So can Barr be charged for anything on the Weiss vs Smirnov indictment or is he free and clear?
earlofhuntingdon says:
Barr hasn’t much to worry about on that score.

I learned a lot w/this podcast. I’ve really been frustrated w/the Garland behavior and I’m glad you addressed it. Is there any hope our president would replace Garland? I sure am tired of getting run over by the aggressive ‘hold no bars’ behavior of MAGAts and GOP. It always feels like we’re getting beat up. And Barr has nothing to worry about? I find that repulsive. I love my Friday night evening w/Marcy and Nicole. Thanks1

I don’t see the point of doing so before the election. Whatever else Garland has done, he has staved off impeachment, which is one less thing Biden has to worry about right now. Better to use SJC time confirming judges than getting another AG through confirmation.
I think there are better ways to hold Garland accountable for the ways in which he has enabled right wingers.
phred says:
I was thinking the same thing as I listened to your conversation. I can see Biden replacing Garland after the election (presuming Biden wins, of course), but not before.
However, I am curious what ways do you envision Garland can be held accountable for enabling right wingers other than being replaced? I can’t think of anything myself, but perhaps I lack imagination ; )
emptywheel says:
I wish all the TV lawyers who wail in imagination that they can pressure Garland to prosecute faster would instead start unpacking precisely what is going wrong here, and call that out. My suspicion is that there are a few key cogs that are doing really bad work, structurally.
And honestly, the Hur report is the first SCO abuse anyone cares about. Zero people, outside of a handful of NYT reporters, explained how abusive Durham was. No one gives a shit about Hunter Biden.
phred says:
Ah, now I understand : ) Excellent point. That is what the 4th estate is for, if they were willing to do the work. Glad we have you!
Apparently Kenneth Chesebro turned over a trove of emails and other docs to Michigan prosecutors, and they included details about a possible way the Jan 6 events might play out where they succeed in delaying the election certification past Jan 20 and prevent Joe Biden from taking office.
The plan would have seen the Trump campaign pushing Republican lawmakers to prevent Congress from certifying Joe Biden’s win not just on Jan. 6, but for days afterwards. GOP legislators would have feigned confusion over competing slates of electors, paralyzing Congress as the Trump campaign brought increasing pressure on the Supreme Court to step in and resolve the election in their favor.

Forgot to mention that I found it from a link in this Salon story, which reminds anyone not paying close attention that the Special Counsel’s “Jan 6 case” against Trump is about the entire months-long conspiracy, not just the events of Jan 6.
I hope we don’t have to wait long to find out how the Supreme Court will handle Trump’s immunity appeal in that case. Salon is right: Americans deserve to see that case go to trial before Trump is nominated as the Republican candidate. They deserve to know if he’s guilty of these charges before they go to the polls.
Good stuff for those of us still engrossed by the coup attempt of ’20-’21.

IANAL but if Republicans still control the House of Representatives at the end of this year, couldn’t it still happen that they delay verification forcing SCOTUS to intervene?

Between Trump’s comments las night (that they had plenty of votes but needed people watching the vote counters, and that he would betray NATO) and the clarity of the purge in the House, it seems increasingly likely Trump plans on winning in the House in Jan2025”
I seem to recall some posts on this blog as well around the same time (Oct 24, 2023). I can’t recall the details, but I’m sure that you can find it. Unless I’m wrong and my memory just plain sucks; that, too, is a possibility.😁😁

I’m slowly working through those articles, but just want to mention that there’s a sidebar in the second one that shows that CHESEBRO had an anonymous blog and Xitter accounts [Badger Pundit] …showing some examples of conversations during the coup. https://talkingpointsmemo.com/feature/two-weeks-of-chaos

I predict that on December 14, in several states both the Trump and Biden electors will cast their votes, and the electoral votes of any State still in dispute on January 6 won’t be counted.
If neither candidate has 270 votes, the House will then vote Trump a second term.

So you have an inside source who was in Ablow’s office and can corroborate info? Now I’m really curious what you think would cause Hunter to get involved with Ablow in the first place.
As far as Weiss using the photo and not looking at exif data, the photo appears in iPhone Backup –> Attachments-Messages with filename 20181120-130833-Keith-[a long stream of numbers and letters].jpg, so on the extracted device, and was possibly texted by Ablow to the number that wqs extracted.
I’m not sure if it appears elsewhere in the laptop with a different file name, but right there in that file name it shows as an attachment received from Ablow, “Keith” is how he is saved to contacts.
emptywheel says:
Is it possible that the rehab people Hunter tried in AZ in September recommended Ablow?
Re: that photo. We may see Lowell respond to it tomorrow, when a reply on the motion to compel is due. They SHOULD have filtered out messages from Ablow as a shrink. That’s sort of the point I was trying to make: if they got it from the message, it means they violated privileged communications.
zscoreUSA says:
I’m not familiar with rehab people in Arizona in September, what is the source for that? Let’s see Lowell response.
There is an interesting text exchange on 11/15 with the Blue Water Wellness manager.
H: I appreciate your kindness. I’m lucky to have found you. I guess technically you found me.

Interesting in it makes it sound like there was some efforts to reach out on the Ablow side, which they try to play off as completely Hunter.
