Trash Talk – Raider Nation Edition

No silly, not those Raiders, Al Davis died years ago, he just forgot to advise his still ambulatory carcass. I’m talking about the Texas Tech Red Raiders baby! Yes, Mrs. Randiego’s team is playing another huge game today, this week against the Oklahoma State Cowboys. OSU is the best team in Oklahoma according to Texas Radio (the one with the big beat).

Tech will get its first test as a top team with the Cowboys not far behind in statistics ad personnel. The Cowboys and Red Raiders rank in the top 10 nationally in total offense and scoring. They are fighting not only for a share of the lead in the Big 12 South, but also for the opportunity to stay alive in the BCS national championship picture. What may be the most interesting match-up is Tech’s No. 10 rushing defense against the Cowboys’ No. 5 rushing offense. Tech’s defensive line was by far the winning factor in controlling not only Colt McCoy — four sacks, one interception, one fumble — but also down in the trenches. Tech has allowed 349 yards per game this season and gave up less than 400 against Texas. The difference in the Longhorns and Cowboys are three talented running backs in Kendall Hunter (1,220 rushing yards) and Keith Totson (565 rushing yards). Add in quarterback Zac Robinson and the ability to run or throw, and suddenly a play-action pass to receiver Dez Bryant can turn the whole game around in a heartbeat. Robinson and Bryant have connected 60 times for 1,054 yards and 15 touchdowns this season. Another one could come down to the wire in Lubbock.

FAST FACTS: Cowboys — This is the third game in five weeks against a top 5 opponent on the road … OSU is trying to win two games in one season against top 10 opponents for the first time since 1976 … OSU hasn’t won in Lubbock since 1944. Red Raiders — Own the nation’s longest winning streak at 11 games, dating back to last season … Raiders have won eight of the last 11 in the series … Tech is 9-0 for the first time in 70 years.

The other huge game is Alabama and Liar Liar Nick Saban returning to a Saban-hate filled Baton Rouge and it’s LSU Cats. This could be ugly. The Tide can clinch the SEC West Championship with a win Saturday afternoon against LSU, and would appear to have clear sailing to a championship game against Florida in Atlanta. I don’t think so; am picking LSU to pull off the upset.

Elsewhere around the NCAA, it is not the most fascinating week. Utah already beat TCU in a curiously important, but sloppy game. That leaves Utah and Boise State left alive in the all important "mid-major that’s gonna get screwed by the BCS" category. Cal at USC is a big game, but won’t be a good one. The Trojans will wax the Bears badly. How the hell USC is rated #7 in BCS behind some of those other one loss teams is baffling. They did this to USC the last two years in a row at the end of the season, and, at least last year, they were probably the best team in the country and absolutely should have been playing in the title game instead of that pathetic Ohio State excuse. Who didn’t see that shellacking coming in the finale. Nobody; everyone knew, but there it was. Go figure.

In the National Favre League, there are actually, as opposed to the NCAA, several good matchups. Gosh bmaz, tell us about the mighty Bretts versus the Rams, you say. Okay, that is not the game of the week, but the Jets better watch out, the Rams show up to play at the damndest times. Steven Jackson is likely out though, so i will stick with the Favres at home.

The two best games look to be the Gents at Iggles and masaccio’s Titans at Da Bears. Both are wonderful matchups. Popular pundit wisdom seems to be that McNabb is going to rally the iggies over Eli. Yeah, I dunno about that. I think Good Eli comes to play and that the Giants are too consistent and solid for the Eagles, and the Philly fans get a little, um, you know, displeased. Again, go figure. And again, I am going to take the opponent of the Titans (they are not the Pats of Tom Brady and last year fer chrissakes, they gots to lose sooner or later). Plus it gives masaccio something to club me over the head with, and everybody enjoys that spectacle.

Other good games are the Bills at the Pats, I’ll take the Pats, the Cheeseheads at Vikings, where I’ll take the Pack, and the Colts at the Stillers. Don’t know about the last one; no clue. But I know this, Big Ben is hurting (although Byron Leftwich looked awesome last week) and Willie Parker looks to be doubtful again. Plus, the Colts just flat out need the win more and are starting to come together now that Bob Sanders is back. Colts pull out a narrow win, maybe by a Vinateri field goal. The Monday Night game is right here in Phoenix. 49ers are in town. This is just about as unfathomable a concept as is imaginable, but look for the Cards to whup the Niners and raise their record to 6-3. On a related note, look for the world to end.

Get to hootin n hollerin, a whoopin and a whompin. Trash it up!

    I’m with you, though. I think Da Bears could be the team that beats the Titans. Besides, there’s probably still some good luck lying around Solder Field’s immediate neighborhood. Plus, it might well be a little nasty tomorrow in Chicago.

    It’s amazing how we ‘Bama fans have warmed to Nick Saban this year. But with his price tag, I’m not sure we Wildcat folk can afford to play in the big leagues.

    I went down to the ‘Bama/Old Miss game and the deafening noise in a stadium of 90K+ during the last two minutes will never be replicated in the PAC (’Bama was ahead but Old Miss was driving at the time).

    I’m amazed at my Redskins – go Jason (see, I can say War Eagle also!!).

    Last week, the in-laws had to cheer for BOTH teams – they live in Austin and the soon-to-be-brother in law went to Texas. Man, that must have been tough!

    But this week, it’s ALL RED RAIDERS!!

    Of course, I’m missing the game. My brother turned 50 today and the party was scheduled before ABC decided to put Tech in primetime. Honeybunch is having her game-watching party with 20-30 completely pumped Texans, while I’ll be serving BBQ at my moms.

    Texas losing to Tech was one of the hardest losses for me to take, ever. And I was at the Cotton Bowl in Jan ‘91 when Miami in its heyday mauled Texas 46-3.

    The thing about the Big XII South this year is that there are 4 legit Top 10 teams – Texas, OU, TTech, and Okie St. This is truly a rare high point in teams and talent for the Big XII. The result is that it doesn’t come down to one game but a round robin of 3 for each team. Texas was the first to complete its gauntlet, falling to Tech at the very end. Tech, OSU and OU are all in the middle of theirs, each having two games remaining in the round robin (Tech- OSU,OU, OSU -Tech,OU).

    Undoubtedly, the best team will be the one that can adapt to the various strengths of the others while maintaining their focus and endurance without a falloff.

    I think OSU beats Tech today. I also think Tech and OU are the teams that end up with 2 losses in the round robin.

    Tedford and Mike Riley from Oregon State are the two of the best coaches scheme-wise in football. Matchups are where they excel. Jahvid Best will have a decent game (75 rushing yds and a TD) and he’s about all they have offense-wise (no QB). But defense is where Cal will keep it close. LB Worrell Williams and DB Sydquan Thompson are NFL caliber playmakers on defense – watch out for them.

    USC has the best defense in the NCAA. But, the offense is Sanchez and …

    USC – 24

    Cal – 10 (14 if Jahvid Best is a returner on ST and runs one back)

    WASHINGTON—[MA] Attorney General Martha Coakley is preparing to argue before the US Supreme Court in a case to decide whether prosecutors can use crime lab reports as evidence without having the forensic analyst who prepared them testify. AP

    Melendez-Diaz is scheduled for oral argument before the United States Supreme Court in Washington, D.C., on Monday, November 10, 2008, at 1:00 p.m.

    Melendez-Diaz was tried on the indictments in Suffolk Superior Court in September 2004. The drug analysis certificates were presented as evidence at trial. The chemist from the crime laboratory who prepared the reports did not testify at trial. The jury found Melendez-Diaz guilty and he was sentenced to three years in State Prison, and three years of probation.

    The documents I have do not indicate if counsel for Melendez-Diaz called the chemist (who prepared the ‘drug analysis certificate’) as a witness at trial but I assme they did not, and it appears the appeal is asserting the Commonwealth’s affirmative responsibility to present the specialist, if they submit the report as evidence.

    Would anybody argue that the state doesn’t not have to produce the scientist if they are subpoena’d by the defense? No.

    So if the defendant has the right to question the scientist, why must the state produce them if the defense counsel does not put them on the witness list?

    The issue before the Supreme Court in Melendez-Diazis whether reports such as drug analysis certificates from a state laboratory may be used as evidence in a criminal trial without calling the expert who prepared them to testify. The defendant asserts that the admission of such reports without calling the expert who prepared them is a violation of the Confrontation Clause of the Sixth Amendment, which affords an accused individual with the right to confront witnesses against him. The Commonwealth contends that drug analysis certificates are non-testimonial, and therefore not subject to the Confrontation Clause. The Commonwealth also argues that defendants have ample opportunity to review and challenge drug analysis through pretrial procedures, and that a rule requiring live testimony of lab analysts in every case would create unwarranted burdens and expenses for states.

      Neil – It boils down to this. The state is required to prove not just the guilt of the defendant beyond a reasonable doubt, but every element of the charge beyond a reasonable doubt. Reasonable doubt as to any individual element constitutes impermissible doubt as to the whole. In a drug case, proving that the substance at issue is, in fact the drug alleged, and that it was in a usable form and quantity, is an element of the crime charged. It is incumbent on the prosecution to establish this on the record. Allowing the prosecution to blithely enter some piece of paper on this critical element and then requiring the defendant to affirmatively disprove it if he desires, impermissibly shifts the burden of proof to the defendant by making him disprove the evidence instead of the prosecution proving it. That is contrary to the constitutional mandate that a defendant is innocent until proven guilty by the state. Cops, evidentiary custodial chains, police evidence rooms, crime labs and prosecutors make errors, intentional mischief, and all sorts of other mistakes with truly alarming frequency. If you don’t work in the criminal justice system, you probably have no idea of just how bad it is. The state should have to fully prove their case, and this includes the credibility and propriety of their alleged evidence.

        Thanks Bmaz. It’s a matter of law, not that the defendent can call the scientist as a witness but rather that the state must make the case and prove every element of it.
