federal crime Hunter committed or might have committed at any time prior to the date and time Joe issued his pardon. By definition, there are no federal crimes a prosecutor might investigate that could be punished under federal law. State crimes, if any, remain unaffected by this pardon.
Yes, an FBI run by a Kash Patel might investigate him anyway, looking for who knows what, but there would be no predicate for those investigations. Congress could investigate him too, but the grounds are no more clear.
You can bet that Hunter Biden won’t pass a stop sign, drive over the speed limit, turn right on a posted-no turn on red intersection, or knowingly violate any other federal or state law for at least four years, at least not in a red state.

76 million voters “pardoned” Trump for his dozens of felonies. SCOTUS “pardoned” him for all future crimes in office. Trump pardoned his convicted felon buddies and then gave them jobs in the White House.

I’m seeing a fair portion of the professional commentariat, whether or not they agree that this pardon was justified, who are mad that President Biden “lied” about his intentions. I don’t think we know enough to say that the president did lie or whether he really made his mind up this weekend, as he says. I have long been expecting Pres. Biden to commute Hunter’s sentences, a possibility about which, as far as I can tell, he was never asked: reporters’ questions always seemed to be about a “pardon.” But I was not considering the House referral to which Marcy refers. (And can you commute a sentence that hasn’t been imposed yet? Can you commute a sentence for which there hasn’t even been a conviction yet?) We’d need, at the least, to compare a timeline of Biden and White House statements on the matter to when the House referral was made.

Which suggests the pardon power may not be exercised to commute a sentence before it has been imposred, and Marshall J stated that proposition was support for his assertion that:

However the full paragraph from Benz is as follows:

But no one disputes the Executive can excercise the pardon power to preempt the judgement altogether.

There is no doubt that Hunter was hounded for being his father’s son, and the course of justice for his minor crimes was distorted for political purposes as anyone reading Marcy’s work would know and understand.
It is obviously a matter for Joe Biden to figure out how best to redress the injustice and protect his son from futher victimisation.
I tentatively offer the thought that it might have been better to commute the sentences on the gun and tax convictions to penalties more in line with what might be typical for the offences, together with with a blanket pardon for any other matter, so protecting him from further vindictive investigation and prosecution.
The offenses are typically not prosecuted to begin with, but dealt with administratively.
True to form, the press makes it all about the president’s prior comments about NOT pardoning his son, as if he (Biden Sr.) were now breaking some pinky-promise. The president should follow up: “I changed my mind.”

would really like if this was a prelude to at minimum commuting all of the federal death row sentences. Wherever possible it is truly time to start defanging the incoming administration.
There are at least two ways I can think of to do that: First, Biden should arrange to have all of Trump’s appointees ‘properly vetted’ for their roles by the FBI. This is a normal step which Trump wishes to bypass. ‘Help Trump’ by making sure it happens.
Second, pardon everyone. Ordinary people are as much possible victims of Trump as the Bidens, Clintons, or Obamas.
Maybe not everyone, but ‘everyone not currently being investigated for a Federal crime.’
Seems like a perfect example of an official act – and one which should be done publically and transparently as an aid to the transition process

Hunter was never fully convicted on the gun charge. He had a verdict against him, no sentence. On the tax charge, a plea, no sentence. Kevin Morris liking the pardon is my bet. If Trump goes after anyone, it will be Morris, trying to destroy his career as private sector deep state. Trump will keep the P Diddy case active. Hunter will stay with this marriage and stay sober. Lawyer comments about whether he could run for office would help flesh out the picture. Not whether he’d win, but could he be kept off a ballot?
I think Hunter should move to Martha’s Vineyard. People would accept him there.
If Trump is really serious about crippling the deep state he will push against the revolving door. If he does, he will not succeed. That’s where the strong vested interests are.

If you’re a DACA kid, pack a bag, swipe an identity or just go to ground because they are coming for you. If you’re a liberal non-profit, either make yourself judgment-proof or marshal a lot of money for lawyers, because they are coming for you. Wasting a minute on pearl clutching as to whether pardoning Hunter Biden for throwing a gun into a trash can 8 or so years ago, or paying his taxes with interest is bad for Joe Biden or America is going to be seen in hindsight as past the point of ridiculous. I still wonder about Hunter Biden’s open plea deal in September. As a layman, it felt very unusual given all the potential legal issues with the case (for example, proving intent etc.)
I wonder if it was done intentionally to put more pressure on Joe Biden to pardon Hunter, in face of his of insistence on taking the “high-road”.

I doubt he would have but if he did it would not be out of mercy but to rub it in Joe Biden’s face and make himself look good to his MAGA cult. Something like “I did what Joe Biden didn’t have the guts to do.”

Except that Trump is a congenitally petty person. Trump musing on pardoning Hunter Biden was most likely just another way to “own the libs” — get them huffing and puffing about how outrageous that would be to keep them from focusing on other even worse ideas/policies. But Trump is one petty motherfucker so I could see him pardoning Hunter for the reasons that Matt Foley laid out. And also, in Trump’s view, the Bidens would then owe him for doing so. Because, along with being petty, everything is a transaction to Trump.

Joe was more than justified in dispensing with the flood of phony chum that the GOP has scattered on the waters, related to Hunter Biden’s misdeeds. Trump and his unqualified minions and his goons in Congress (Jordan and Comer, for example) would have made Hunter’s life miserable if Joe had not done this. Screw the naysayers – Joe had to do this. Watch them try to indict Joe after he leaves office but he obviously has stopped giving a flying f*ck and more power to him for that!
Glad Joe pardoned his son, the actual subject of a politicized prosecution.
